ARTICLE I

Title, Authority and Purpose

§ 500-1 Short title.

This chapter shall be known and may be cited as "This chapter of 1996."

§ 500-2 Authority.

A. 
Township Authority. Section 601 of the Pennsylvania Municipalities Planning Code (Act 247, as reenacted and amended)[1] provides that the Springfield Township Board of Supervisors may implement a comprehensive plan or accomplish any of the purposes of Act 247 by enacting a zoning ordinance.

B. 
Applicability. This chapter requires that, within Springfield Township, in the County of York and the Commonwealth of Pennsylvania, no land, body of water, or structure shall hereafter be used or occupied and no structure or part thereof shall hereafter be erected, constructed, reconstructed, moved or structurally altered unless in conformity with all the regulations and procedures herein specified for the district in which such land, body of water, or structure is located.

§ 500-3 Purposes.

A. 
General purposes. The zoning regulations and districts herein set forth have been made in accordance with the Springfield Township Comprehensive Plan Update and are designed:
(1) 
To promote, protect, and facilitate the public health, safety, morals, and the general welfare; the coordinated and practical development of the community and the proper density of population; emergency management preparedness and operations; airports and national defense facilities; the provisions of adequate light and air, access to incident solar energy, police protection, vehicle parking and loading space, transportation, water, sewer systems, schools, recreational facilities, and public grounds; the provision of a safe, reliable, and adequate water supply for domestic, commercial, agricultural, or industrial use; and other public requirements; as well as the preservation of natural, scenic and historically valuable features, whether man-made or in the environment, and the preservation of forest, wetlands, aquifers, floodplains and other natural resources.
(2) 
To prevent overcrowding of land, blight, danger and congestion in travel and transportation, loss of health, life, or property from fire, flood, panic, or other dangers.
(3) 
To preserve prime agricultural land and farmland, considering topography, soil type, soil classification, and present use.
(4) 
To provide for the use of land within the Township for residential housing of various dwelling types encompassing all basic forms of housing, including single-family dwellings, two-family dwellings, a reasonable range of multifamily dwellings in various arrangements, mobile homes, and mobile home parks.
(5) 
To accommodate reasonable overall community growth, including population and employment growth, and opportunities for development of a variety of residential dwelling types and nonresidential uses.
B. 
Community development objectives. This chapter provides a legal basis and framework for future Township development and redevelopment. Its provisions are guided by the policies and proposals contained within the Springfield Township Comprehensive Plan Update.

§ 500-4 Interpretation.

A. 
Conflict with other laws. The provisions of this chapter shall be held to be minimum requirements to meet the purposes stated herein. Where the provisions of this chapter impose greater restrictions than those of any statute, other ordinance, or regulation, the provisions of this chapter shall prevail. Where the provisions of any statute, other ordinance or regulation impose greater restrictions than those of this chapter, the provisions of such statute, ordinance, or regulation shall prevail.
B. 
Validity. Should any section, subsection, or provision of this chapter be declared by a court of competent jurisdiction to be invalid, such decision shall not affect the validity of this chapter as a whole or any other part thereof. Likewise, if a court of competent jurisdiction finds the application of any provision or provisions of this chapter to any lot, building, or other structure or tract of land to be invalid or ineffective in whole or in part, the effect of such decision shall be limited to the person, property, or situation immediately involved and shall not affect any other persons, property, or situations.
C. 
Interpretation of ordinance provisions. In interpreting the language of this chapter to determine the extent of the restriction upon the use of property, the language shall be interpreted, where doubt exists as to the intended meaning of the language written and enacted by the Board of Supervisors, in favor of the property owner and against any implied extension of the restriction.

§ 500-5 Repealer.

A. 
Ordinance No. 1990-4, passed December 15, 1990, and entitled "This chapter of 1990," and all amendments thereto, are hereby repealed; provided, however, if this chapter is held to be ineffective or invalid by reason of any irregularity in or impediment to its passage, this repealer shall also be ineffective as aforesaid; then and in that event, this chapter of 1990, as amended, shall remain in full force and effect.
B. 
All other Township ordinances or parts of ordinances are hereby repealed insofar as they are inconsistent with the provisions of this chapter.
