Words and terms in this article shall have the meanings given in this article. Unless expressly stated otherwise, any pertinent word or term not part of this listing but vital to the interpretation of this article shall be construed to have its legal definition or, in absence of a legal definition, its meaning as commonly accepted by practitioners, including civil engineers, surveyors, architects, landscape architects, and planners.
ABANDONED SIGNA sign, including both on-premises signs and off-premises signs, which has not identified or advertised a current business, service, owner, product, or activity for a period of at least 180 days.
ADDRESS SIGNA sign that designates the street number and/or street name for identification purposes, as designated by the United States Postal Service.
ANIMATED SIGNA sign that uses action, motion, flashing, or color changes and requiring either electrical energy or an electronic manufactured source of supply. This does not include wind-actuated elements such as flags or banners.
AWNINGA cloth, plastic, or other nonstructural covering which projects from a wall for the purpose of shielding a doorway or window and is either permanently attached to a building or can be raised or retracted to a position against the building.
AWNING SIGNA sign that is mounted or painted on, or attached to, an awning, as defined herein.
BALLOON SIGNA lighter-than-air, gas-filled balloon, tethered to a fixed location, which contains an advertisement message either on its surface or attached to the balloon in any other manner.
BANNER SIGNAny temporary sign intended to be hung either with or without frames and possessing characters, letters, illustration, or ornamentations applied to fabric or similar material and attached to a pole or building. National, state, or municipal flags, or flags containing only decorative illustrations, shall not be considered a banner sign for the purposes of this article unless its use or purpose is that of advertising the location of a business at which it is flown.
BEACON LIGHTA signaling or guiding device, such as a lighthouse, spotlight, or other light, used to attract attention to a specific business, property, or any location.
BENCH SIGNA sign located on any part of the surface of a bench or seat placed on or adjacent to a public right-of-way.
BUILDING FRONTAGEThe maximum linear width of a building measured in a single straight line parallel with the abutting public street or parking lot.
BUSINESS SIGNAn on-premises sign which advertises or otherwise directs attention to a business, commodity, service, industry, or other activity which is sold, offered, or conducted, other than incidentally, on the premises upon which the sign is located or to which it is affixed.
CANOPYA structure other than an awning made of fabric, metal, or other material that is supported by columns or posts affixed to the ground and may also be connected to a building.
CANOPY SIGNAny sign that is part of or attached to a canopy.
CHANGEABLE COPY SIGNA sign that is designed so that characters, letters, panels, or illustrations can be manually changed or rearranged without altering the face or the surface of the sign. This shall also include the changing of a copy on a billboard.
CHANNEL LETTER SIGNAny sign consisting of fabricated or formed three-dimensional letters, illuminated or nonilluminated, individually applied to a wall.
CLEARANCEEither the vertical distance above a walkway (or other surface if specified) to the bottom edge of a sign or the horizontal distance between two objects.
CONSTRUCTION SIGNAny temporary sign displaying the names of principal contractors, architects, or lending institutions responsible for construction on the site where the sign is placed. Where permitted, construction signs shall be limited to the duration of construction.
DIGITAL DISPLAYAny portion of a sign consisting of internally illuminated components capable of changing the message or image automatically or by remote control, including but not limited to LCD, LED, or plasma screen.
DIRECTIONAL SIGNAn on-premises or off-premises incidental sign designed to guide or direct pedestrians or vehicular traffic. Where permitted, such signs shall not include logos, insignia, or any other commercial symbols.
DIRECTORY SIGNA sign on which the names and locations of occupants or the use of a building is given, including, but not limited to, office buildings and church directories.
FLAG SIGNAny sign printed or painted on cloth, plastic, canvas, or other like material with distinctive colors, patterns, or symbols attached to a pole or staff and anchored along only one edge or supported or anchored at only two corners. Flag signs include flags printed with logos or text for a commercial purpose, not including local, state, or national flags.
FLASHING SIGNA sign whose artificial illumination is not kept constant in intensity when in use and which exhibits changes in light, color, direction, or animation. This definition does not include signs meeting the definition of "message center signs" or "digital displays."
