Off-Street Parking Requirements; Loading Zones
§ 435-31 Spaces required.

A.
The following number of off-street parking spaces shall be provided and satisfactorily maintained by the owner of the property for each building, structure or premises which shall be hereafter erected, enlarged or altered for use of any of the following purposes, or the use of which shall be changed so that such building, structure or premises shall be hereafter used for any of the following purposes. Where there are multiple uses planned for a site, the required number of spaces for each use shall be combined to determine the total number of required spaces.
(1)
Hospitals: one parking space for every four beds.
(2)
Theaters, museums, galleries, and nonresidential uses permitted in the Arts and Culture District: one parking space for every seven occupants, as that term is defined in § 435-31D, plus one space for every employee on duty during the largest shift.

(3)
Hotels: one parking space for every two rooms plus one space for every employee on duty during the largest shift.
(4)
Dwellings:
(a)
One-family dwellings and RH Residence District apartments: 1 1/4 parking spaces for every dwelling unit.
(b)
Two-family dwellings: 1 1/2 parking spaces for every dwelling unit.
(c)
Multiple dwellings: 1.25 parking spaces for each efficiency apartment; two parking spaces for the first bedroom and 0.5 parking space for each additional bedroom. Any fractional space resulting shall be increased to a full space.
(e)
Condominiums, townhouses, apartments: one visitor space for every three units. Garage spaces shall not be credited towards the required spaces. Any fractional space resulting shall be increased to a full space.
(5)
All places of public assembly, such as auditoriums, churches and similar uses: one parking space for each seven permanent seats or an area equivalent to seven permanent seats.
(6)
Office buildings and professional buildings: one parking space for each 150 square feet of floor area.
(7)

(8)
All retail and service businesses: one parking space for each 150 square feet of floor area plus one space for every employee on duty during the largest shift.
(9)
Motels: 1 1/4 parking spaces for each room or unit plus one space for every employee on duty during the largest shift. Any fractional space resulting shall be increased to a full space.
(10)
Schools and instructional facilities for adults, including public, parochial, business and professional institutions: one parking space for each student, to be determined by the total capacity for students of the school or facility.
(11)
Food-serving establishments.
(a)
Restaurants: one per two seats, or one per 100 square feet of floor area, or one per three persons legally accommodated, whichever is greater, plus one space for every employee on duty during the largest shift.
(b)
Catering halls: three per 100 square feet plus one space for every employee on duty during the largest shift.
(c)
Bars, taverns and nightclubs: 1 1/2 per two persons legally accommodated plus one space for every employee on duty during the largest shift.
(d)
Restaurants, take-out: one per 150 square feet of floor area plus one space for every employee on duty during the largest shift.
(14)
If the application of the requirements of any subsection of § 435-31 shall result in a fractional parking space, said fractional parking space shall be increased to a full parking space.
(15)
Ministorage warehouse: one parking space per 2,000 square feet of gross floor area.
C.
Residential properties.
(1)
The Board of Trustees finds that an excess number of vehicles parked on residential properties can be indicative of overcrowding, a reduction of open space and/or a deterioration of property values.
(2)
Unless a permit is received from the Village for additional vehicles, a dwelling unit shall not have more than one vehicle for each conventional bedroom, plus one additional vehicle, parked on the property at night, nor shall vehicles be parked on the street in violation of applicable parking regulations. Both the owner and occupant of the property may be held liable in the event of a violation of this section of the Code.
D.
The occupancy limit of a particular site shall be the lesser of the occupancy calculations made for fire safety, parking, sewage treatment and public health. The calculations used in this section are intended solely for the determination of the required number of parking spaces for a particular site and should not in any way be interpreted as altering the formulas used to calculate the maximum occupancy of a site.
§ 435-32 Alteration or enlargement of structures.
A.
In the event that any building built prior to August 16, 1953, and not enlarged or altered since 1953 under the provisions of this chapter is altered or enlarged, the entire building as altered or enlarged (i.e., the existing building plus the addition) shall be considered new construction, and the number of parking spaces to be provided and maintained for such building as altered or enlarged shall be determined on such basis.
B.
In the event that any building built subsequent to August 16, 1953, under the provisions of this chapter is altered or enlarged, only that portion of the alteration or enlargement which is new shall be considered in determining the number of parking spaces to be provided under this article.
§ 435-33 Parking sites.

