TRAFFIC

§ 9.04.010 Definitions.

   As used in this title, the following words and terms shall have the meanings herein ascribed to them unless the context makes the meanings repugnant thereto.
   ANIMAL. Any horse, pony, donkey, mule, burro or other animals which may be ridden or driven.
   CURB. The lateral boundaries of the road-bed of a street.
   DRIVE. To ride, to drive, propel or operate.
   DRIVER. Any person, as herein defined, who drives, operates or propels a vehicle, as herein defined.
   PARK or PARKING. The standing of a vehicle, whether occupied or not, otherwise than temporarily for the purpose of and while actually engaged in loading or unloading passengers or merchandise.
   RIDER. The rider, driver or person in charge of any vehicle or animal.
   STREET. Every street, avenue, boulevard, highway, roadway, lane, alley, strip, path, square or place laid out for the use of vehicles.
   VEHICLE. Any device in, upon or by which any person or property may be transported upon a street or highway, except those operated upon rails or tracks.
   VEHICLE CODE DEFINITIONS. The definition of any term not otherwise herein defined shall be the same as such term is defined and described in the Vehicle Code of the state and amendments thereto.

§ 9.08.010 Obedience to police.

   It shall be unlawful for any person to wilfully fail or refuse to comply with any lawful order, signal or direction of any officer of the Police Department when on duty and directing traffic.

§ 9.08.020 Obedience to signs.

   No person shall fail, neglect or refuse to comply with any instruction or direction displayed upon any past standard, sign or device for the regulation of traffic in public streets.

§ 9.08.030 Injury to signs.

   No person shall wilfully deface, injure, move or interfere with any sign, standard, post, rope or other device installed or placed for the purpose of directing or regulating traffic.

§ 9.08.040 Authority to prohibit U-turns.

   The Chief of Police, subject to the approval of the Manager, is hereby authorized and directed to indicate intersections at which operators of motor vehicle shall not, at any time of day or night, turn the vehicles in a complete circle, or so as to proceed in the opposite direction.

§ 9.12.010 Prima facie speed limits.

   The prima facie speed limit hereinafter set forth as to the streets hereinafter designated are as follows and shall be applicable when signs have been erected giving notice thereof.

§ 9.16.010 Traffic signals.

   The City Engineer is authorized to install, and Public Works Director authorized to maintain, official traffic signals at those intersections and at other places where conditions are such as to require that the flow of traffic be alternatively interrupted and released in order to prevent or relieve traffic congestion, or to protect life or property from exceptional hazard in accordance with engineering studies.

§ 9.20.010 Jaywalking downtown.

   When within a business district, no pedestrian shall cross a roadway other than by crosswalk.

§ 9.20.020 Residence district - Right-of-way.

   Outside of the business district, no pedestrian shall cross a roadway other than by a route at right angles to the curb.

§ 9.20.030 Standing, walking in street.

   No pedestrian shall stand or walk in any roadway other than within a safety zone or crosswalk. This provision shall not be construed to prevent the necessary use of a roadway by a pedestrian.

§ 9.20.040 Crosswalks at other than intersections.

   Pedestrians’ crosswalks, other than at intersections, are hereby established and the same shall be painted and identified, in the hereinafter designated, streets and locations:
   (A)   From the easterly line of K Street to the westerly line of K Street at the intersection of K and Elm Street;
   (B)   From the easterly line of K Street to the westerly line of K Street, midway between the intersection of Elm and K Streets, and the intersection of Alpine and K Streets;
   (C)   From the easterly line of K Street to the westerly line of K Street, midway between the intersection of K and Inyo Streets, and the intersection of K and Kern Streets;
   (D)   From the easterly line of K Street to the westerly line of K Street, midway between the intersection of Kern and K Streets and Tulare and K Streets;
   (E)   From the easterly line of K Street to the westerly line of K Street, midway between the intersection of K and Tulare Streets, and the intersection of K and King Streets;
   (F)   From the easterly line of L Street to the westerly line of L Street, midway between the intersection of Tulare and L Streets and the intersection of King and L Streets;
   (G)   From the northerly line of Kern Street to the southerly line of Kern Street adjacent to and westerly of the alley between J and K Streets; and
   (H)   From the northerly line of Kern Street to the southerly line of Kern Street, adjacent to and westerly of the alley between K and L Streets.

§ 9.24.010 City Council to designate one-way streets and alleys.