FOOTCANDLEA unit of incident light (on a surface) stated in lumens per square foot and measureable with an illuminance meter. One footcandle is equal to one lumen per square foot.
FOOTLAMBERTA unit of emitted light (from a surface) stated in lumens per square foot and measurable with an illuminance meter. One footlambert is equal to one lumen per square foot.
FREESTANDING SIGNA self-supporting sign resting on or supported by means of poles, standards, or masonry structure on the ground independent from any building or other structure. The following are subtypes of freestanding signs:
A. GROUND SIGNA freestanding sign permanently affixed to the ground at its base, supported entirely by a base structure, and not mounted on a pole or attached to any part of a building (also referred to as "monument sign").
B. POLE SIGNA freestanding sign that is permanently supported in a fixed location by a structure of one or more poles, posts, uprights, or braces from the ground and not supported by a building or base structure.
GAS STATION CANOPYA freestanding, open-air structure constructed for the purposes of shielding service station islands from the elements.
GAS STATION CANOPY SIGNAny sign that is part of, or attached to, the vertical sides of the gas station canopy roof structure. For the purposes of this article, gas station canopy signs shall be considered wall signs.
GOVERNMENTAL REGULATORY SIGNAny sign for the control of traffic or for identification purposes which is erected by or at the order of a public officer, employee or agent thereof, in the discharge of official duties, including, but not limited to, street signs, warning signs, railroad signs, and signs of public service companies indicating danger or construction.
HOLIDAY DECORATIONSSigns or displays including lighting which are a nonpermanent installation celebrating national, state, and local holidays, religious or cultural holidays, or other holiday seasons (also known as "seasonal decorations").
ILLUMINATED SIGNA sign in which a source of light is used in order to make the message readable. This shall include signs with both external illumination and internal illumination.
ILLUMINATIONA source of any artificial or reflected light, either directly from a source of light incorporated in or indirectly from an artificial source (also "illuminated").
A. EXTERNAL ILLUMINATIONArtificial light, located away from the sign, which lights the sign, the source of which may or may not be visible to persons viewing the sign from any street, sidewalk, or adjacent property.
B. FESTOON LIGHTINGA directly illuminated sign, as defined herein, comprised of either:
(1) A group of incandescent light bulbs hung or strung overhead or on a building or structures.
(2) Light bulbs not shaded or hooded or otherwise screened to prevent direct rays of light from shining on adjacent properties or right-of-way.
C. INTERNAL ILLUMINATIONA light source that is concealed or contained with the sign and becomes visible in darkness through a translucent surface. Message center signs, digital displays, and signs incorporating neon lighting shall not be considered internal illumination for the purposes of this article.
D. HALO ILLUMINATIONA sign using a three-dimensional message, logo, etc., which is lit in such a way as to produce a halo effect (also known as "back-lit illumination").
INCIDENTAL SIGNA sign that displays general site information, instructions, directives, or restrictions that are primarily oriented to pedestrians and motor vehicle operators who have entered a property from a public street. These signs shall not contain any commercial advertising.
INCIDENTAL WINDOW SIGNSigns displayed in a window displaying information such as the business hours of operation, credit institutions accepted, commercial and civic affiliations, and similar information. These signs shall be informational only and shall not contain a commercial message.
INFLATABLE SIGNA sign that is an air-inflated object, which may be of various shapes, made of flexible fabric, resting on the ground or structure and equipped with a portable blower motor that provides a constant flow of air into the device.
INTERACTIVE SIGNAn electronic or animated sign that reacts to the behavior or electronic signals of motor vehicle drivers.
LEGIBILITYThe physical attributes of a sign that allow for an observer's differentiation of its letters, words, numbers, or graphics.
LIGHT TRESPASSLight emitted by a lighting installation which extends beyond the boundaries of the property on which the installation is sited.
LUMINANCEAn objective measurement of the brightness of illumination, including illumination emitted by an electronic sign, measured in candela per square foot (cd/ft2).
