CHAPTER 5

OFF-STREET PARKING AND LOADING REGULATIONS

9-5-1: GENERAL USES:

The regulations in this Chapter apply to all zoning districts and are adopted for the following purposes:
   A.   To provide necessary off-street parking and loading spaces in connection with all new residential, commercial and industrial development, including the enlargement and/or the extension of existing residential, commercial or industrial development within the incorporated limits of the Village and the unincorporated territory within one and one-half (11/2) miles of the corporate limits of Pawnee.
   B.   To provide for higher standards of all types of development within the Village of Pawnee.
   C.   To reduce traffic congestion resulting from the use of public streets as places for storage of private vehicles.
   D.   To alleviate substantial amounts of vehicular traffic that circulates through and parks within residential areas for access to and from commercial and industrial development.
Terms closely associated with this Chapter include, and shall be taken to mean:
ACCESSORY: Subordinate or incidental to the principal use.
EXTENSIONS, MAJOR REPAIRS OR SUBSTANTIAL ALTERATIONS: Reconstruction activities increasing the floor area, seating capacity, number of dwelling units or some other factor affecting the off-street parking or loading requirements established hereinafter when the cost thereof, including all material and labor, is found by the Zoning Administrator to be in an amount equal to or in excess of twenty five percent (25%) of the last tax valuation of the pertinent buildings or structures by the Sangamon County Assessor's Office, as equalized by the Department of Revenue, State of Illinois.)
OFF-STREET LOADING SPACE: An on-the-property space for temporary parking of a commercial motor vehicle which is loading and unloading merchandise or materials and which has direct access to a street, alley or other appropriate means of access. Such space shall not be less than ten feet (10') wide and fifty feet (50') long and shall not have less than seventeen feet (17') of vertical clearance, exclusive of access aisles and maneuvering space.
OFF-STREET PARKING SPACE: An on-the-property space of not less than one hundred eighty (180) square feet of appropriate dimensions for parking an automobile, exclusive of the access drives or aisles thereto. (Ord. 93-11, 6-14-93)

9-5-2: REQUIRED OFF-STREET PARKING SPACES FOR ALL USES:

