Where the owner of a lot consisting of 1 or more lots of official record in any district, at the time of the adoption of this chapter, or his or her successor in title thereto does not own sufficient contiguous land to enable him or her to conform to the minimum lot size requirements of this chapter, the lot may be used as a building site; provided, however, that the other requirements of the district are complied with or a variance is obtained from the Zoning Board of Adjustment.
The height limitations of this chapter shall not apply to church spires, belfries, cupolas, and domes not intended for human occupancy, monuments, water towers, observation towers, transmission towers, chimneys, smokestacks, conveyors, radio towers, flagpoles, television towers, masts, aerials, and similar structures.
On a corner lot in any residential district, no planting, structure, fence, wall, or obstruction to vision between 3 and 8 feet above the street level shall be placed or maintained within a triangular area branded by the street property lines of the corner lot and a line connecting the points 25 feet distant from the intersection of the property lines of the lot. Open wire fences (chain link, hog wire, lawn fence, and the like) up to 4 feet high are exempt.
Accessory buildings as herein defined may be placed according to the following standards.
(A) Accessory buildings may be built in a required rear yard; but the accessory building shall not be nearer than 10 feet to the main building, nearer than 3 feet to any side or rear lot line, or nearer than 5 feet to any alley abutting the rear of the lot.
(B) Accessory buildings, which are to be used for storage purposes only, may be erected upon a lot prior to the construction of the main buildings, but no accessory building shall be used for a dwelling purpose.
(C) Accessory buildings other than carports and garages shall be located not less than 60 feet from the front lot line. Carports and garages shall conform to principal structure front setback requirements as designated by its district classification.
Within residential zoning districts, fences and walls may be constructed not to exceed 6 feet in height. No height limitations apply to fences and walls in other district classifications.
