SECTION 3

6 - Floodplain Overlay District.

The Floodplain Overlay District comprises the floodplain, areas removed from the floodplain by the issuance of a FEMA Letter of Map Revision Based on Fill (LOMR-F), and the Special Flood Hazard Area. All proposed development located wholly or partially within the Floodplain Overlay District requires Special Review Use approval pursuant to Section 5.2 of these Regulations.

A.

Use Restrictions within the Floodplain Overlay District.

Encroachments. Encroachments into the floodway are prohibited, including fill, new construction, and substantial improvements unless it has been demonstrated through hydrologic and hydraulic analyses performed by a licensed Colorado Professional Engineer and in accordance with standard engineering practice that the proposed encroachment would not result in any increase in flood levels during the occurrence of the base flood discharge (No-Rise Certification).

2.

Critical Facilities. New construction of Critical Facilities in the Floodplain Overlay District is prohibited.
