ARTICLE I
Title; Scope; Purpose
§ 150-1 Title.
This chapter shall be known and may be cited as the "Land Use Regulations of the Town of Poestenkill, Rensselaer County, New York." The Land Use Regulations are Chapter 150 of the Code of the Town of Poestenkill.
§ 150-2 Scope.
A.
This chapter regulates the location, construction, alteration, occupancy and use of buildings and structures and the use of land in the Town of Poestenkill and, for said purposes, divides the Town into land use districts.
B.
The Town Board of the Town of Poestenkill, as permitted by Municipal Home Rule Law § 22, Effect of local laws on acts of legislature or prior local laws or ordinances, expressly supersedes § 268, Subdivision 2, of Town Law, Enforcement and remedies, in § 150-82C, Penalties for offenses, of this chapter.
C.
The portion of Town Law § 268, Subdivision 2, to be superseded follows. Words which are to be eliminated are in brackets.
" . . . upon the failure or refusal of the proper local officer, board or body of the town to institute any such appropriate action or proceeding for a period of 10 days after written request by a resident taxpayer of the town so to proceed, any three taxpayers of the town [residing in the district wherein such violation exists], who are jointly or severally aggrieved by such violation, may institute such appropriate action or proceeding in like manner as such local officer, board or body of the town is authorized to do." |
§ 150-3 Purpose.
This chapter is enacted pursuant to the Town Law of the State of New York, Article 16, to protect and promote public health, safety, comfort, convenience, economy, aesthetics and general welfare and for the following additional purposes:
A.
To promote and effectuate the orderly physical development of the Town of Poestenkill in accordance with the Town Comprehensive Plan.
B.
To encourage the most appropriate use of land in the community in order to conserve and enhance the value of property.
C.
To eliminate the spread of strip business developments and provide for more adequate and suitably located commercial facilities.
D.
To create a suitable system of open spaces and to protect and enhance existing wooded areas, scenic areas and waterways.
E.
To regulate building densities in order to assure access of light and circulation of air, in order to facilitate the prevention and fighting of fires, in order to prevent undue concentration of population, and in order to lessen congestion on streets and highways, and to facilitate the adequate provision of water and sewerage.
F.
To improve transportation facilities and traffic circulation and to provide adequate off-street parking and loading facilities.
G.
To realize a development plan properly designed to conserve the use of land and the cost of municipal services.
H.
To assure privacy for residences and freedom from nuisances and things harmful to the senses.
I.
To protect the community against unsightly, obtrusive and noisome land uses and operations.
J.
To enhance the aesthetic aspects throughout the entire community and maintain its present character and natural beauty.
K.
To encourage the continuation of commercial agricultural activity within the Town.
