ARTICLE V

- REZONING

Sec. 80. - Definitions.

Adjacent property owner shall mean any property owner as their name appears and is shown on tax records, who is an adjoining property owner that touches.

Touches as it appears in the definition of "adjacent property owner" shall mean any property owner whose property shares a common boundary with the property proposed to be rezoned or any property that would touch and share a common boundary with the property proposed to be rezoned but for a road, street or avenue dividing the property.

Publication shall mean running a copy of the legal notice within the newspaper of general circulation in the municipality.

Sec. 81. - Notification requirements for rezoning.

(a)

A sign must be erected on the property proposed to be rezoned no less than fourteen (14) days prior to the public hearing date. The building inspector shall be responsible for making sure the sign is erected on the property proposed to be rezoned and the applicant shall be responsible for any associated expense incurred by the building inspector. The public notice sign must be placed on all street frontages for property notification to the community and adjacent land owners, and shall remain erected until the day after the meeting in which the building inspector will be responsible for removing the sign from the site. Any tabled items from the agenda until the next month will need to be changed by the building inspector to note the new date;

(b)

The applicant shall provide to [the] building inspector's office names and addresses of all adjacent land owners and the building inspector's office shall send out public hearing notices via certified mail to all adjoining property owners prior to the planning commission public hearing. Notice to adjacent land owners shall be mailed no less than ten (10) days prior to the planning commission hearing date;

(c)

The proposed rezoning ordinance notice shall be published in the newspaper for one (1) week and publication must take place at least seven (7) days prior to the planning commission public hearing of the proposed rezoning ordinance. The cost of publication, as determined by the newspaper, will be paid to the city by the applicant. The building inspector's office will not publicize the proposed rezoning ordinance until the cost of publication is paid;

(d)

Upon recommendation of rezoning to the Selma City Council by the planning commission, the proposed rezoning ordinance notice will be published in the newspaper for two (2) consecutive weeks with the last publication taking place at least fifteen (15) days prior to the Selma City Council Public Hearing of the proposed rezoning ordinance. The cost of publication, as determined by the newspaper, will be paid to the city by the applicant. The building inspector's office will not publish the proposed rezoning ordinance until the cost of publication is paid; and

(e)

Upon passage by the Selma City Council, the approved ordinance will be legally advertised in the newspaper. The city clerk will advertise said ordinance in the newspaper.

Sec. 82. - Notification requirements for a variance.

(a)

The applicant shall provide to the building inspector's office names and addresses of all adjacent land owners and the building inspector's office shall send out public hearing notices via certified mail to all adjoining property owners prior to the board of adjustments public hearing. Notice to adjacent land owners shall be mailed no less than ten (10) days prior to the board of adjustments hearing date;

(b)

The building inspector shall erect a public notice sign on the street frontage of the property at least twenty-one (21) days prior to the hearing with applicant bearing the cost. The proposed variance notice shall be published in [the] newspaper one (1) time at least fifteen (15) days prior to the board of adjustment's public hearing. Cost of publication, as determined by [the] newspaper, and the cost of the public notice sign shall be paid to the city by applicant. Notice of proposed variance shall not be published until all cost is paid in full.