   The City Council may by resolution describe and designate streets, alleys, or portions thereof as one-way streets or alleys whenever it determines that the restriction of the movement of traffic to a single direction at all times, or at certain times only, would reduce congestion, control hazards, or improve the movement of traffic.

§ 9.24.020 Public Works Director to post one-way streets and alleys.

   The Public Works Director shall place or cause to be placed in a conspicuous location on such one-way streets and alleys at the intersection of each street or highway intersecting such one-way street or alley, adequate signage designating the direction of lawful traffic movement and prohibition of access as applicable.

§ 9.24.030 Violation of one-way street and alley designations.

   It shall be unlawful for the operator of any vehicle traversing any portion of any one-way street or alley as designated or established by resolution of the City Council, to operate such vehicle thereon in violation of the one-way street signs placed by the Public Works Director pursuant to this chapter.

§ 9.28.010 Through streets designated.

   M Street, from the north line of Tulare Street to the north city limits, is hereby declared to constitute a through highway as the same is defined in the Vehicle Code of the State of California.

§ 9.28.020 Designation of streets by Police Chief.

   The Chief of Police, subject to the approval of the Manager, is hereby authorized and directed to designate streets as arterial highways or boulevards, in addition to those in this chapter enumerated, whenever the public safety may require.

§ 9.28.030 Erection of signs.

   The intersection of every arterial highway or boulevard, established pursuant to this chapter with every other street, shall be plainly marked with a sign visible to persons traveling along the intersecting streets upon which sign there shall be printed in legible characters the word “stop.”

§ 9.28.040 Stop intersections.

   At points of intersection of two boulevards or arterial highways, as herein described, the Chief of Police shall have power to determine that stops may be required on only one thereof; and, in that event, it shall be the duty of the Chief of Police to determine and indicate, by appropriate signs, upon which thereof the stops shall be required.

§ 9.28.050 Boulevard stops enumerated.

   For the purpose of this chapter, the following described streets or portions thereof are boulevard or arterial highways:
   (A)   Alpine Street: at east line of K Street;
   (B)   Blackstone Avenue: at north line of Tulare Street;
   (C)   Cherry Avenue: at north line of Tulare Street;
   (D)   Cross Avenue: east and west line at J Street;
   (E)   East Avenue: at south line of Tulare Street;
   (F)   Hospital Road: at east line of K Street;
   (G)   Inyo Street:
      (1)   South line of A Street;
      (2)   North and south line of B Street;
      (3)   North and south line of C Street;
      (4)   South line of California Street;
      (5)   North and south line of D Street;
      (6)   North and south line of E Street;
      (7)   North and south line of F Street;
      (8)   North and south line of G Street;
      (9)   North and south line of H Street;

§ 9.28.060 Yield right-of-way - Designation.

   The Chief of Police, subject to the approval of the Manager, is hereby authorized and directed to designate intersections of streets and highways at which a yield right-of-way sign will be erected in accordance with the provisions of Cal. Vehicle Code § 471.1.

§ 9.32.010 Truck routes designated.

   The following designated streets are declared to constitute truck routes within the City of Tulare.
   (A)   Avenue 200 (Rankin Avenue), the entire length within the city limits;
   (B)   Bardsley Avenue, the entire length within the city limits;
   (C)   Blackstone Drive, the entire length within the city limits;
   (D)   Blackstone Street, the entire length within the city limits;
   (E)    Cartmill Avenue, the entire length within the city limits;
   (F)   Cross Avenue, from the intersection of J Street to the intersection of M Street;
   (G)   H Street, from the intersection of Bardsley Avenue to the intersection of Cedar Avenue;
   (H)   Hillman Street, the entire length within the city limits;
   (I)   I Street, from the intersection of Inyo Avenue to the intersection of Alpine Avenue;
   (J)   I Street, from the intersection of Bardsley Avenue to the south city limits;
   (K)   J Street, from the intersection of K Street to the north city limits;
   (L)    K Street, from the intersection of Tulare Avenue to the intersection of Cross Avenue;
   (M)   Laspina Street, from the intersection of Paige Avenue to the south city limits;
   (N)   Martin Luther King, Jr. Avenue, from the intersection of K Street to State Route 99;
   (O)   M Street, from the intersection of Tulare Avenue to the intersection of Cross Avenue;

   (W)   Tulare Drive, the entire length within the city limits;
   (X)   Turner Drive, the entire length within the city limits; and
   (Y)   West Street, the entire length within the city limits.

