Commercial Highway District: CH

§ 27-1301 Purpose.

The Commercial Highway District is designed to accommodate the needs of transient highway travelers as well as to serve as retail marketing centers for the entire Township. This district is intended for a wide range of shopping and service functions which can provide adequate comparison shopping activities.

§ 27-1302 Permitted uses.

1. 
In the Commercial Highway District no building or land shall be used and no building shall be erected which is arranged, intended or designed to be used for other than the following uses. No processing or storage activity shall be permitted outside of a building unless such activity is effectively screened by a wall, partition or suitable landscaping. Such uses, operations or products shall not be objectionable due to odor, dust, smoke, noise, vibration or similar causes.

Accessory uses customarily incident to permitted uses.

Half-way house/after care facility.

Academic clinical research centers, medical marijuana grower/processors, medical marijuana transport vehicle offices, and medical marijuana dispensaries, with consideration for the applicable performance standards found in § 27-14A04.

§ 27-1303 Conditional uses.

Billboards as defined herein, subject to the requirements of § 27-1707 of this article.

§ 27-1304 Yard requirements.

Each lot shall have front, side and rear yards of not less than the depth or width indicated below:
A. 
Front yard depth, 60 feet from the street right-of-way.
B. 
Side yards, two; width 10 feet each side of a principal building; provided, that when a written agreement is provided by adjoining property owners no side yard shall be required where two or more commercial uses abut side to side; however, in no case shall common walls be permitted between properties of separate ownership. In the case of a series of abutting structures adjacent to and paralleling a public right-of-way and open and unobstructed passage for vehicles and pedestrians of at least 20 feet in width shall be provided at grade level at intervals of not more than 400 feet.
C. 
Rear yard depth, 30 feet.

§ 27-1305 Buffer yard requirements.

Where required, buffer yards shall be provided in compliance with the standards set forth in § 27-1508, Subsection 1F, of this chapter.

§ 27-1306 Building height.

The height of a building shall not exceed 35 feet.

§ 27-1307 Off-street parking.

Parking shall be provided for in accordance with Article XVIII of this chapter.

§ 27-1308 Signs.

Signs shall be in accordance with Article XVII of this chapter.

§ 27-1309 Lot coverage requirements.

Total coverage shall not exceed 40% of the lot area.

§ 27-1310 Motor vehicle access.

Motor vehicle access shall be provided in accordance with Article XIX of this chapter.
