Site Plan Review
§ 95-55 Authority of Planning Board.
All uses so designated in the Schedule of Uses as requiring site plan approval of the Planning Board are allowed only after site plan review of the Planning Board as provided in this article. The Planning Board is hereby authorized pursuant to Town Law § 274-a to review site plans and to grant site development plan approval upon a finding that such site plan is consistent with the specific requirements and general intent of this chapter.
§ 95-56 Imposition of conditions.
In granting its approval of a site plan, the Planning Board may impose conditions to guarantee the necessary compatibility with other uses in the district and to minimize possible adverse impacts on the land and surrounding areas.
§ 95-57 Contents of application.
The owner, developer or agent thereof of lands requesting the issuance of a site plan approval shall be required to submit an application for site plan approval containing the following information:
A.
Name and address of applicant.
B.
Interest of the applicant in the proposed site plan.
C.
Location and legal description of the area.
D.
Complete engineering plans and specifications of the proposed site plan showing:
(1)
Area and dimensions of the tract of land.
(2)
Topography of the tract of land.
(3)
Proposed number, location and size of all building lots.
(4)
Location and width of roadways, walkways, parking areas, recreation areas, fencing and landscaping and any existing large trees, indicating whether said trees shall remain.
(5)
Location, dimensions, outline, area and use of any proposed buildings or structures.
(6)
Location of sewer lines, water lines, drainage areas and easements.
(7)
Plans and specifications of water supply and sewage disposal facilities and all other utilities, proposed and existing, if any.
(8)
All surrounding land use for a distance of 500 feet in all directions, including names and addresses of all adjacent landowners.
(9)
All commercial, multifamily dwelling, apartment or townhouse buildings constructed or to be constructed within the site plan area.
(10)
Existing and proposed streets providing access to the area of the site plan, showing existing and anticipated traffic patterns and loads and any required alterations to existing streets to accommodate the same. Proposed streets must contain construction specifications which comply with Town specifications for acceptance by dedication.
E.
Drafts of all covenants regarding offers of cession or dedication of areas or facilities to the Town, which shall be in a form approved by the Town Attorney.
F.
Copies of all other permits which have been obtained from those federal, New York State or other government agencies from which approval is required or the identification of all such other permits which shall be required for the construction and/or use of the site plan area.
§ 95-58 Processing of application; fee.

The application will be submitted to the Code Enforcement Officer for review to ensure that all content requirements have been complied with, after which the application will be submitted to the Planning Board. The Code Enforcement Officer shall require the submission of a filing fee to be submitted to the Town Clerk, as specified by the Town Board in a separate resolution at the time of submission.
§ 95-59 Review procedure.
A.
The Planning Board will review the application at the first regularly scheduled meeting of the Planning Board following submission of the application to the Code Enforcement Officer. The Planning Board shall consider the application at this meeting and at any other adjourned meeting deemed necessary by the Planning Board.

B.
In reviewing the site plan, the Planning Board shall take into consideration the following:
(1)
Harmonious relationship between proposed uses and existing uses, including the nature of the use of the surrounding area and the effects thereon of the proposed uses.
(2)
Adequacy and suitability of existing and proposed streets to carry anticipated traffic and ensure maximum safety within and in the vicinity of the proposed site plan.
(3)
Parking and loading facilities are sufficient to hold anticipated vehicular and pedestrian traffic.
(4)
Adequacy of interior circulation, parking and loading facilities with particular attention to vehicular and pedestrian safety.
(5)
Adequacy of landscaping and setbacks in regard to achieving maximum capability and protection to adjacent residential districts.
C.
The Planning Board may require changes or additions in relation to yards, driveways, entrances and exits landscaping and the location and heights of buildings and structures to ensure safety, to minimize traffic difficulties and to safeguard adjacent properties. Should changes or additions be required by the Planning Board, the applicant shall be required to amend his site plan accordingly.
D.
The Planning Board, upon review of the proposed site plan, may recommend such additional general or specific performance standards as are in its opinion necessary in order to secure the objectives and intents of each district.
E.
Within 45 days following receipt of the application from the Town Clerk or from receipt of any amended Site Plan amended at the request of the Planning Board, the Planning Board will either approve, approve with conditions or disapprove the site plan. The failure of the Planning Board to take any action shall be deemed a disapproval of the site plan.
F.
No building permit shall be issued under this section until such time as the Planning Board shall have been provided with copies of all other permits which have been obtained from those federal, New York State or other government agencies from which approval is required.