§ 9.32.020 Authority to establish truck routes.

   The City Council, by ordinance, shall establish appropriate streets to be designated as a truck route, to be consistent with the circulation element of the General Plan. The Police Chief and the City Engineer shall identify, by signs, through traffic routes for the movement of vehicles of two or more tons capacity involved in the carrying of merchandise, freight or materials.

§ 9.32.030 Use of established routes.

   When any such through traffic routes are established and designated by appropriate signs, it shall be unlawful for any operator of any vehicle mentioned in § 9.32.020 to drive on any other route in the city except when it is impractical to do otherwise, or except when it is necessary for such vehicles to traverse another street to a destination for the purpose of loading or unloading, but in such case only by such deviation from the nearest truck route as is reasonably necessary.

§ 9.36.010 Injuring pavement.

   No person shall drive or permit to be driven along or upon any paved street any vehicle or traction engine any tire of which is worn or is not smooth or that has a sharp or uneven surface, or any vehicle or traction engine to any tire or wheel of which is attached cleats or spikes or uneven surfaces or any device that will cause drainage to the pavement in the street. Nothing contained in this section shall be deemed to prohibit the use of anti-skid chains, or pneumatic tires attached to the wheels of motor vehicles.

§ 9.36.020 Heavy traffic prohibited.

   No person shall drive or operate a heavy-laden vehicle or any vehicle employed in carrying heavy freight, natural oil, crude petroleum, gasoline or regularly employed in carrying goods or merchandise on any street or parts of streets as follows:
   (A)   K Street from the north line of Inyo Street to the south line of King Street;
   (B)   Tulare Street from the east line of J Street to the west line of L Street;
   (C)   Kern Street from the east line of J Street to the west line of L Street; and
   (D)   Deliveries; trailers: Nothing herein contained shall be deemed to prohibit trucks making deliveries within the described boundaries; but no truck making any such delivery shall have a trailer attached.

§ 9.36.030 Authority to designate streets.

   The Chief of Police, subject to the approval of the Manager, is hereby authorized and directed to designate streets in addition to those herein enumerated whenever the public safety may require.

§ 9.40.010 Daytime speed limit.

   Between the hours of 5:00 a.m. and 11:00 p.m., the speed of freight and passenger trains operating through the city limits shall not be greater than 35 mph.

§ 9.40.020 Nighttime speed limit.

   Between the hours of 11:00 p.m. and 5:00 a.m., the speed of any trail shall not be greater than 60 mph) while operating through the city limits.

§ 9.40.030 Duty to maintain crossing lights.

   All persons owning, operating or controlling any steam railway, engines or cars propelled by steam and whose tracks cross Tulare, Kern, K and L Streets in the city are hereby required to maintain each of the crossings of Tulare, Kern, K and L Streets, at least a six ampere incandescent arc light.

§ 9.40.040 Location of lights.

   The required lights shall be suspended directly above each of the crossings.

§ 9.44.010 Riding or driving on sidewalks.

   No person shall ride or drive any vehicle, bicycle or motorcycle along or upon the sidewalks in the city. The word VEHICLE, as used in this section, shall not be construed to include invalids’ chairs, baby carriages or small vehicles commonly used for small children; provided, that coasters are hereby declared to be street vehicles and are hereby excluded from sidewalks within the Fire District as established by this code.

§ 9.44.020 Funeral processions.

   No person shall obstruct the free and uninterrupted passage in, upon, along or through any public street of any funeral cortege or procession, or obstruct, impede or prevent the passage of any person attending the conveyance of the body of any deceased person to place for holding services thereover, or to a place of interment or cremation. All corteges or processions as herein described shall be properly equipped with small stickers designating the same as a funeral cortege or procession.

§ 9.44.030 Clinging to vehicles.

   No person riding upon any coaster, bicycle, motorcycle or similar vehicle, or while wearing roller skates shall take hold of or attach himself or herself to any vehicle, or anything attached to the vehicle when the vehicle is in motion; provided, that this section shall not be construed to prohibit the towing of disabled vehicles.

§ 9.44.040 Impounding of vehicle.

   In addition to, or in lieu of any fine and imprisonment, the vehicle used in the violation of § 9.44.030 may be impounded by the Police Department for a period of not more than 50 days.

§ 9.44.050 Emerging from alley or driveway.

   The operator of any vehicle emerging from an alley, driveway or garage within the fire limits of this city shall stop the vehicle immediately prior to driving onto a sidewalk.

