CHAPTER 1

PURPOSE AND INTERPRETATION

8-1-1: PURPOSE OF ZONING TITLE:

The Zoning regulations and districts as herein established have been made in accordance with a Comprehensive Plan for the purpose of promoting the health, safety, morals and general welfare of the City. They have been designed to lessen the congestion in the streets; to secure safety from fire, panic and other dangers; to provide adequate light and air; to prevent the overcrowding of land; to avoid undue concentration of population; to facilitate the adequate provisions of transportation, water, sewage, schools, parks and other public requirements. They have been made with reasonable consideration, among other things, for the character of the district and its peculiar suitability for particular uses, and with a view of conserving the value of buildings and encouraging the most appropriate use of the land throughout the incorporated area of the City. 8-1-2: INTERPRETATION:

   A.   In the interpretation and application of the provisions of this Title the requirements will be held to be minimum requirements. This Title is adopted in compliance with the Idaho Code for the purpose of promoting the health, safety, and general welfare of the citizens of the City and the State.
   B.   When this Title imposes a greater restriction upon the use of buildings or premises or requires larger spaces than are imposed by other codes, resolutions, rules and regulations, or covenants the provisions of this Title shall control. The provisions of this Title shall be so interpreted as shown on the City Comprehensive Plan. (Ord. 320, 9-14-95)