MARQUEEA permanent structure, other than a roof or canopy, attached to, supported by, and projecting from a building and providing protection from the elements.
MARQUEE SIGNAny sign attached to a marquee for the purposes of identifying a use or product. If attached to a theater, performing arts center, cinema, or other similar use, it may also advertise films or productions.
MECHANICAL MOVEMENT SIGNA sign having parts that physically move rather than merely appear to move as might be found in a digital display. The physical movement may be activated electronically or by another means but shall not include wind-activated movement such as used for banners or flags. Mechanical movement signs do not include digital displays.
MEMORIAL SIGNA memorial plaque or tablet, including grave markers or other remembrances of persons or events, which is not used for a commercial message.
MENU SIGNA permanent sign for displaying the bill of fare available at a restaurant or other use serving food or beverages.
MESSAGE CENTER SIGNA type of illuminated changeable copy sign that consists only of electronically changing alphanumeric text, including, but not limited to, gas price display signs and athletic scoreboards.
MULTITENANT SIGNA freestanding sign used to advertise businesses that occupy a shopping center or complex with multiple tenants.
MURALA large picture/image (including but not limited to painted art) which is painted, constructed, or affixed directly onto a vertical building wall, which may or may not contain text, logos, and/or symbols (also known as "mural sign").
NAMEPLATE SIGNA nonbusiness sign which announces only the name and/or address of the occupants of a residence.
NITThe unit measurement for luminance equal to one candela per square meter.
NONCONFORMING SIGNA sign that was legally erected and maintained at the effective date of this article, or amendment thereto, that does not currently comply with sign regulations of the district in which it is located.
OFF-PREMISES SIGNAn outdoor sign whose message directs attention to a specific business, product, service, event, or activity, or other commercial or noncommercial activity or contains a noncommercial message about something that is not sold, produced, manufactured, furnished, or conducted on the premises upon which the sign is located. See §
153-502C(21) for additional requirements (also known as a "third-party sign," "billboard," or "outdoor advertising").
OFFICIAL TRAFFIC SIGNOfficial highway route number signs, street name signs, directional signs and other traffic signs erected and maintained on public highways and roads in the interest of public safety or for the regulation of traffic.
ON-PREMISES SIGNAn outdoor sign whose message and design relate to an individual business, profession, product, service, event, point of view, or other commercial or noncommercial activity sold, offered or conducted on the same property where the sign is located.
PENNANTA triangular or irregular piece of fabric or other material, commonly attached in strings or strands or supported on small poles intended to flap in the wind.
PERMANENT SIGNA sign attached to or affixed to a building, window, or structure or to the ground in a manner than enables the sign to resist environmental loads, such as wind, and that precludes ready removal or movement of the sign and whose intended use appears to be indefinite.
POLE BANNER SIGNA sign possessing characters, letters, illustration, or ornamentations applied to fabric or similar material and attached to a single pole at the top and bottom.
PORTABLE SIGNA sign designed to be transported or moved and not permanently attached to the ground or other structure. The following are subtypes of portable signs:
A. SANDWICH BOARD SIGNA type of freestanding, portable, temporary sign consisting of two faces connected and hinged at the top and whose message is targeted to pedestrians (also known as an "A-Frame Sign").
B. VEHICULAR SIGNAny vehicle to which a sign is affixed in such a manner that the carrying of such sign, or signs, no longer is incidental to the vehicle's primary purpose, but becomes a primary purpose in itself, shall be considered a freestanding sign and, as such, shall be subject to the provisions regarding freestanding signs in the district in which the vehicle is located.
PRIVATE DRIVEWAY SIGNA sign indicating a street or drive which is not publicly owned and maintained and used for access by the occupants of the development and their guests.
PROJECTING SIGNA building-mounted, double-sided sign with the two faces generally perpendicular to the building wall, otherwise known as a "blade sign."
PUBLIC SIGNA sign erected or required by governmental agencies or utilities, including traffic, utility, safety, railroad crossing, and identification signs, for public access.
REAL ESTATE SIGNAny sign which is used to offer for sale, lease, or rent the property upon which the sign is placed.
