Medical Marijuana

Section 400.405 Regulation Regarding Medical Marijuana Facilities.

A. 
Compliance with State Law. Uses shall remain in compliance with Section 1 of Article XVI of the Missouri Constitution.
B. 
Proximity O Facilities. Medical Marijuana facilities are prohibited within set distances listed below from any elementary or secondary school, day care, church, or other building regularly used as a place of religious worship, except when the aforementioned uses establish themselves within the prohibited distance, existing Medical Marijuana facilities may remain. The prohibited distance shall be measured in a straight line from the outer walls of the Medical Marijuana facility or the edge of the outdoor cultivation site to the outer walls of any elementary or secondary school, day care, church, or other building regularly used as a place of religious worship.
The set distances Medical Marijuana Facilities need to remain away from any elementary or secondary school, day care, church, or other building regularly used as a place of religious worship shall be as follows:
1. 
Medical Marijuana Dispensary Facility: 500 feet.
2. 
Medical Marijuana Cultivation Facility: 1,000 feet.
3. 
Medical Marijuana-Infused Products Manufacturing Facility: 1,000 feet.
4. 
Medical Marijuana Testing Facility: 1,000 feet.
5. 
Any combination of the above listed facilities: 1,000 feet.
C. 
Signage. In addition to the sign regulations located in the City of Scott City's sign code, the following shall apply to signage for Medical Marijuana facilities:
1. 
Facilities shall not use signage or advertising with the word "marijuana" or "cannabis" or any other word, phrase or symbol commonly understood to refer to marijuana unless such word, phrase or symbol is immediately preceded by the word "medical" in type and font that is at least as readily discernible as all other words, phrases or symbols.
2. 
Facilities shall not advertise in a manner that is inconsistent with the medicinal use of medical marijuana or use advertisements that promote medical marijuana for recreational or any use other than for medicinal purposes.

Section 400.410 License Application And Fee.

A. 
No person shall be permitted to engage in the business of being a medical marijuana dispensary facility, cultivation facility, marijuana-infused products manufacturing facility or testing facility without first procuring a business license from the City of Scott City, Missouri. Any person desiring to secure such a license shall make written application to the City Clerk for such license and such application shall particularly describe the premises where the applicant will conduct such business. Said person shall also provide the City Clerk with a copy of his/her State license. No license shall be granted unless such person is of good moral character, no license shall be granted to any person who previously held a license which has been revoked or who has been convicted with violations with regard to distribution, cultivation, manufacturing or testing of marijuana. All applicants requesting a license shall provide proof the applicant is the owner of the premises on which the premises will be operated or has lawful possession of the premises pursuant to a written lease with the owner.
B. 
Before any business license shall be granted, the applicant shall deliver to the City a bond in the sum of one thousand dollars ($1,000.00), with sufficient surety to be approved by the City Council, conditioned that the person obtaining such license shall not sell, give away or otherwise distribute any marijuana without a prescription or violate any other provisions of the law in Missouri regarding distribution, cultivation, manufacturing and testing of marijuana. The business license for the distribution, cultivation, manufacturing and testing of marijuana shall be subject to revocation if the applicant has violated any of the conditions set forth in his/her bond.
C. 
Fees. Medical Marijuana Dispensary Facilities shall pay the same license fee as a pharmacy. Medical marijuana cultivation facilities shall pay the same license fee as agricultural/farming and medical marijuana-infusion product manufacturing facilities and medical marijuana testing facilities shall pay the same license fee as manufacturing establishments, all as set forth in Section 600.080 of the Scott City Code.