In all districts in the Village, no building or structure shall be erected and no extension, major repairs or substantial alterations shall be made to an existing building or structure, unless there is already in existence upon the lot, or unless provision is made for the location on the lot concurrently with such erection or change, off-street parking space in accordance with regulations and requirements set forth hereinafter:
   A.   Single-Family Dwellings: Not less than one off-street parking space for each dwelling unit but no more than four (4) parking spaces for each single-family dwelling unit.
   B.   Two-Family Dwellings: Not less than two (2) nor more than four (4) off-street parking spaces for each two-family dwelling.
   C.   Multiple-Family Dwellings: Not less than one off-street parking space for each dwelling unit, except at least twenty (20) parking spaces for multiple-family dwellings containing twenty (20) or more dwelling units, plus two (2) parking spaces for each additional three (3) dwelling units over twenty (20) dwelling units.
   D.   Rooming or Lodging Houses: Not less than two (2) off-street parking spaces, plus one off-street parking space for each three (3) persons for whom living accommodations are provided.
   E.   Hotels, Motels and All Similar Places Offering Overnight Accommodations: Not less than one off-street parking space for each lodging room or dwelling unit.
   F.   Mobile Home Parks: Not less than one off-street parking space for each mobile home.
   G.   Community Facility Uses:
      1.   Churches or Similar Places of Worship: Not less than one off-street parking space for each eight (8) seats or at least one off-street parking space for each one hundred (100) lineal inches of seating space.
      2.   Civic, Cultural or Historical Institutions (Nonboarding): Not less than one off-street parking space for each eight hundred (800) square feet of floor area used or intended to be used by the public.
      3.   Clubs and Lodges: Not less than two (2) off-street parking spaces, plus one off-street parking space for each seven (7) seats in accordance with design capacity of the main meeting room.
      4.   Community Center or Recreational Buildings: Not less than one off-street parking space for each three (3) employees, plus not less than one off-street parking space for each eight hundred (800) square feet of floor area used by or intended to be used by the public.
      5.   Schools, Elementary or Junior High, Public or Private: Not less than one off-street parking space for each two (2) faculty members and other full-time employees.
      6.   Schools, High or Senior High, Public or Private: Not less than one off-street parking space for each ten (10) students.
      7.   Public Tennis Courts (Outdoors): Not less than one off-street parking space for each two (2) courts.
   H.   Amusement Facilities:
      1.   Amusement Parks, Golf Driving Ranges, Miniature Golf Courses: Not less than one off-street parking space for each six hundred (600) square feet of lot area to be used by the public. In the case of golf driving ranges, requirements apply only to portion of range used for tees.
      2.   Dance Halls, Gymnasiums, Pool Halls, Swimming Pools: Off-street parking spaces shall be provided equal in number to thirty percent (30%) of the capacity in persons for such establishments.
   I.   Automotive Services, Drive-In Retail Establishments:
      1.   Automotive Service Stations (Filling Station; Gas Station): Not less than one off-street parking space for each two (2) employees, plus one off-street parking space for the owner or manager.
      2.   Car Wash: Not less than one off-street parking space for each three (3) employees, plus one off-street parking space for the owner or manager and, in addition, reserve parking spaces equal in number to three (3) times the maximum capacity (greatest number of automobiles undergoing some phase of washing at the same time) of the car wash.
   J.   Public Utility or Public Service Facilities: Gas or electric substations, police and fire stations, radio or television stations, telephone exchanges and water or sewerage pumping stations and freight stations, public transit or truck terminals and other similar facilities: not less than one off-street parking space for each two (2) employees, as related to the working period when the maximum number of persons are employed on the premises.
   K.   Office Building and Retail or Service Establishments:
      1.   Professional, Governmental and Wholesale Offices as Well as Business Offices, Retail or Service Establishments: Not less than one off-street parking space for each two hundred (200) square feet of floor area used or intended to be used for service to the public as customers, patrons and clients, plus at least one additional off-street parking space for each two (2) employees.
      2.   Dental, Medical, Chiropractic or Osteopathic Offices or Clinics: Not less than one off-street parking space for each examining or treatment room, plus one off-street parking space for each doctor and employee in the building.
   L.   Schools: Business, Dance, Music and Trade: Not less than one off-street parking space for each two (2) employees, plus one additional off-street parking space for each five (5) students, based on the maximum number of students attending classes on the premises at any one time during any twenty four (24) hour period.
   M.   Wholesale, Manufacturing and Industrial Plants: (Including warehouse and storage buildings and yards, contractor equipment and lumber yards, blueprinting, printing engraving, soft drink, bottling plants, breweries, fabricating plants, research laboratories, and all other establishments devoted to producing, processing, cleaning, servicing, treating or repairing materials, goods or products.) Not less than one off-street parking space for each three (3) employees, as related to the working period when the maximum number of persons are employed on the premises. (Ord. 93-11, 6-14-93)

9-5-3: REQUIRED OFF-STREET LOADING:

In all districts, no building or structure shall be erected and no extensions, major repairs or substantial alterations shall be made to an existing building or structure in any district unless there is already in existence upon the lot or unless provision is made for the location on the lot concurrently with such erection or change, off-street loading space in accordance with minimum requirements set forth hereinafter:
   A.   Rooming or Lodging: No less than one off-street loading space for each building having ten thousand (10,000) to one hundred thousand (100,000) square feet of floor area, plus one additional off-street loading space for each additional one hundred thousand (100,000) square feet of floor area or fraction thereof.
   B.   Multiple Family Residence, Hotels, Motels, Private Clubs and Lodges, Tourist Homes and Cabins, Transient Trailer Parks and all Other Similar Places Offering Overnight Accommodations: Not less than one off-street loading space for each building having ten thousand (10,000) to one hundred fifty thousand (150,000) square feet of floor area, plus one additional off-street loading space for each additional one hundred fifty thousand (150,000) square feet of floor area or portion thereof.
   C.   Community Facility Uses, Such as Aquariums; Art Galleries; Libraries; Museums; Auditoriums; Assembly Halls; Churches; Civic, Cultural or Historical Institutions; Clubs (Nonbusiness); Colleges, Junior and Senior; Universities; Community Centers; Recreational Buildings; Convents; Hospitals; Sanitariums; Nursing Homes; Schools and Similar Institutions: Not less than one off-street loading space for each building having ten thousand (10,000) to one hundred fifty thousand (150,000) square feet of floor area, plus additional off-street loading spaces for each one hundred fifty thousand (150,000) square feet of floor area or fraction thereof.
   D.   Amusement Facility Uses such as Fairgrounds, Race Tracks, Bowling Alleys, Dance Halls, Gymnasiums, Theaters (Indoor) and Similar Uses: Not less than one off-street loading space for each building having ten thousand (10,000) to one hundred fifty thousand (150,000) square feet of floor area, plus additional off-street loading spaces for each one hundred fifty thousand (150,000) square feet of floor area or fraction thereof.
   E.   Public Utility and Public Service Facility Uses:
      1.   Airports, Railroad Passenger and Freight Stations, Public Transit, Bus and Motor Freight Terminals, Post Offices: Not less than one off-street loading space for each building having ten thousand (10,000) to one hundred fifty thousand (150,000) square feet of floor area, plus one additional off-street loading space for each additional one hundred fifty thousand (150,000) square feet of floor area or portion thereof.
   F.   Banks and Business Offices (Nonretail) including Professional and Government Offices, Medical Clinics: Not less than one off-street loading space for each building having ten thousand (10,000) to one hundred thousand (100,000) square feet of floor area, plus one additional off-street loading space for each additional one hundred thousand (100,000) square feet of floor area or portion thereof.
   G.   Retail or Service Establishments and Eating and Drinking Establishments: Off-street loading spaces shall be provided in accordance with the following schedule:

