Public Use Districts

§ 26-64.1 Permitted Uses.

The following uses are permitted in the P-1 District and no others:
a. 
Beach stabilization structure.
b. 
Dune protection and nourishment structure.
c. 
Pedestrian pier.
d. 
Open air public facilities such as pavilions, bandstands and lifeguard stands.
e. 
Enclosed public facilities, including but not limited to restrooms, lifeguard stands and bandstands. Such facilities are limited to locations west of the promenade.
f. 
Promenade.
g. 
Licensed beach vendors.
h. 
Trash and refuse collection containers.

§ 26-64.2 Conditional Uses.

a. 
Any other suitable uses on public piers may be approved by the Governing Body after consideration of comments by the Planning Board.
b.

§ 26-64.5 Building Height.

The maximum height of a principal building or structure in the P-1 District shall be twenty-nine (29') feet measured from the height standards set forth in Chapter 14 entitled "Flood Damage Prevention."

§ 26-64.6 Lot Coverage.

The maximum permitted size of a structure located on a lot east of the Promenade shall be three hundred (300) square feet. The maximum lot coverage for an enclosed structure located on a lot west of the Promenade shall be seventy (70%) percent.

Dredge Spoil Deposit. Only in the two (2) areas which already exist, providing that the areas will not expand beyond the current limits and that the surrounding wetland areas are buffered by appropriate sediment control devices.

Nature Trail. Provided that any structure is constructed so as not to damage the wetland conditions or constitute a public hazard.
c. 
Cellular Antennas and Towers. Provided that any structure is designed to aesthetically coexist with the natural surroundings of this zone and constructed so as not to damage the wetland conditions or constitute a public hazard.

Small public miniature golf courses.

§ 26-66.2 Accessory Buildings and Uses/Conditional Uses and Structure.

§ 26-66.3 Front Yard.

Each lot shall have a minimum fifteen (15') foot setback from the front property line, except that properties fronting on the north side of John F. Kennedy Boulevard between Landis Avenue and Cini Street shall maintain a sixty (60') foot setback from the curb.

§ 26-66.4 Side Yard.

Each side yard setback shall be not less than ten (10') feet.

§ 26-66.5 Rear Yard.

A minimum twenty (20') foot setback shall be required.

§ 26-66.6 Minimum Lot Area; Dimensions.

No lot shall be less than five thousand (5,000) square feet.

No lot shall be less than fifty (50') feet wide at the street line.

The maximum height of a principal building or structure in the P-3 District shall be thirty-six (36') feet measured from the height standards set forth in the flood damage prevention ordinance in subsection 14-3.2.

The maximum lot coverage of all structures on a lot shall be sixty (60%) percent.

Off-street parking shall be required in accordance with Section 26-23. No parking shall be permitted in the required front yard setback for properties fronting on the north side of John F. Kennedy Boulevard.

§ 26-66.11 Encroachment of Side and Front Yard Setbacks.

A one (1') foot encroachment of stairs is only permitted into the side or front yard setbacks if the main entrance foyer for a unit is at or above flood elevation, providing the one (1') foot freeboard is used as the referenced level.
