50 - ENFORCEMENT

The planning director and all department officials and public employees of the city vested with the duty or authority to issue permits shall do so in conformity with the provisions of this title, and any such permit, certificate, license or other entitlement issued in conflict with this title, intentionally or otherwise, is null and void. It shall be the duty of the planning director and the building official to enforce the provisions of this title pertaining to the erection, construction, reconstruction, moving, conversion, alteration or addition to any building or structure, and to the use of any land, building or premises.

Any building or structure set up, erected, constructed, altered, enlarged, converted, moved or maintained contrary to the provisions of this title, and any use of land, building or premises established, conducted, operated or maintained contrary to this title is unlawful and a public nuisance. The city attorney, upon the written request of the planning director or upon direction from the city council, is authorized and directed to commence legal action or proceedings for the abatement, removal and enjoinment thereof.

Any person, whether as principal, agent, employee or otherwise, violating or causing the violation of any provisions of this title, is guilty of an infraction. The fine for the first conviction shall be a minimum of one hundred dollars. The fine for a second conviction of the same municipal code section within one year shall be a minimum of two hundred dollars. For each additional conviction of the same municipal code section within one year, the minimum fine shall be three hundred dollars.
