General. The Board of Trustees may, from time to time, on its own motion or on petition, or on recommendation from the Planning Board, amend the regulations and districts established by this chapter, after public notice and public hearing in each case.

Petitions. All petitions for any amendment of the regulations or districts herein established shall be filed in writing with the Village Clerk/Treasurer on such form as may be required by the Board of Trustees and shall be accompanied by a certified check payable to the Clerk/Treasurer of the Village in the amount as established by the Board of Trustees, which amount is hereby determined to be the appropriate fee to indemnify the Village against the expenses of the Village in connection with such petition.

Advisory report by Planning Board. Every proposed amendment, unless initiated by the Planning Board, shall be referred by the Village Clerk/Treasurer to the Planning Board. The Planning Board shall report its recommendations thereon to the Board of Trustees, accompanied by a full statement of the reasons for such recommendations. The Board of Trustees shall not take final action upon the proposed amendment until receiving the report and recommendation of the Planning Board, except that if the Planning Board fails to report to the Board of Trustees within 30 days of such referral, the Board of Trustees may take final action without such report.

Public notice and hearing. The Board of Trustees, by resolution, shall fix the time and place for a public hearing upon the proposed amendment and cause notice to be given by publishing a notice of the proposed amendment and the time and place of the public hearing in the official newspaper of the Village not less than five days prior to the date of the public hearing and shall further comply with § 20(5) of the Municipal Home Rule Law. In addition, the Village Clerk/Treasurer shall give written notice of the public hearing and refer the proposed amendment to any required municipal, county, regional, metropolitan, state or federal agency in the manner prescribed by law and shall in addition submit written notice of any proposed amendment affecting property within 500 feet of the boundary of the Village to the Town Clerk of the Town of Skaneateles at least 10 days prior to such public hearing.

Protest by owners. If a protest against the proposed amendment is presented to the Board of Trustees, duly signed and acknowledged by the owners of 20% or more of the area of land included in such proposed amendment, or by the owners of 20% or more of the area of land immediately adjacent extending 100 feet from the boundaries of the area of land included in such proposed amendment, or by the owners of 20% or more of the area of land directly opposite therefrom extending 100 feet from the street frontage of such opposite land, such amendment shall not become effective except by the favorable vote of at least 3/4 of the members of the Board of Trustees.

Publication and posting. Every amendment to this chapter, including any map incorporated therein, adopted pursuant to the provisions of the Village Law shall be entered in the minutes of the Board of Trustees and a copy thereof, exclusive of any map incorporated therein, shall be published once in the official newspaper, and a copy of such amendment together with a summary or abstract of any map incorporated therein shall be posted conspicuously at or near the main entrance to the office of the Village Clerk/Treasurer, and affidavits of the publication and posting thereof shall be filed with the Village Clerk/Treasurer.

Effective date of amendment. Any such amendment shall take effect 10 days after such publication and posting, but such amendment shall take effect from the date of its service as against a person served personally with a copy thereof, certified by the Village Clerk/Treasurer, and showing the date of its passage and entry in the minutes.
