1159.01 - Districts and district boundaries.

(a)

Enumeration of Districts. In order to classify, regulate and restrict location of trades and industries and the locations of buildings designated for specific uses, to regulate and limit the intensity of the use of all areas and to regulate and determine the area of yards and other open spaces surrounding such buildings, the City is hereby divided into nine (9) classes of districts. The use and area regulations are uniform in each district and the districts shall be known and referred to as follows:

RE Residential Estate District

R1 One-Family Residential District

R2 One- and Two-Family Residential District

R3 Multiple Family Residential District

C1 Neighborhood Commercial District

C2 Central Business District

M1 Light Industrial District

M2 Heavy Industrial District

M3 Mixed Industrial Use.

(b)

Boundaries.

(1)

The boundaries of these districts are hereby established as shown on the Key Maps 1-A thru 1-I made a part of this Zoning Code which Map is designated as the Zoning District Map of the City. The Zoning District Map and all the notations, references and other information shown thereon are a part of this Zoning Code and shall have the same force and effect as if such Map with all the notations, references and other information shown thereon were fully set forth and described herein, which Zoning District Map is properly attested and on file with the Clerk of Council.

Where uncertainty exists with respect to the boundaries of the various districts as shown on the Map made a part of this Zoning Code, the following rules shall apply:

A.

The district boundaries are along alleys and the rear property lot lines unless otherwise shown, and where the districts designated on the Map made a part of this Zoning Code are bounded approximately by street or alley lines the street or alley lines shall be construed to be the boundary line of the district.

B.

Where the district boundaries are not otherwise indicated, and where the property has been or may hereafter be divided into blocks and lots the district boundaries shall be construed to be the rear lot lines, and where the districts designated on the Map made a part of this Zoning Code are bounded approximately by lot lines the lot lines shall be construed to be the boundary of the districts unless the boundaries are otherwise indicated on the Map.

C.

In unsubdivided property, the district boundary lines on the Map made a part of this Zoning Code shall be determined by using the scale appearing on the Map.

(c)

Annexed Territory. All territory which may hereafter be annexed to the City shall be in the RE Residential District.

(d)

Vacated Streets. Whenever any street or public way is vacated by Council, the zoning districts adjoining each side of the street or public way shall be automatically extended to the center of such vacations and all areas included in the vacation shall thereafter be subject to all regulations of the extended districts.

1159.02 - Requirements to be construed singularly.

(a)

The minimum yards, parking spaces and open spaces including lot area per family required in this Zoning Code for each and every building existing at the time of passage of this section (Ordinance 4631, passed April 24, 1967), or for any building hereafter erected or structurally altered, shall not be encroached upon or considered a part of the yard or parking space or open space required for any other building, nor shall any lot area be reduced below the requirements of this Zoning Code for the district in which such lot is located.

(b)

Every building hereinafter erected or structurally altered in R Districts shall be located on a lot as defined in this Zoning Code and in no case shall there be more than one (1) main building on any one (1) lot, except as provided in Section 1163.13(b)(7).