For each additional one hundred thousand (100,000) square feet of floor area, or fraction thereof in such a building, one additional off-street loading space shall be provided.
   H.   School; Business, Dance, Music or Trade: Not less than one off-street loading space for each building having ten thousand (10,000) to one hundred fifty thousand (150,000) square feet of floor area, plus one additional off-street loading space for each additional one hundred fifty thousand (150,000) square feet of floor area or portion thereof.
   I.   Wholesaling, Manufacturing and Industrial Plant, Including Warehouse and Storage Buildings and Yards, Contractor Equipment and Lumber Yards, Blueprinting, Printing, Engraving, Soft Drink Bottling Plants, Breweries, Fabricating Plants, Research Laboratories, and All Other Establishments Devoted to Producing, Processing, Cleaning, Servicing, Treating or Repairing Materials, Goods or Products: At least one off-street loading space for each building having five thousand (5,000) to forty thousand (40,000) square feet of floor area; at least two (2) off-street loading spaces for each building having forty thousand (40,000) to one hundred thousand (100,000) square feet of floor area; plus one additional off-street loading space for each additional one hundred thousand (100,000) square feet of floor area or fraction thereof. 9-5-4: RESTRICTIONS ON LOCATION AND USE OF OFF-STREET PARKING AND LOADING FACILITIES:

   A.   Restrictions on Off-Street Parking Facilities Location and Use: In connection with any building or structure which is to be erected or substantially altered and which requires off-street parking spaces, such off-street parking space shall be provided in accordance with the following restrictions:
      1.   Location: Parking spaces required for single- or two-family dwelling units shall be located on the same lot as the dwelling served. Parking spaces required for all other uses, in the Village of Pawnee, which were established after September 8, 1975, shall be located on the same lot as the use served. Uses other than single- or two-family dwellings which were in existence on September 8, 1975, which are subsequently altered or enlarged and new uses in the Village may be served in accordance with requirements of this Title, by off-street parking facilities located on land other than the lot on which the building or use served is located; provided, such facilities are located within three hundred feet (300') walking distance from the main entrance to the use served.
      2.   Use: Except as may otherwise be provided for parking trucks or in connection with special uses, off-street parking facilities, required as accessory to uses listed herein, shall be solely for the parking of passenger automobiles of patrons, clients, occupants or employees.
   B.   Restrictions on Off-Street Loading Facilities Location and Use: In connection with any building or structure which is to be erected or substantially altered and which requires the receipt or distribution of materials or merchandise by trucks or other similar motor vehicles, off-street loading spaces shall be provided with not less than the minimum requirements specified herein.
      1.   Location: All required off-street loading spaces shall be located on the same lot as the use to be served and no portion of the vehicles shall project into a street, alley or other public right of way. In an industrial district, no off-street loading space for vehicles of more than two (2) ton capacity shall be located less than fifty feet (50') from any residential district nor shall it be located in a required front yard or side yard.
      2.   Use: Except as may otherwise be provided for parking trucks or in connection with special uses, off-street loading facilities, required as accessory to uses listed herein, shall be solely for the receipt or distribution by private, public or commercial motor trucks of materials or merchandise. 9-5-5: ADDITIONAL REGULATIONS FOR REQUIRED OFF-STREET PARKING AND LOADING FACILITIES:

