ARTICLE III

DISTRICTS GENERALLY; OFFICIAL ZONING MAP

Sec. 29-81.- Schedule of district regulations.

In order to regulate the locations of trades, industries and other uses, and the location of buildings designed, erected, altered or occupied for specific purposes; to regulate the height and size of buildings hereafter erected or altered; to regulate the density of population, the city is hereby divided into districts designated as follows:

R-1 Residential district
R-2 Residential district
R-3 Residential district
R-4 Residential district
R-MF Multifamily residential district
R-HR Residential high-rise district
R-PUD Residential planned unit development
B-1 Neighborhood business district
B-2 Community and regional shopping center district
B-3 Highway commercial district
B-4 General commercial district
B-5 Central business district
B-6 University Drive district
C.I.PUD Commercial—industrial planned unit development district
I-1 Light industrial district
I-2 Heavy industrial district
I-3 General industrial district
I-4 Industrial district
R-R Recreational district
R-B Residential-commercial district
A-R Agricultural-residential district

Sec. 29-82. - Establishment of districts and provision for official zoning map.

(a)

The city is hereby divided into districts, or zones, as shown on the official zoning map which, together with all explanatory data thereon, is hereby adopted by reference and declared to be part of this chapter.

(b)

The official zoning map shall be identified by the signature of the mayor, attested by the city clerk and bearing the seal of the city under the following words: "This is to certify that this is the official Zoning Map referred to in Section 2 of the 1981 Zoning Ordinance of Pine Bluff, Arkansas, adopted on the 2nd day of February, 1981."

(c)

If, in accordance with the provisions of this chapter, changes are made in district boundaries or other data portrayed on the official zoning map, such changes shall be made on the official zoning map within thirty (30) days after the amendment has been approved by the city council. The amending ordinance shall provide that such changes or amendments shall not become effective until they have been duly entered upon the official zoning map.

(d)

No changes of any nature shall be made in the official zoning map or information shown thereon except in conformity with the procedures set forth in this chapter. Any unauthorized change of whatever kind by any person shall be considered a violation of this chapter and punishable under section 29-4.

(e)

Regardless of the existence of purported copies of the official zoning map which may from time to time be made or published, the official zoning map which shall be located in the office of the city zoning department shall be the final authority as to the current zoning status of lands, buildings, and other structures in the city.

Sec. 29-83. - Rules for interpretation of district boundaries.

Whereas uncertainty exists as to the boundaries of districts as shown on the official zoning map, the following rules shall apply:

(1)

Boundaries indicated as approximately following the centerlines of streets, highways, alleys or creeks shall be construed to follow such centerlines.

(2)

Boundaries indicated as approximately following city limits shall be construed as following city limits.

(3)

Boundaries indicated as approximately following platted lot lines shall be construed as following such lot lines.

(4)

Boundaries indicated as following shore-lines shall be construed to follow such shore-lines, and in the event of change in the shoreline shall be construed as moving with the actual shoreline.

(5)

Boundaries indicated as parallel to or extensions of features indicated in paragraphs (1) through (4) of this section shall be so construed. Distances not specifically indicated on the official zoning map shall be determined by the scale of the map.

(6)

Whenever any street, alley or other public way is vacated or abandoned by official action by the mayor and city council, the zone district boundaries on each side of such street, alley or public way shall be automatically moved to the centerline of same and all areas included therein shall then and henceforth be subject to all appropriate regulations on the extended districts.

(7)

Where the street or property layout existing on the ground is not in accordance with that shown on the official zoning map, or in other circumstances not covered by paragraphs (1) through (6) of this section, the board of zoning adjustment shall interpret the district boundaries.
