CHAPTER 15

TELEVISION SATELLITE ANTENNAS

10-15-1: DEFINED:

"Television satellite antenna (or dish antenna)" is a combination of an antenna or dish antenna whose purpose is to receive communication or other signals from orbiting satellites; a low noise amplifier (LNA) which is situated at the focal point of the receiving component and whose purpose is to magnify and transfer signals; and coaxial cable whose purpose is to carry the signals into the interior of a building. 10-15-2: BUILDING PERMIT REQUIRED:

A building permit shall be obtained before any television satellite antenna is constructed on any lot in the city. The fee for the permit shall be set from time to time by the city council by resolution or motion and minute entry. The fee is initially set at fifteen dollars ($15.00). It shall be a class C misdemeanor and upon conviction, subject to penalty as provided in section 1-4-1 of this code, to construct or locate any television satellite antenna on any lot in violation of this section, or any other section of this chapter. 10-15-3: LOCATION:

Any television satellite antenna shall be located as follows:
   A.   All television satellite antennas shall have setbacks of at least five feet (5') from any property line. The setbacks shall be measured from the property line to the nearest point on the antenna. For a rotating dish, the measurement shall be from the nearest point of the antenna in its closest rotation configuration to the property line.
   B.   In any residential zone, the antenna shall be located in the rear yard. Upon proper application to the hearing officer and upon their finding that a usable satellite signal cannot be obtained by locating the antenna in the rear yard, the antenna may be permitted in the side yard or on the roof of a building. The antenna shall not be located in the front yard or in the side yard facing the street on a corner lot under any circumstances.
   C.   In any nonresidential zone, the antenna shall be located either in the rear yard or in a side yard or on the roof of a building. Upon proper application to the hearing officer and upon their finding that a usable satellite signal cannot be obtained by locating the antenna in one of these areas, the antenna may be permitted in the front yard or in the side yard facing the street on a corner lot. 10-15-4: NUMBER:

Not more than one television satellite antenna shall be allowed on any lot in any zone. (Ord. 85-8, 11-14-1985)

10-15-5: SIZE:

No television satellite antenna shall exceed thirteen feet (13') in diameter in any zone. No television satellite antenna which is placed upon a roof shall exceed one meter in diameter. (Ord. 85-8, 11-14-1985)

10-15-6: HEIGHT:

When constructed or located on the ground, no television satellite antenna shall exceed the height of sixteen feet (16'). When constructed or located on the roof of a building, the overall height of the building and antenna shall not exceed the maximum height restrictions applicable to the zone. (Ord. 85-8, 11-14-1985)

10-15-7: CONSTRUCTION STANDARDS:

   A.   The antenna shall be securely mounted and anchored to the ground (or roof) in accordance with the requirements of the manufacturer of the antenna and the building code. (Ord. 85-8, 11-14-1985; amd. 2003 Code)
   B.   Every antenna must be properly grounded for protection against a direct strike by lightning.
   C.   All electrical and antenna wiring (or cable) shall be placed underground or otherwise obscured from view in a manner approved by the building inspector.
   D.   The surface of the antenna (dish) shall be treated or painted so as not to reflect glare from the sunlight. (Ord. 85-8, 11-14-1985)