In connection with any building or structure which is to be erected or substantially altered and which requires off-street parking and loading spaces, such off-street parking and loading spaces shall be provided in accordance with the additional regulations hereinafter specified.
   A.   Additional Off-Street Parking Regulations:
      1.   Size: A required off-street parking space shall be at least nine feet in width and at least twenty feet in length (9' x 20'), exclusive of access drives, aisles, ramps, columns and office or work area. Such space shall have a vertical clearance of at least seven feet (7').
      2.   Access:
         a.   Each required off-street parking space shall open directly upon an alley or driveway. Means of access shall be subject to review by the Village Engineer.
         b.   A parking area containing four (4) or more off-street parking spaces shall have vehicular access to it over a street, alley or driveway containing all-weather, hard-surfaced pavement. The location and route of access to such a parking area shall be identified. No driveway access to public property shall have a width exceeding twenty four feet (24'), exclusive of curbs.
      3.   Repair and Service: No motor vehicle repair work of any kind shall be permitted in off-street parking area, other than the owner of a lot repairing his own vehicle. No gasoline or motor oil shall be sold in conjunction with any accessory parking facilities unless such facilities are located within a completely enclosed building, in which case gasoline and motor oil may be sold to the users of such facilities within such building; provided, that no advertising sign is visible from outside the building, and provided further, that all gasoline pumps shall be effectively screened from view from the street.
      4.   Computation: When determination of the number of off-street parking spaces required by this Title results in a requirement of a fractional space, any fraction of one-half (1/2) or less may be disregarded, while a fraction in excess of one-half (1/2) shall be counted as one off-street parking space.
      5.   In Yards: Off-street parking spaces may be located in required yards, except no vehicle shall be parked closer than five feet (5') from the street.
      6.   Collective Provisions for Nonresidential Uses: Off-street parking facilities for separate uses may be provided collectively if the total number of spaces so provided is not less than the sum of the separate requirements of each such use and if all regulations governing the location of accessory parking spaces in relation to the use served are observed. But no off-street parking space, or portion thereof, shall serve as the required space for more than one use unless otherwise authorized in accordance with this Title.
      7.   Design and Maintenance:
         a.   Surfacing: Except for single-family dwellings, all open off-street parking areas shall be improved with a compacted macadam base or equivalent, of not less than four inches (4") thick, with an asphaltic concrete surface or a comparable hard-surfaced all-weather material.
         b.   Open and Enclosed Parking Spaces: Off-street parking spaces, located on the same lot as occupied by the principal use, may be open to the sky or enclosed in a building.
         c.   Screening and Landscaping: All open off-street parking spaces containing more than four (4) parking spaces shall be effectively screened for privacy, light and sound on each side and adjoining or fronting on any residential or institutional use by a solid wall or solid fence not less than six feet (6') in height and shall have wheel stops of masonry, steel or timber placed not nearer than five feet (5') from the street line in districts where a front yard is not required or from side lot lines.
         d.   Lighting: Illumination of an off-street parking area shall be arranged so as not to reflect rays of light into adjacent residential districts and streets. All lighting shall be extinguished no later than thirty (30) minutes after the close of business of the principal use being served, except as may be otherwise authorized by the Village Board.
   B.   Additional Off-Street Loading Regulations:
      1.   Size: A required off-street loading space shall be at least ten feet in width and at least fifty feet in length, exclusive of aisle and maneuvering space, and shall have vertical clearance of at least seventeen feet (10'x50'x17').
      2.   Access: Each required off-street loading space shall be designed with means of motor vehicular access to a street or alley in a manner which will least interfere with traffic movements.
      3.   Repair and Service: Neither storage of any kind nor repair work or service of any kind on motor vehicles shall be permitted within any required loading space.
      4.   Design and Maintenance Surfacing:
         a.   Surfacing: All open off-street loading spaces shall be improved with a compacted macadam base not less than eight inches (8") thick or equivalent, with not less than two inches (2") of asphaltic-concrete surfacing or a comparable all-weather, dustless material.
         b.   Allocated Spaces: Space allowed to any off-street loading space shall not, while so allocated, be used to satisfy the space requirements for any off-street parking facilities or portions thereof. (Ord. 93-11, 6-14-93)

9-5-6: OTHER REGULATIONS FOR OFF-STREET PARKING AND LOADING FACILITIES:

The number of off-street parking or loading spaces required upon the erection or substantial alteration of a building shall not be reduced, except upon written approval of the Zoning Administrator after proof that, by reason of diminution in floor area, seating, number of employees or change in other factors controlling the requirements for off-street parking or loading spaces, the proposed reduction is consistent with the provisions of this Chapter. Whenever an increase in floor factors or change in the use of a building or structure creates a need for an increase of more than twenty five percent (25%) of the number of off-street parking or loading spaces as determined by the requirements of this Chapter, more off-street parking or loading facilities shall be provided within six (6) months.
