REGULATIONS FOR

SPECIFIC DISTRICTS

§ 155.045 "C" CONSERVATION DISTRICT.

   (A)   The "C" Conservation District encompasses areas that are presently undeveloped or sparsely developed and that, for various reasons, should remain so for the foreseeable future.
   (B)   Some tracts of land in this district are fertile and relatively level, and best suited for agricultural pursuits.
   (C)   Other tracts in this district have the poor soils, steep slopes, inadequate natural drainage and/or other problems, or are simply so distant from existing developed areas that the provision and maintenance of roads, utilities and storm water drainage systems would be impractical or burdensomely expensive to the tax-paying public.
      (1)   One dwelling on one lot. In the "C" District, only one dwelling shall be situated on any lot.
      (2)   Lot and building requirements. Every principal building erected in the "C" District shall conform to the following requirements:

      (3)   Permitted uses. Agriculture, including all uses commonly classified as such, provided the requirements of § 155.121 are met.
         (a)   Cemeteries;
         (b)   Government uses of the village;
         (c)   Nurseries, greenhouses, temporary produce stands;
         (d)   Single-family dwellings; and
         (e)   Accessory uses in accordance with § 155.031.
      (4)   Special uses.
         (a)   Agricultural implement sales;
         (b)   Amusement facilities, such as go-cart tracks, miniature golf courses and the like;
         (c)   Animal hospitals;
         (d)   Churches and other places of formal worship;
         (e)   Clubs or lodges, private; but not those which have as their chief activity a service customarily carried on as a business;
         (f)   Golf courses, regulation size;
         (g)   Government uses other than those of the village;
         (h)   Home occupations;
         (i)   Institutions such as convents, retreat houses, seminaries and the like;
         (j)   Kennels, commercial;
         (k)   Nursing homes, sanitariums; and
         (l)   Utility substations.

§ 155.046 "R-1" SINGLE-FAMILY RESIDENCE DISTRICT.

   (A)   In the "R-1" Single-Family Residence District, land is principally used for, or is best suited for, detached single-family dwellings and related educational, religious and recreational facilities.
   (B)   The regulations for this district are intended to stabilize and preserve sound existing single-family neighborhoods, and to promote the development of subdivisions offering a range of new conventionally-constructed single-family housing.
   (C)   Other types of residences: mobile homes, duplexes, apartments and the like, are strictly prohibited in this district.
      (1)   Special restrictions.
         (a)   One principal building per lot: In the "R-1" District, only one principal building shall be situated on any lot.
         (b)   No mobile homes.
            1.   No mobile home shall be brought into or placed anywhere in the "R-1" District.
            2.   No existing mobile home in the "R-1" District shall be immobilized, unless a special-use permit is granted.
            3.   It shall be unlawful to replace any existing mobile home located in the "R-1" District, without a special-use permit from the Zoning Board of Appeals. (See Chapter 153 also.)
      (2)   Lot and building requirements. Every principal building erected in the "R-1" District shall conform to the following requirements:

      (3)   Permitted uses. Agriculture, including all uses commonly classified as such, provided the requirements of § 155.121 are met:
         (a)   Government uses of the village;
         (b)   Single-family dwellings, conventionally-constructed; and
         (c)   Accessory uses in accordance with § 155.031.
      (4)   Special uses.
         (a)   Churches and related religious facilities;
         (b)   Government uses other than those of the village;
         (c)   Home occupations, but only in conformity with the requirements of § 155.123;
         (d)   Schools; and
         (e)   Utility substations

§ 155.047 "R-2" ONE-FAMILY RESIDENCE DISTRICT.

   The "R-2" One-Family Residence District encompasses areas suitable for both conventionally-constructed single-family dwellings and duplexes as well as related educational, religious and recreational facilities.
   (A)   One single or two-family dwelling. In the "R-2" District, only one single-family dwelling may be situated on any lot.
   (B)   Lot and building requirements. Every principal building erected in the "R-2" District shall conform to the following requirements:

   (D)   Special uses. Any use allowed by special use permit in the "R-1" District. Nursing homes.

§ 155.048 "R-3" MULTIPLE-FAMILY RESIDENCE DISTRICT.

   The "R-3" Multiple-Family Residence District is established to stabilize and conserve existing neighborhoods that predominantly consist of multiple-family dwellings and to promote the development of comparable new areas in order to accommodate all persons desiring this type of residential environment.
   (A)   Lot and building requirements. Note: Detached single-family and two-family dwellings erected in the "R-3" District shall comply with all applicable regulations of the "R-2" District. Every principal building in the "R-3" District shall conform to the requirements indicated below:

   (C)   Special uses. Any use that may be allowed by special use permit in the "R-2" District. Convenience shops (e.g., small drugstore, food store, laundromat).

§ 155.050 "B-1" COMMUNITY BUSINESS.

   The "B-1" Community Business District primarily encompasses the long-established commercial areas of the village where a wide range of goods and services is offered to the general public at retail or wholesale.
   (A)   Lot and building requirements. See also § 155.027.

Generally, none required, except as necessary to comply with applicable off-street parking and loading requirements. However, any lot that abuts any residential district shall meet the front setback and side setback (on the side abutting the residential use) requirements of the residential district.

   (B)   Permitted uses.
      (1)   Churches and related facilities;
      (2)   Clubs and lodges;
      (3)   Commercial establishments, wholesale and retail;
      (4)   Government uses of the village;
      (5)   Medical/dental clinics;
      (6)   Offices;
      (7)   Service establishments;
      (8)   Accessory uses in accordance with § 155.031; and
      (9)   Any use permitted in the "R-3" District. See § 155.046.
   (C)   Special uses.
      (1)   Government uses other than those of the village; and
      (2)   Utility substations.

