ZONING BOARD OF ADJUSTMENT
(a) | that special conditions and circumstances exist which are peculiar to the land, structure or building involved and which are not applicable to other lands, structures, or buildings in the same district; |
(b) | that literal interpretation of the provisions of this ordinance would deprive the applicant of rights commonly enjoyed by other properties in the same district under the terms of this ordinance; |
(c) | that the special conditions and circumstances do not result from the actions of the applicant; |
(d) | that granting the variance requested will not confer on the applicant any special privilege that is denied by this ordinance to other lands, structures or buildings in the same district; and |
(e) | The cost of compliance with the Zoning Ordinance is greater than fifty percent (50%) of the appraised value of the structure as shown on the most recent certified appraisal role. |
(f) | Compliance would result in a loss to the lot on which the structure is located of at least twenty-five percent (25%) of the area on which development may physically occur. |
(g) | Compliance would result in the structure not to be in compliance with a requirement of another City ordinance, building code or other requirement. |
(h) | Compliance would result in the unreasonable encroachment on the adjacent property or easement. |
(i) | The City considers the structure to be a nonconforming structure. |