§ 9.48.010 Parking behind parked cars.

   It shall be unlawful to park or permit to stand, parallel with the curb line and behind parked cars, any vehicle on:
   (A)   K Street, from the north line of Inyo Street to the south line of King Street;
   (B)   J Street, from the north line of Inyo Street to the south line of King Street;
   (C)   Tulare Street, from the east line of J Street to the west line of M Street;
   (D)   Kern Street, from the east line of J Street to the west line of M Street;
   (E)   Inyo Street, from the west line of J Street to the west line of M Street; and
   (F)   Such other streets as the Chief of Police, with the approval of the Manager may, from time to time, designate.

§ 9.48.020 Trailers in business district.

   No person shall park any vehicle with trailer attached within the congested business district in the city.

§ 9.48.030 Parking vehicles for sale.

   No person shall park any vehicle for displaying it for sale on any street inside the fire limits of the city, as described by this code.

§ 9.48.040 Repairing car on street.

   No person shall repair or perform mechanical work upon any vehicle on any street within the city.

§ 9.48.060 Exceptions - Emergency vehicles.

   This chapter shall not apply to any vehicle of the Tulare Police or Fire Department, large commercial vehicles under contract with the Tulare Police Department's Tow Service Agreement or Tow Service Agreement with any other public agency, or to vehicles of any regularly licensed physician when actually engaged in making professional calls. Large commercial vehicles under contract with the Tulare Police Department's Tow Service or Tow Service Agreement with any other agency shall be allowed to park in residential areas from 6:00 p.m. to 6:00 a.m. only and shall be parked in a matter so to not impede traffic line of sight or parked so as to not create a traffic hazard as determined by the Chief of Police or their designee in consultation with the City Engineer.

§ 9.48.070 Congested district defined.

   The “congested district” is hereby described as follows:
   (A)   North-south streets. The east and west sides of J, K, and L Streets from the north line of Inyo Street to the south line of King Street; and
   (B)   East-west streets. The north and south sides of Tulare, Kern and Inyo Streets from the east line of J Street to the west line of L Street.

§ 9.48.080 Twenty-minute parking.

   (A)   Green curb marking shall mean no standing or parking for a period of time longer than 20 minutes at any time between 8:00 a.m. and 5:00 p.m. on any day except Sunday and legal holidays.
   (B)   When authorized signs or curb markings have been determined by the Chief of Police to be necessary and are in place giving notice thereof, no operator of vehicle shall stop, stand or park said vehicle adjacent to any such legible curb marking or sign in violation thereof.

§ 9.48.090 Parking near post office.

   It shall be unlawful to park, stand or leave any vehicle for any period of time whatever in excess of ten minutes upon the north side of Tulare Street in front of the United States Post Office, located on the street.

§ 9.48.100 Moving of vehicles.

   (A)   At the end of the periods of time allowed in this chapter for parking, the vehicles shall be moved; and, for the period of one hour after the moving, it shall be unlawful for the person in charge of the vehicle to allow the same to stand within 20 feet of the position occupied by the vehicle immediately prior to the moving.
   (B)   The prohibitions of §§ 9.48.070 through 9.48.090 shall not apply to any licensed physician, Fire Department vehicle or police vehicle in active use.

§ 9.48.110 Parking lots - Early morning parking restricted.

   It shall be unlawful for the owner or driver of any vehicle to allow a vehicle to remain standing longer than 30 minutes between the hours of 2:00 a.m. and 6:00 a.m. upon any public parking lot owned or operated by the city.

§ 9.48.120 Commercial vehicle parking restrictions.

