Approved
subdivision. Any
lot in a
subdivision that received final approval of the
Planning Commission after June 1, 1965, and prior to the effective date of this Chapter
18:1 which was not recorded prior to the effective date of this Chapter
18:1 will, upon recordation of the
subdivision plat, be deemed as a
lot of record as of the date of
Planning Commission final approval and shall be processed under the terms of this Chapter
18:1 as if recorded on the date of final approval, provided that the
lots have at least 35 feet of frontage along a public or
private road. However, where the
property owner demonstrates eligibility for and participation in the MALPF program, instead of complying with the frontage requirement above, the
property owner may provide a duly recorded access
easement that runs between the
road and the newly created
lot, which is at least 35 feet in width.
