CHAPTER 6

BUILDING PERMITS AND CERTIFICATES OF OCCUPANCY

10-6-1: DEFINITIONS:

For purposes hereof, the following terms, phrases, words and their derivations shall have the meanings given herein:
   ACCESSORY BUILDING: Any building or structure incidental and subordinate to the main building and located on the same lot or property with the main building.
   APPROVED: Approved in accordance with regulations promulgated by the city commission of the city of Perkins.
   BUILDING: Any building, structure, or portion thereof, which is occupied as, or designed or intended for occupancy as, a residence by one or more families, and any building, structure, or portion thereof, that is used as a business, commercial venture, is open or accessible by the public, or which may be wholly or partly used or intended to be used by the public.
   BUILDING CODE: The building code of this city.
   BUILDING INSPECTOR: The building inspector of this city.
   CITY: The city of Perkins, Oklahoma.
   CITY CLERK: The city clerk of the city of Perkins, Oklahoma, or his authorized representative.
   DWELLING: Any building or structure designed for occupancy as a residential structure.
   PERSON: Includes one or more individuals, corporations, partnerships, associations, labor organizations, trusts, unincorporated organizations, trustees, trustees in bankruptcy, receivers and fiduciaries.
   PORTABLE BUILDING: Any structure or edifice that encloses a space within its walls and usually, but not necessarily, is covered by a roof and that is mounted on skids, rails or other similar device, not including wheels, that will allow such structure or edifice to be moved.
   PREMISES: A lot, plot or parcel of land, including the building and structures thereon.
   STRUCTURAL ADDITION: Any roofed canopies or enclosed porch, room or structure used in connection with a building; provided, the construction of a concrete slab porch without a roof or walls shall not be a structural addition.
   STRUCTURAL ALTERATION: To change the exterior foundation line or location of a structure. (2010 Code § 22-12)

10-6-2: BUILDING PERMIT:

A.   Required: It shall be an offense for any person to change or permit the change in the use of land or buildings or structures, or to erect, alter, move or improve any building or structure, other than changing, adding or deleting siding materials, in accordance with the building code until a building permit has been obtained under the following conditions.
B.   Information Required: The applicant shall be required to furnish the following information:
   1.   A plot plan legibly drawn to scale, showing the exact size, shape and dimensions of the lot to be built upon, the exact size and location on the lot of all existing buildings and structures, and the exact size and location on the lot of the structure or building proposed to be repaired, altered, erected or moved, and the size, arrangement, number of parking stalls, movement of vehicles, and ingress and egress drives for all off street parking and loading facilities.
   2.   A declaration of the existing and intended use of each existing and proposed building or structure on the lot and the number of families and housekeeping units which each existing building accommodates and which each existing and proposed building is designed to accommodate.
   3.   Any additional information relating to the proposed improvement needed to determine compliance with these regulations. (2010 Code § 22-11)
C.   Additional Requirements; Exception:
   1.   Residential Building Permit Defined: A "residential building permit" shall be defined, for purposes of this subsection, as any building permit for a single-family or a duplex residential structure and shall include construction of a new structure, remodel of an existing structure, and the addition to an existing structure. Not included under the definition of a residential building permit, for purposes of this subsection, are a single-family or a duplex carport, patio cover, storage building, accessory building, pool or fence.
   2.   Requirements: All applicants for issuance or renewal of residential building permits shall, in addition to existing requirements of this title, be required to:
      a.   Provide the city a certificate of insurance from the appropriate insurer that the contractor has general liability insurance in an amount required by other construction trade contractors licensed by the construction industries board;
      b.   Provide written verification that the contractor has workers' compensation insurance or a workers' compensation exemption verification document; and
      c.   Pay the additional sum of four dollars fifty cents ($4.50), of which four dollars ($4.00) will be forwarded to the Oklahoma uniform building code commission.
   3.   Exception: The provisions of this subsection shall not apply to a person or persons performing the construction or remodeling to his, her or their own single-family or duplex structure on their own property regardless if the construction or remodeling is to a single-family or duplex structure that is also for rental purposes, unless the modifications are being performed by and the permit is acquired by a general contractor or subcontractor, in which case, the general contractor or subcontractor shall meet the requirements set forth in this subsection. D.   Records Maintained: A careful record of such applications and plot plans shall be kept in the office of the building inspector. (2010 Code § 22-11)

10-6-3: CERTIFICATE OF OCCUPANCY:

A.   Completion Of Improvements Required: Prior to the issuance of any certificate of occupancy, the applicant shall complete, in a manner satisfactory to the building inspector, all improvements required by these regulations and as required by the mayor and city commission.
B.   Certificate Of Occupancy Required: No vacant land shall be occupied or used, except for agricultural uses, and no building erected or structurally altered shall be occupied or used until a certificate of occupancy shall have been issued by the building inspector.
C.   Time Of Application: A certificate of occupancy for the use of vacant land or to change any use thereof shall be applied for before any such land shall be occupied or used and a certificate of occupancy shall be issued within three (3) days after application has been made; provided, that the use is in conformity with the provisions of the ordinances of the city.
D.   Building Code Applicability: The certificate of occupancy for the use of the building shall be as provided by the building code of the city.
E.   Fee:
   1.   No fee shall be charged for the original certificate of occupancy issued in connection with construction of a building. (2010 Code § 22-11)
   2.   For all other certificates or copies of any original, there shall be a charge as established by resolution of the city commission. (2010 Code § 22-11; amd. 2012 Code)

10-6-4: EXCAVATION PERMIT:

No permit for excavation for any building shall be issued before application has been made therefor. (2010 Code § 22-11)

10-6-5: PORTABLE BUILDINGS:

It shall be unlawful for any person, firm, corporation or other entity to erect, move in or place any portable building within the corporate limits of the city without first securing a permit for such portable building from the city clerk. There shall be no fee for such portable building permit. (2010 Code § 22-11)