   (A)   Definitions.
      (1)   This section shall apply to commercial vehicles of more than two-ton capacity commonly described as a truck, truck trailer, trailer, semi or tractor.
      (2)   For purposes of this section, a RESIDENTIAL DISTRICT shall be any such district as established and identified pursuant to Tulare City zoning, set forth in Title 10 of this city code.
   (B)   Parking requirements in general.
      (1)   No commercial vehicle shall be left to idle for longer than five minutes, nor blow air horns.
      (2)   No commercial vehicle shall have cargo transferred from such commercial vehicle to another within a residential district or on any public street, highway, alley or other public right-of-way.
      (3)   No refrigeration unit shall be operated on any commercial vehicle parked or left standing within 300 feet of any residence.
      (4)   Commercial vehicles used for the transportation of hazardous waste, materials, or garbage, or which harbor vermin or pestilence, or which emit noxious or noisome odors, shall not be parked or stored within 300 feet of a residential district.
   (C)   Street parking.
      (1)   (a)   It shall be unlawful for any person to leave, park or allow to be parked any commercial vehicle, whether attended or unattended, within any residential district. This prohibition shall apply regardless of whether the commercial vehicle is located on the public street, highway or alley, or on private property within the residential district.
         (b)   Exceptions.
            1.   During the first 24 hours during which the vehicle is mechanically disabled;
            2.   While a commercial vehicle is making a pick-up or delivery of materials or goods to or from any building or site.
      (2)   No commercial vehicle shall be parked or left standing on any public street or right-of-way unless it is a minimum of 12 feet from the centerline of the street, or such that a minimum of 12 feet is provided per lane if more than one lane, and under no circumstances shall be parked in any travel lanes.
      (3)   No commercial vehicle shall be parked or left standing on any street or right-of-way in such a manner that obstructs a designated bike lane or pedestrian path of travel.
      (4)   No commercial vehicle shall be parked or left standing within 100 feet of any street intersection, or in a manner that obstructs the visibility of an official traffic control device to such a degree that the Police Chief or his or her designee determines that it constitutes a traffic safety hazard.

§ 9.48.130 Stopping in alleys.

   No person shall park or stop any vehicle for any purpose other than the loading or unloading of passengers or materials in any alley. No stop for the loading of passengers shall be for more than three minutes, nor for the loading or unloading of materials for more than 30 minutes in any alley. All vehicles so parked or stopped in any alley shall be parked or stopped facing in the proper direction for legal traffic in any such alley, and on the right side thereof. No vehicle shall be parked or stopped in such a manner as to obstruct the passage of any vehicle.

§ 9.48.140 One-hour, two-hour, three-hour and four-hour parking.

   (A)   When authorized signs have been determined by the Chief of Police to be necessary and are in place giving notice thereof, no operator of any vehicle shall stop, stand or park said vehicle between the hours of 8:00 a.m. and 5:00 p.m. of any day except Sundays and legal holidays for a period of time longer than one hour.
   (B)   When authorized signs have been determined by the Chief of Police to be necessary and are in place giving notice thereof, no operator of any vehicle shall stop, stand or park said vehicle between the hours of 8:00 a.m. and 5:00 p.m. of any day except Saturday(s), Sunday(s), and legal holidays for a period of time longer than two hours.
   (C)   When authorized signs have been determined by the Chief of Police to be necessary and are in place giving notice thereof, no operator of any vehicle shall stop, stand or park said vehicle between the hours of 8:00 a.m. and 5:00 p.m. of any day except Saturday(s), Sunday(s), and legal holidays for a period of time longer than three hours.
   (D)   When authorized signs have been determined by the Chief of Police to be necessary and are in place giving notice thereof, no operator of any vehicle shall stop, stand or park said vehicle between the hours of 8:00 a.m. and 5:00 p.m. of any day except Saturday(s), Sunday(s), and legal holidays for a period of time longer than four hours.

§ 9.48.150 Parking restrictions on state highways.

   All restricted parking adopted under the provisions of this chapter, or designated by the Chief of Police, with the approval of the Manager, insofar as the same are intended to be effective on streets within the city which are also highways within the state and subject to the jurisdiction of the Division of the Highways of the state, shall become effective only after the approval of the Department of Public Works of the state. All of the restrictions shall cease to be effective six months after the approval though once given has been withdrawn and notice of the withdrawal has been given to the Manager.

§ 9.48.160 Removal of parked vehicles.

   Any regularly employed and salaried officer of the Police Department may remove or cause to be removed:
   (A)   Any vehicle that has been parked or left standing upon a street or highway for 72 or more consecutive hours; and
   (B)   Any vehicle which is parked or left standing upon a street or highway where the use of the street or highway or a portion thereof is necessary for the cleaning, repairing or construction of the street or highway or for the installation of underground utilities or where the use of the street or highway or any portion thereof is authorized for a purpose other than the normal flow of traffic or where the use of the street or highway or any portion thereof is necessary for the movement of equipment, articles or structures of unusual size, and the parking of the vehicle would prohibit or interfere with the use or movement; provided that signs giving notice that the vehicle may be removed are erected or placed at least 24 hours prior to the removal.

§ 9.48.170 Authority to establish zones.

