Site Plans
§ 215-47 Legislative intent.
The purpose of these requirements is to promote the orderly development of land and structures within the Town and to ensure that such activities are developed in a manner harmonious with surrounding properties and in the interest of the private and public welfare. More specifically, the site plan shall be used to review the project's compatibility with the environment, to review the capability of the project's traffic circulation system to provide for the convenient and safe internal and external movement of vehicles and pedestrians, to review the quality, quantity and types of needed community facilities and to review the location and adequacy of the project's provisions for drainage and utilities.
§ 215-48 Applicability.
A.
The provisions of this article shall apply to all buildings, structures or uses except single- and two-family detached dwellings.
B.
Where a change of use of an existing structure requires additional parking or other requirements applicable to a new use or will result in a substantial increase in traffic, a site plan shall be submitted for review to ensure the change of use can be accomplished within the purpose and intent of this chapter, except for those that may be waived pursuant to this article.
§ 215-49 Waiver of requirements.
Any requirements of this article may be waived by the Planning Commission when the waiver is not adverse to the purpose of this article and the applicant establishes that in his particular case an undue hardship would result from a strict enforcement of this article or that the requirement is unreasonable.
§ 215-50 Specifications.
§ 215-51 Information requirements.
The site plan shall clearly show the conditions on and adjacent to the site at the time of application, the features of the site which are being incorporated into the proposed use or building and the appearance and function of the proposed use or building. The site plan shall show the following information unless waived by the Planning Commission:
A.
The proposed title of the project and the name of the engineer, architect, surveyor, planner and/or developer and a rectangular signature block for the Planning Commission Chairman.
B.
The North point, scale and a key map at a scale of not less than one inch equals 2,000 feet showing the location of the site and its relationship to surrounding areas and to existing street locations and rights-of-way.
C.
Existing zoning and zoning district boundaries of the property in question and on surrounding immediate properties.
D.
The present use of all adjacent properties.
E.
The location, design and dimensions of each new and existing use and buildings.
F.
The location, dimensions and character of construction of proposed streets, alleys, driveways and the location, type and size of ingress and egress to the site.
G.
When proposed streets intersect with or adjoin existing streets, both the rights-of-way and the extent of the paved surface, including curbs, of the existing street must be indicated for a minimum of 50 feet.
H.
The location, size and direction of flow of all streams, brooks, ditches, lakes and ponds. The boundaries of the one-hundred-year floodplain and the floodways of all watercourses shall also be submitted and shown on the plat.
I.
The building or use setback distances from all property lines; plans and design data for storm drainage facilities; contours of the project area at four-foot intervals for slopes averaging 8% or greater and at two-foot intervals for slopes of less than 8%.
J.
Grading plan showing existing and proposed spot elevations based upon a benchmark listed on the plan at center lines of abutting roads.
K.
The size, type and location of all proposed signs; the location and design of proposed lighting for buildings and signs.
L.
Traffic flows, if required by the Planning Commission; estimates of the total number of trips generated by the proposed development, and a comparison of the trips with the actual and designed capacity of the road.
§ 215-52 Amendments.
If it becomes necessary for an approved site plan to be changed, the Administrator shall, at the applicant's request, notify the Planning Commission and request approval for a minor change. If the change is major, the Planning Commission may require that a new site plan be drawn and submitted for review and action in accordance with this article.
§ 215-53 Plan required prior to issuance of certain permits.
No zoning or building permits shall be issued to construct, erect or alter any building or structure, nor any permit or authorization granted to improve or develop land subject to the provisions of this article, unless a site development plan has been submitted and approved.
