Zoning Administration

1131.01 PLANNING COMMISSION TO ACT AS BOARD OF APPEALS.

   The Planning Commission for the purposes herein, shall be and is the Board of Zoning Appeals, with full power and authority to hear and determine the administration of the Zoning Ordinance and the details of the application thereof.

1131.02 POWERS; RULES AND REGULATIONS.

   (a)   The Planning Commission shall adopt from time to time such rules and regulations as it may deem necessary to carry into effect the provisions of the Zoning Ordinance and all resolutions and orders of the Commission shall be in accordance therewith.
   (b)   The Commission shall have the power to review any order or decision of the Building and Zoning Official or Manager where such order or decision is based upon the requirements of the Zoning Ordinance.

1131.03 VARIANCES.

   After the refusal of the Zoning Official to issue a Zoning permit where such refusal is for noncompliance with the provisions of the Zoning Ordinance, the Commission shall hear and determine appeals from the decision of the Zoning Official, and after public notice and hearing, may permit exceptions to and variations from the district regulations in the classes of cases or situations herein specified. 1131.04 ZONING ADMINISTRATION AND REQUESTS FOR CHANGES; FEES.

   (a)   All requests for variances and/or conditional use permits addressed to the Planning Commission (Board of Zoning Appeals) shall be accompanied by a fee in the amount of One Hundred dollars ($100.00) and no such request shall be submitted to or considered by the Planning Commission (Board of Zoning Appeals) until such fee is paid to the Finance Director. The fee shall be in the nature of a deposit to defray the costs of the Commission in reviewing the request. In the event that the applicant fails to appear at any Commission meeting at which his request is to be considered, the fee shall be retained in full by the Finance Director.
   (b)    All requests for any type of zoning change or rezoning shall be addressed to Council and shall be accompanied by a fee of two hundred fifty dollars ($250.00) to help defray the expenses of notice, hearings and publications which shall be incurred if such request is pursued; and no such request shall be submitted to or considered by Council until such fee is paid to the Finance Director.
   (c)    All moneys received as fees under subsections (a) and (b) hereof shall be deposited in the General Fund of the City. (Ord. 48-2024. Passed 10-14-24.)