REFLECTIVE SIGNA sign containing any material or device which has the effect of intensifying reflective light.
REVOLVING SIGNA sign which revolves in a circular motion, rather than remaining stationary on it supporting structure.
ROOF SIGNA sign erected upon, against, or over the roof of a building which is wholly or partly supported by said building.
SAFETY SIGNA sign that provides information or warning regarding potential hazards, proper use or materials.
SCOREBOARDA sign contained within an athletic venue and intended solely to provide information to the attendees of an athletic event.
SECURITY SIGNAn on-premises sign regulating the use of the premises, such as "No Trespassing," "No Hunting," or "No Soliciting" (also known as "warning sign").
SHIELDEDThe description of a luminaire from which no direct glare is visible at normal viewing angles, by virtue of its being properly aimed, oriented, and located and properly fitted with such devices as shields, barn doors, baffles, louvers, skirts, or visors.
SIGNAny device, structure, fixture, painting, emblem, or visual that uses words, graphics, colors, illumination, symbols, numbers, or letters for the purpose of communicating a message. A sign includes the sign faces as well as any sign supporting structure.
SIGN AREAThe dimensions of a sign surface used to display information, messages, advertising, logos, or symbols. See §
153-805C of this Code for standards for measuring sign area.
SIGN FACEThe part of the sign that is or can be used for the sign area. The sign area could be smaller than the sign face.
SIGN GROUPA group of two or more similar signs placed on the same property. All sign groups, except for those containing only signs exempt from a permit by §
153-804, require a permit.
SIGN HEIGHTThe distance from the highest portion of the sign to the mean grade at the base of the sign.
SIGN LIGHTERA directed and controlled light specifically intended to illuminate a sign.
SNIPE SIGNSign of any material whatsoever that is attached in any way to a utility pole, official traffic sign, traffic signal pole, tree, stake, fences, public benches, streetlights, or any similar object located or situated on public or private property without permission of the property owner (also known as a "bandit sign").
STOREFRONTThe exterior facade of a building housing a commercial use visible from a street, sidewalk, or other pedestrianway accessible to the public and containing the primary entrance to the commercial establishment.
STREAMERSA display made of lightweight, flexible materials, consisting of long, narrow, wavy strips hung individually or in a series, with or without a logo or advertising message printed or painted on them and typically designed to move in the wind.
STREET BANNER SIGNAny off-premises temporary banner sign which is stretched across and hung over a public right-of-way.
STREET FRONTAGEThe side or sides of a lot abutting a public street or right-of-way.
STREET POLE BANNERA banner sign suspended above a public sidewalk and attached to a single street pole. These signs shall not contain any commercial advertising.
TEMPORARY SIGNA type of nonpermanent sign that is located on private property that can be displayed for no more than 120 days and is not intended to be permanent and which is intended to advertise, without limitation, special events, sales, general elections, community or civic projects, construction projects and real estate for sale or lease on a temporary basis.
TRAILER SIGNAny sign which is erected upon a structure having wheels, rollers, or similar devices facilitating movement and is capable of being moved from one location to another.
TRI-VISION SIGNAn outdoor unit with a slatted face that allows three different copy messages to revolve at intermittent intervals.
UNDER-MARQUEE SIGNA display, whether illuminated or nonilluminated, attached to the underside of a marquee protruding over a public or private sidewalk or right-of-way.
VENDING MACHINE SIGNA sign displayed on a vending machine indicating the name of the product being sold and/or the price.
WALL SIGNA building-mounted sign which is either attached to, displayed on, or painted on an exterior wall in a manner parallel with the wall surface. A sign installed on a false or mansard roof is also considered a wall sign (also known as "fascia sign," "parallel wall sign" or "band sign").
WINDOW SIGN or DOOR SIGNA sign which is applied, painted or affixed to a window, or placed inside a window or glass door, within three feet of the glass, facing the outside of the building, and easily seen from the outside, which advertises or otherwise directs attention to an activity conducted on the same lot or premises. Customary displays of merchandise or objects and material without lettering behind a store window are not considered window or door signs.
