ARTICLE XV

Miscellaneous Provisions

§ 158-117 Severability.

If any section, sentence, clause, provision or portion of this chapter shall be held to be invalid or unconstitutional by any court of competent jurisdiction, such holding shall not affect or impair any other section, sentence, clause, provision or portion of this chapter .

§ 158-118 Repealer.

All ordinances or parts of ordinances inconsistent with this chapter are hereby repealed to the extent of such inconsistency.

§ 158-119 When effective.

This chapter shall take effect immediately after final passage and publication thereof according to law.

§ 158-120 Pending applications.

All applications for development filed prior to the effective date of this chapter may be continued, but any appeals arising out of decisions made on any such application shall be governed by the provisions of §§ 158-69 and 158-70 of this chapter.

§ 158-121 Effect of preliminary approval of major subdivision or site plan.

Preliminary approval of a major subdivision pursuant to this chapter and N.J.S.A. 40:55D-48 or of a site plan pursuant to this chapter and N.J.S.A. 40:55D-46 shall confer upon the applicant the obligations and rights to proceed within the time periods and subject to the conditions set forth in N.J.S.A. 40:55D-49.

§ 158-122 Effect of approval of minor subdivision.

Approval of a minor subdivision pursuant to this chapter and N.J.S.A. 40:55D-46.1 shall confer upon the applicant the obligations and rights to proceed within the time periods and subject to the conditions set forth in N.J.S.A. 40:55D-47.

§ 158-123 Effect of final approval of major subdivision or site plan.

Final approval of a major subdivision or site plan shall confer upon the applicant the obligations and rights to proceed within the time periods and subject to the conditions set forth in N.J.S.A. 40:55D-52.

§ 158-124 Expiration of variance.

Any variance hereinafter granted by the Planning Board pertaining to the erection or alteration of any structure and structures or permitting a specified use of any premises shall expire unless such construction or alteration shall have been actually commenced on each and every structure permitted by said variance or unless such permitted use has actually been commenced within one year from the date of publication of the notice of the judgment or determination of the Board.