   In exercise of his or her power to regulate and control traffic upon, and the movement and standing of vehicles upon the streets of the city, the Chief of Police, following consultation with the City Engineer and subject to the approval of the City Manager, is hereby authorized to establish and enforce the following parking zones and spaces, and to designate the zones and spaces by proper markings:
   (A)   Red Zone: no parking.
   (B)   Green Zone: parking restricted to a specified length of time.
   (C)   Yellow Zone: parking restricted to the loading and unloading of passengers or freight.
   (D)   White Zone: parking restricted to loading and unloading of passengers.
   (E)   Blue Zone: parking limited to the use of handicapped drivers and/or passengers.
   (F)   Restricted Time Zone: prohibition of parking during a specified time period.
   (G)   Restricted Use Zone: prohibition of the parking of designated types of vehicles.
   (H)   Temporary Restriction Zone: prohibition or limitation of parking during emergencies, special events or unusual circumstances.

§ 9.48.180 Parking position.

   It shall be unlawful to park any vehicle across any line or marking, placed upon the curb or street adjacent to the curb designating a parking space, or to park a vehicle in such position that the same shall not be entirely within the space designated by the lines or markings.

§ 9.48.190 School zones - Preferential resident parking.

   (A)   No parking in school zones. It shall be unlawful and constitute an infraction to park any vehicle upon any street, avenue or lane, from 8:00 a.m. to 2:30 p.m., Monday through Friday, on days when school is in session, within any area in the city that has been designated a school zone parking area and has been posted with a sign with the words “NO PARKING WHILE SCHOOL IN SESSION” pursuant to a resolution of the City Council.
   (B)   Permit parking exemption. A motor vehicle on which is displayed a valid parking permit as provided for in this section, shall be permitted to stand or be parked in the school zone parking area for which the permit has been issued. The motor vehicle shall not be exempt from parking restrictions or prohibitions established pursuant to authority other than this section. All other motor vehicles parked within a school zone parking area shall be subject to the no parking restriction set forth in this section. A parking permit shall not guarantee or reserve to the holder thereof an on-street parking space within the designated school zone parking area.
   (C)   Parking permits.
      (1)   Parking permits shall be issued by the Finance Director/City Clerk. Each such permit shall state the address and license number of the motor vehicle for which it is issued. No more than one parking permit shall be issued for each motor vehicle for which application is made. Parking permits shall be valid for the duration of the residency of the permittee and while the permittee retains ownership of the vehicle for which the parking permit was issued. The City Manager is authorized to issue such rules and regulations, not inconsistent with this section, governing the manner in which persons shall qualify for parking permits.
      (2)   Parking permits may be issued for motor vehicles only upon application of the following persons:
         (a)   A resident of a school zone parking area who has a motor vehicle registered in his or her name, or who has a motor vehicle for his or her exclusive use and under his or her control;
         (b)   A person who owns or leases commercial property and actively engages in business activity within a school zone parking area. However, no more than one parking permit may be issued for each business establishment for a motor vehicle registered to or under the control of such a person;
         (c)   A resident of the school zone parking area for display upon a rented motor vehicle; provided that no such permit shall be valid for more than seven days from date of issuance or renewal thereof; and
         (d)   A resident of a school zone parking area for use by bona fide transient visitors therein. Such a visitor permit shall provide all the rights and privileges of a regular permit. A visitor permit shall be valid for one calendar month and shall expire on the last day of each month. No resident of a school zone parking area shall be issued more than one visitor permit at any one time.
   (D)   Additional parking permits.
      (1)   The Finance Director/City Clerk is authorized upon application to issue additional parking permits to resident of a school zone parking area for use of persons who, on a regular basis, provide health care or other related services essential to the well being of the resident applicant, upon the certification under penalty of perjury by a licensed physician that such services are required. No resident of a school zone parking area shall be authorized to possess more than three additional parking permits at any one time. The City Manager may issue rules and regulations, not inconsistent with this section, governing the manner in which persons shall qualify for this permit.
      (2)   The fee for a parking permit shall be $5. A parking permit shall be valid for the duration of the residency of the permittee and while the permittee retains ownership of the vehicle for which the parking permit was issued. There shall be a $1 transfer charge for those applicants with permits in one school zone parking area who move to another school zone parking area and apply for a permit in the new area of residence. The fee for a rental car permit shall be $1. The fee for a visitor permit shall be $2.
      (3)   The Finance Director/City Clerk is authorized to revoke the parking permit of any person found to be in violation of this section and, upon written notification thereof, the person shall surrender the permit to the Finance Director/City Clerk.
   (E)   Posting. Upon the adoption by the City Council of a resolution designating a school parking area, the Director of Public Works/City Engineer shall cause appropriate signs to be erected in the area, reading as follows: “NO PARKING WHILE SCHOOL IN SESSION”.
   (F)   Display of permits. Permits shall be displayed in a manner determined by the Chief of Police.