A.
All parking spaces provided pursuant to this article may be in the open or in private garages, or both, provided that no such parking spaces shall be in the front yard in any use district.
B.
All parking spaces shall be a minimum of nine by 20 feet and shall have a twenty-four-foot backup space.
C.
Driveways and turnarounds. Driveways and turnarounds providing access to parking areas shall conform to the following provisions:
(1)
A driveway for a single-family dwelling shall have a minimum width of nine feet, and a shared driveway serving a two-family dwelling shall have a width of 12 feet.
(2)
Properties with uses other than single-family and two-family dwellings shall be provided with adequate aisles or turnaround areas so that all vehicles may enter the street in a forward manner.
(3)
Properties with uses other than single-family and two-family dwellings shall be served by a driveway design and constructed to facilitate the flow of traffic on or off the site, with due regard to pedestrian and vehicle safety, and shall be clearly and permanently marked and defined. In no case shall two-way and one-way driveways be less than 20 feet and 12 feet respectively.
D.
Vision clearance. No signs, structures or vegetation in excess of 2 1/2 feet in height shall be placed in the vision clearance area. The vision clearance area consists of a triangular area. Two sides of the triangle consist of the lot lines that intersect at the street corner. Each side meets at the street intersection, and each side extends to a point along the lot line lying 25 feet from the street intersection. The triangle's third side is a line across the corner of the lot joining the other two sides. In the case of an intersection involving an alley and a street, the triangle is formed by a line connecting points 10 feet along the alley and 25 feet along the street. When the angle of intersection between the street and the alley is less than 30°, the distance shall be 25 feet. No signs, structures or vegetation or portion shall be erected within 10 feet of driveways unless the same is less than 2 1/2 feet in height.
§ 435-34 Construction and maintenance facilities.

All off-street parking spaces, except those provided for one- and two-family dwellings and loading spaces, shall be constructed and maintained in the following manner:
A.
All parking and loading spaces and the passageways and driveways appurtenant thereto shall be paved with an asphaltic or concrete surface. Parking lots in residential zones that contain less than 10 spaces may, at the discretion of the Planning Board, be surfaced with a permeable material, such as crushed rock, so long as a concrete, paver, or asphalt apron is used at the point where the driveway or passageway meets the street.
B.
The entire parking and loading area shall have adequate and self-contained drainage.
C.
All underground installations shall have suitable covers or bridges sufficient to support all traffic over the same.
D.
Each parking and loading space shall be clearly marked and delineated and shall have wheel or bumper guards.
E.
Access driveways and passageways shall be marked not only with entrance and exit signs but also with arrows indicating the proper flow of traffic.
F.
The entire parking area shall be fully illuminated at night during the business hours of the premises which it serves.
G.
Concrete curbs and sidewalks shall be provided along all street frontages, except that, in the event that a street is not actually improved, not maintained by any municipality or is not required for present or future use, then such requirement may be waived by the Planning Board.
H.
Paving, curbing, signs, catch basins and any other required work or installation shall fully comply with the Village of Patchogue standard street and public improvement construction specifications.
I.
In addition to the foregoing, the following shall apply to partially subterranean and subterranean parking:
(1)
Partially subterranean parking.
(a)
Shall be located within the site boundary and shall provide a minimum setback of five feet in the side and rear property lines and may extend up to the front property line.
(b)
At the front, side, and rear yard setbacks, the parking structure may extend an additional five feet, provided it is configured so that the additional portions meet the same criteria as for fully subterranean parking.
(c)
Planting and tree wells shall be provided as specified by the Planning Board.
(d)
Ventilation openings and grilles shall be concealed and shall not be visible from the street.
(2)
Subterranean parking.
(a)
Fully subterranean parking shall be located within the site boundary and may extend to all property lines.
(b)
A fully subterranean structure not covered by building volume shall be covered by soil with a minimum depth of two feet, recreating the natural grade before construction.
(c)
Planting and tree wells shall be provided as specified by the Planning Board.
(d)
Ventilation openings and grilles shall be concealed and shall not be visible from the street.
§ 435-35 Availability.
Parking spaces shall not be considered as provided pursuant to this article unless they are readily available to persons who are residents, employees or visitors of the building or premises for which such parking spaces are provided.
§ 435-36 Loading zone requirements.
In E Industrial District where no off-street parking is provided for on the same lot or lot on which the principal use is located, no building shall hereafter be erected, altered or enlarged unless such building shall be provided with one loading space, either as a part of the building or accessory thereto on the same lot, for each 8,000 square feet or fraction thereof of floor space. Such loading space shall be not less than 12 feet in width, 25 feet in length and 15 feet in height.
