ARTICLE I
General Provisions
§ 360-1 Short title.
This chapter shall be known and may be cited as the "Zoning Ordinance of the City of Plattsburgh, New York."
§ 360-2 Authority.
Pursuant to the authority and power granted by the General City Law of the State of New York, Chapter 21, Article 2-A, of the Consolidated Laws, to regulate and limit the height, and determine the area of yards, courts and other open spaces and to regulate the density of population in any given area and for said purposes divide the City into districts, the Common Council of the City of Plattsburgh, New York, does ordain the following provisions.
§ 360-3 Purpose.
The zoning regulations and districts herein set forth and as identified upon the Zoning Map of the City of Plattsburgh[1] are made in accordance with a Comprehensive Plan for the purpose of promoting the public health, safety, morals, convenience, order, prosperity and general welfare of the community. They have been designed to lessen congestion in the streets; to secure safety from fire, panic and other dangers; to provide adequate light and air; to prevent the overcrowding of land; to avoid undue concentration of population; and to facilitate the adequate provision of transportation, water, sewerage, schools, parks and other public requirements. They have been made with reasonable consideration, among other things, as to the character of each district and its suitability for particular uses and with a view of conserving the value of buildings and encouraging the most appropriate use of land throughout the City of Plattsburgh and to achieve the following specific purposes:
A.
To promote an orderly, economical and desirable development of the entire community.
B.
To encourage the most appropriate use of land in the community in order to conserve and enhance the value of property.
C.
To provide adequate open spaces in order to ensure access of light and circulation of air, in order to facilitate the prevention and fighting of fires, in order to prevent undue concentration of population and in order to lessen congestion on streets and highways.
D.
To protect the right to solar access in order to facilitate the use of this alternate energy source by residents and property owners.
E.
To create an attractive and cohesive central business district.
F.
To improve the financial structure of the City by increasing the rate of growth of municipal income through enhanced value of property.
G.
To slow down the deterioration cycle of neighborhoods.
H.
To enhance the aesthetic aspects throughout the entire community.
I.
To ensure that tax revenues will remain sufficient to meet the increasing expenses of government.
