Soil Erosion and Sedimentation Control
§ 315-102 Statement of purpose.
It is the purpose of this regulation to carry out the mandate of the Connecticut Legislature in Public Act 83-388 codified in §§ 22a-325 through 22a-329 of the General Statutes to provide for proper regulations concerning soil erosion and sediment control during development. These regulations are meant to provide minimum requirements by inclusion or reference for soil erosion and sediment control plans:
A.
To prevent costly repairs to gullies, washed out fills, roads and embankments;
B.
To prevent sediment from polluting water bodies and wetlands;
C.
To prevent degrading of aesthetic, recreational, fish and wildlife values;
D.
To prevent clogging of storm sewers and road ditches that reduce capacities and cause flooding and damage to adjoining properties; and
E.
To prevent erosion that destroys the soils' capabilities to support vegetation.
§ 315-103 Definitions.
As used in this article, the following terms shall have the meanings indicated:
A signed written approval by the Commission (or its designated agent) that a soil erosion and sediment control plan complies with the applicable requirements of these regulations.
The North Central Conservation District, Inc., which was formed by combining the Hartford County and Tolland County districts, established under Subsection (a) of CGS § 22a-315.

Any construction or grading activities to improved or unimproved real estate.
An area where the ground cover is destroyed or removed leaving the land subject to accelerated erosion.
The detachment and movement of soil or rock fragments by water, wind, ice or gravity.
Any excavating, grubbing, filling (including hydraulic fill) or stockpiling of earth materials or any combination thereof, including the land in its excavated or filled condition.
The periodic review of sediment and erosion control measures shown on the certified plan.
Solid material, either mineral or organic, that is in suspension, is transported, or has been moved from its site of origin by erosion.
Any unconsolidated mineral or organic material of any origin.
A scheme that minimizes soil erosion and sedimentation resulting from development and includes, but is not limited to, a map and narrative.
§ 315-104 Activities requiring certified erosion and sediment control plan.
A soil erosion and sediment control plan shall be submitted as part of any application for development when the disturbed area of such development is cumulatively more than 1/2 acre.
§ 315-105 Erosion and sediment control plan.
A.
To be eligible for certification, a soil erosion and sediment control plan shall contain proper provisions to adequately control accelerated erosion and sedimentation and reduce the danger from stormwater runoff on the proposed site based on the best available technology. Such principles, methods and practices necessary for certification are found in the 2002 Connecticut Guidelines for Soil Erosion and Sediment Control.
B.
Said plan shall contain, but not be limited to:
(1)
A narrative describing:
(a)
The development.
(c)
The design criteria for proposed soil erosion and sediment control measures and stormwater management facilities.
(d)
The construction details for proposed soil erosion and sediment control measures and stormwater management facilities.
(e)
The installation and/or application procedures for proposed soil erosion and sediment control measures and stormwater management facilities.
(f)
The operations and maintenance program for proposed soil erosion and sediment control measures and stormwater management facilities.
(2)
A site plan map at a sufficient scale to show:
(a)
The location of the proposed development and adjacent properties;
(b)
The existing and proposed topography, including soil types, wetlands, watercourses and water bodies;
(c)
The existing structures on the project site, if any;
(d)
The proposed area alterations, including cleared, excavated, filled or graded areas and proposed structures, utilities, roads and, if applicable, new property lines;
(e)
The location of and design details for all proposed soil erosion and sedimentation control measures and stormwater management facilities identified by standard symbols and nomenclature shown in the 2002 guidelines;
(f)
The sequence of grading and construction activities;
(g)
The sequence for installation and/or application of soil erosion and sediment control measures;
(h)
The sequence for final stabilization of the development site.
(3)
Any other information deemed necessary and appropriate by the applicant or requested by the Commission or its designated agent.
§ 315-106 Minimum acceptable standards.
A.
Plans for soil erosion and sediment control shall be developed in accordance with these regulations using the principles as outlined in the 2002 Connecticut Guidelines for Soil Erosion and Sediment Control. Soil erosion and sediment control plans shall result in a development that minimizes erosion and sedimentation during construction, is stabilized and protected from erosion when completed, and does not cause significant off-site erosion and/or sedimentation.
B.
The minimum standards for individual measures are those in the 2002 Connecticut Guidelines for Soil Erosion and Sediment Control, as amended. The Commission (or its designated agent) may grant exceptions when requested by the applicant if technically sound reasons are presented.
C.
For soil erosion and sediment control measures requiring engineered measures per the 2002 Connecticut Guidelines for Soil Erosion and Sediment Control as amended, calculations by a Connecticut professional engineer shall be used in determining peak flow rates and volumes of runoff.
§ 315-107 Issuance of certification.
A.
The Suffield Zoning and Planning Commission or its agent shall by its approval certify that the soil erosion and sediment control plan complies with the requirements and objectives of this regulation.
B.
Nothing in these regulations shall be construed as extending the time limits for the approval of any application under Chapter 124 or 126 of the General Statutes.

C.
Prior to approval, any plan submitted to the Town may be reviewed by the North Central Conservation District which may make recommendations concerning such plan, provided such review shall be completed within 30 days of receipt of such plan.
§ 315-108 Conditions relating to soil erosion and sediment control.
A.
The estimated costs of measures required to control soil erosion and sedimentation, as specified in the certified plan, that are a condition of certification of any modified site plan may be required to be covered in a performance bond or other assurance acceptable to the Commission in accordance with the provisions specified under § 315-118 of the regulations.
B.
Site development shall not begin unless the soil erosion and sediment control plan is approved and those control measures and facilities in the plan scheduled for installation prior to site development are installed and functional.
C.
Planned soil erosion and sediment control measures and facilities shall be installed as scheduled according to the approved plan.
D.
All control measures and facilities shall be maintained in effective condition to ensure compliance with the approved plan.
§ 315-109 Inspection and other requirements.
A.
Inspection shall be made by the Commission or its designated agent during development to ensure compliance with the approved plan and that control measures and facilities are properly performed or installed and maintained. The Commission or its designated agent may require the permittee to verify through progress reports that soil erosion and sediment control measures and facilities have been performed or installed according to the approved plan and are being operated and maintained.
B.
Modifications to plans may be necessary and field changes may be required in the event that upon inspection it is found that the intent of the regulations is not being met.
