ARTICLE 1311

General Provisions

1311.01 ADOPTED PURPOSE.

      (a)   BE IT FURTHER ORDAINED that in order to:
      (1)    Classify, regulate and limit the height, area, bulk, and use of buildings hereafter to be erected,
      (2)    Regulate and determine the area of front, rear and side yards, courts, and other open spaces about such buildings,
      (3)    Regulate and determine the use and intensity of use of land and lot areas,
      (4)    Classify, regulate and restrict the location of buildings designed for specified uses,
      (5)    Regulate and control, or prohibit in certain areas, junk yards, salvage yards, used parts yards, dumps or automobile or appliance graveyards, or the maintenance and operation of second hand stores or outlets in residential areas,
      (6)    Classify and designate lands among industrial, commercial, residential and other uses and purposes,
      (7)    Divide the municipality into districts of such kind, character, number, shape and areas as may be deemed necessary, and
      (8)    Adopt a Zoning Map thereof, the zoning ordinance of the City of St. Albans, Kanawha County, West Virginia presented to the City Council of St. Albans, and accepted by said Council on April 17th, 2023, a certified copy of which is presented herewith and the provisions of which are incorporated herein by reference as if set forth verbatim, be, and the same hereby is, adopted as Part 13, Chapter 3 of the Codified Ordinances of the City of St. Albans, to be known hereafter generally as the "2023 Zoning Ordinance and Zoning Map".

1311.02 CONSTITUTIONALITY AND SEVERABILITY.

      (a)    If any section, subsection, subdivision, provision, clause or phrase of this article or the application thereof to any person or circumstance is held unconstitutional of invalid, such unconstitutionality or invalidity shall not affect other sections, subsections, subdivisions, provisions, clauses or phrases or applications of the article, and to this end each and every section, subsection, subdivision, provision, clause and phrase of this article is declared to be severable. The Council hereby declared that it would have enacted the remaining sections, subsections, subdivisions, provisions, clauses and phrases of this article even if it had known that any sections, subsections, subdivisions, provisions, clauses and phrases thereof would be declared to be unconstitutional or invalid, and that it would have enacted this article even if it had known that the application thereof to any person or circumstance would be held to be unconstitutional or invalid.
      
   (b)    The provisions of subsection (a) hereof shall be fully applicable to all future amendments or additions to this article, with like effect as if the provisions of said subsection (a) hereof were set forth in extenso in every such amendment or addition and were reenacted as a part thereof.

1311.03 EFFECTIVE DATE.

    This Zoning Ordinance shall take effect and be in force from and after April 17th, 2023.

1311.04 CHAPTER 8A OF WEST VIRGINIA CODE ADOPTED.

   There is included, and incorporated, by reference, into Article 1311, of the Official Code of the City of St. Albans, West Virginia provisions of Chapter 8A of the West Virginia Code, as amended, which pertain to the subject matter of Article 1311 of the City Code.