§ 155.051 "B-2" HIGHWAY BUSINESS DISTRICT.

   The "B-2" Highway Business District is intended to accommodate and regulate strip commercial developments and compatible uses. Since the businesses, both retail and wholesale, draw their patrons primarily from the motoring public, they typically require direct access to major streets and large lots for off-street parking and loading.
   (A)   Use restrictions.
      (1)   Repairs indoors. All repair and maintenance services shall be conducted within completely enclosed structures. Storage areas may be open to the sky, but shall be enclosed by walls or solid fences at least eight feet high.
      (2)   Refuse containers. All refuse generated by facilities located within this district shall be stored in tightly-covered containers placed in visually-screened areas.
      (3)   Screening. Along the side and rear lot lines of any lot abutting any residential district, screening (a wall, solid fence, or closely-planted shrubbery) at least six feet high which completely blocks the view from the adjacent residential property shall be installed.
      (4)   Parking. See § 155.065 through 155.071.
      (5)   Signs. See § 155.085 through 155.109.
   (B)   Lot and building requirements. Every principal building erected in the "B-2" Highway Business District shall conform to the requirements indicated below:

   (C)   Permitted uses.
      (1)   Provided all the use restrictions of this district are observed, the following uses are permitted:
         (a)   Any use permitted in the "B-1" District;
         (b)   Churches and related facilities;
         (c)   Clubs and lodges; and
         (d)   Commercial establishments, any type including drive-in facilities.
      (2)   The uses as the following are especially appropriate in this district:
         (a)   Bowling alleys;
         (b)   Furniture and appliance sales;
         (c)   Greenhouses;
         (d)   Lumber and building supplies sales;
         (e)   Mobile home and recreational vehicles sales;
         (f)   Motor vehicles sales;
         (g)   Government uses;
         (h)   Offices; and
         (i)   Service establishments, any type, including drive-in facilities.
      (3)   Such uses as the following are especially appropriate in this district:
         (a)   Animal hospitals;
         (b)   Banks and other financial institutions;
         (c)   Motels;
         (d)   Motor vehicles services;
         (e)   Restaurants;
         (f)   Service stations; and
         (g)   Accessory uses in accordance with § 155.031.
   (D)   Special uses. Provided all the use restrictions of this district are observed, the following uses may be allowed by special use permit (see § 155.051):
      (1)   Drive-in theaters;
      (2)   Bus terminals, and bus transportation facilities;
      (3)   Research and development facilities not involving explosives, flammable gases or liquids, or live animals;
      (4)   Utility substations; and
      (5)   Warehousing and wholesaling of any goods except explosives, flammable gases or liquids, or live animals.

§ 155.052 "I" INDUSTRIAL DISTRICT.

   The "I" Industrial District is intended to provide for areas where light industry, research facilities, warehouses and wholesale businesses may locate without detriment to the remainder of the community. In these areas, a satisfactory correlation of factors required by the uses exists or can be readily achieved.
   (A)   Use restriction.
      (1)   No nuisances. No production, processing, cleaning, servicing, testing, repair, sale or storage of goods, materials or equipment shall unreasonably interfere with the use, occupancy or enjoyment of neighboring properties or the community as a whole. Unreasonable interferences include, but are not limited to, excessive traffic congestion, loud or shrill noises, excessive emission of smoke, emission of toxic gases, excessive glare and noxious odors.
      (2)   Activities enclosed. All production, processing, cleaning, servicing, testing or repair activities shall be conducted within completely enclosed buildings. Storage areas may be open to the sky, but shall be enclosed by walls or fences (whether solid or chain-link), including gates, at least eight feet high.
      (3)   Buffer strips. Wherever any industrial use located in this district abuts any residential district, a 20-foot wide view and noise control buffer strip shall be installed. The buffer strip shall consist of densely planted shrubbery that is at least five feet high when planted and that can be expected to reach a height of ten feet when full grown.
   (B)   Lot and structure requirements.

   (C)   Permitted uses. Provided all the use restrictions of this district are observed, the following uses are permitted: See division (A) above.
      (1)   Adult uses as defined and regulated by the Adult Licensing and Regulation Ordinance of the village;
      (2)   Assembly, manufacturing or processing of any commodity from semifinished materials provided explosives, flammable gases or liquids, or live animals are not involved;
      (3)   Freight and bus terminals and related mass transportation facilities;
      (4)   Any use permitted in the "B-1" or "B-2" Districts except single and/or multi-family dwellings;
      (5)   Research and development facilities not involving explosives, or flammable gases or liquids;
      (6)   Service stations;
      (7)   Warehousing or wholesaling of goods except explosives, flammable gases or liquids, or live animals;
      (8)   Utility substations or government uses; and
      (9)   Accessory uses in accordance with § 155.031.
   (D)   Special uses. All uses permitted in the "R-3" District ( i.e. dwellings).

§ 155.053 "O-FP" FLOOD PLAIN OVERLAY DISTRICT.

   (A)   The "O-FP" Flood Plain Overlay District delineates areas that, in the absence of flood protection measures, are subject to periodic flooding which may result in injury to or loss of life and property, disruption of private and governmental services, impairment of the village tax base, and the need for extraordinary relief measures.
   (B)   The regulations of this section are intended to restrict permitted development in flood plains to:
      (1)   Uses which inherently have low flood damage potential and to:
      (2)   Other uses allowed in the primary zoning districts provided appropriate protective measures have been taken. See Chapter 152 of this Code of Ordinances.
   (C)   This overlay district has no effect on the classification, whether permitted, special or prohibited, of uses in the primary zoning districts. Rather, this overlay district imposes additional restrictions on both permitted and special uses. The regulations and requirements of Chapter 13 Article I of the "Revised Code of Ordinances" shall be the controlling law for flood plain uses.
