ESTABLISHMENT OF

ZONING DISTRICTS

§ 155.040 GENERALLY.

   The following districts are hereby established.

§ 155.041 R-20 RESIDENTIAL DISTRICT.

   The R-20 Residential District is established as a district in which the principal use of land is for residential purposes. This district is primarily for areas that do not have water or wastewater services, and the parcels have to be larger for wells and/or septic systems. Other rural uses may also be permitted.

§ 155.042 R-10 RESIDENTIAL DISTRICT.

   The R-10 Residential District is established as a district in which the principal use of land is for single-family residential purposes only. This district is established for lower density purposes.

§ 155.043 R-6 RESIDENTIAL DISTRICT.

   The R-6 Residential District is established as a district in which the principal use of land is residential, and also encourages higher density development.

§ 155.044 NB NEIGHBORHOOD BUSINESS DISTRICT.

   The NB Neighborhood Business District is hereby established as a transitional, mixed-use district to provide for the orderly expansion of selected businesses which serve a limited area or segment of the community while maintaining to the highest degree possible the quality of the existing neighborhood.

§ 155.045 CC CENTRAL COMMERCIAL DISTRICT.

   The CC Central Commercial District is hereby established with the intent to protect and improve the downtown shopping area of the town and to discourage uses which do not require a central location and which are not compatible with the downtown shopping and office area.

§ 155.046 GC GENERAL COMMERCIAL DISTRICT.

   The GC General Commercial District is hereby established as a district in which the principal use of land is for retail sales and services to the motoring public and other uses not requiring a centralized location, but which do require thoroughfare frontage, larger lots, outdoor sales or open storage areas.

§ 155.047 HC-I HEAVY COMMERCIAL/INDUSTRIAL DISTRICT.

   The HC-I Heavy Commercial/Industrial District is hereby established as a district in which the principal use of land is for warehousing, wholesaling, industrial and commercial uses requiring large areas, and generating high volumes of traffic. It is the intention of this district to discourage uses which would encroach upon the commercial and industrial nature of this district but would also establish safeguards to the public interest.

§ 155.060 PURPOSE AND INTENT.

   (A)   It is recognized that certain types of general use zoning districts would be inappropriate at certain locations in the absence of special conditions.
   (B)   Where the applicant for rezoning desires property to be rezoned to such a district in such situations, the conditional zoning district is a means by which these types of special conditions can be imposed in furtherance of the purposes of this chapter.
   (C)   The conditional zoning district classification will be considered for rezoning only upon request of a property owner or authorized agent.

§ 155.061 DISTRICTS ESTABLISHED.

   (A)   The following conditional zoning districts (bearing the designation “CD”) are hereby established to correspond with each of the general use districts described in §§ 155.040 through 155.047 of this chapter.
   (B)   The conditional districts are therefore as follows: R-20-CD; R-10-CD; R-6-CD; NB-CD; CC-CD; GC-CD; and HCI-CD.

§ 155.062 USES PERMITTED.

   (A)   The uses permitted in a conditional district are identical to those permitted in its corresponding general use district, as well as any additional requirements stated in the conditions unless specifically prohibited in the conditions.
   (B)   The uses permitted in a conditional district are also subject to all other requirements of that district.

§ 155.063 TYPES OF CONDITIONS PERMITTED.

   Conditions imposed upon a conditional district must be mutually agreed-upon by the applicant and Board of Commissioners and are limited to those that:
   (A)   Address the conformance of the development and use of the site to town ordinances and officially adopted plans; and
   (B)   Address impacts reasonably expected to be generated from the development or use of the site.