§ 9.48.200 Unlawful parking.

   It shall be unlawful to park or leave standing any vehicle in parking zones or spaces, in violation of the restrictions, established pursuant to § 9.48.170.

§ 9.48.210 Commercial zones - Preferential parking.

   (A)   Title. It is unlawful and constitutes an infraction to park any vehicle upon any street, avenue, lane or alley, from time to time, day to day, within any area in the city that has been designated a commercial limited parking area and has been posted with a sign with the words “Limited Parking Except By Permit” pursuant to a resolution of the City Council, unless the non-permit parking conforms with the non-permit parking restrictions posted in the area.
   (B)   Permit parking exemption. A motor vehicle on which is displayed a valid parking permit as provided for in this section, shall be permitted to stand or be parked in the commercial limited parking area for which the permit has been issued. The motor vehicle shall not be exempt from parking restrictions or prohibitions established pursuant to authority other than this section. All other motor vehicles parked within the commercial limited parking area shall be subject to the non-permit parking restriction posted in the area. A parking permit shall not guarantee or reserve to the holder thereof an on-street parking space within the designated commercial limited parking area.
   (C)   Parking permits.
      (1)   Parking permits shall be issued by the Finance Director/City Clerk. Each such permit shall state the address and license number of the motor vehicle for which it is issued. No more than one parking permit shall be issued for each motor vehicle for which application is made. Parking permits shall be valid only so long as the permittee works at a commercial establishment located within the designated commercial limited parking area and while the permittee retains ownership of the vehicle for which the parking permit was issued. The City Manager is authorized to issue such rules and regulations, not inconsistent with this section, governing the manner in which persons shall qualify for parking permits.
      (2)   Parking permits may be issued for motor vehicles only upon application of the following persons:
         (a)   One who is employed by a commercial establishment located within a designated commercial limited parking area who has a motor vehicle registered in his or her name, or who has a motor vehicle for his or her exclusive use and under his or her control;
         (b)   A person who owns or leases commercial property and actively engages in business activity within a commercial limited parking area; and
         (c)   No more than one parking permit may be issued for each commercial establishment for a motor vehicle registered to or under the control of such a person, provided that any religious facility located in such an area may be entitled to two permits.
      (3)   The fee for a parking shall be $5. A parking permit shall be valid for the duration of the time a permittee is employed by or owns an interest in a commercial establishment located within the designated commercial limited parking area.
      (4)   The Finance Director/City Clerk is authorized to revoke the parking permit of any person found to be in violation of this section and, upon written notification thereof, the person shall surrender the permit to the Finance Director/City Clerk.
   (D)   Posting. Upon the adoption by the City Council of a resolution designating a commercial limited parking area, the Director of Public Works/City Engineer shall cause appropriate signs to be erected in the area, reading as follows: “Limited Parking Except by Permit”.
   (E)   Display of permits. Permits shall be displayed in a manner determined by the Chief of Police.

§ 9.52.010 License required - Exception.

   It shall be unlawful for any person to operate or use a bicycle propelled wholly or in part by muscle power upon any street, alley, school ground or area open to the public use within the city without first obtaining a bicycle license from the Licensing Agency. Persons living outside of the city shall be exempt from the purchase of a license when visiting within the city.

§ 9.52.020 Issuance - Expiration of license.

   The Licensing Agency is hereby authorized to issue, on request, and upon payment of the prescribed fee, a permanent bicycle license. All licenses issued shall be for a three-year period. The fee shall be established by resolution of the City Council.

§ 9.52.030 Effect of license.

   The license, when issued, shall entitle the licensee to operate the bicycle for which the license has been issued within the city.

§ 9.52.040 License plate.

   The city shall provide a standard statewide bicycle plate and registration card. A number shall be issued to the bicycle. The number shall be entered on the registration card.

§ 9.52.050 Attaching license.

   The license plate shall be affixed on the forward side of the vertical frame member, extending from the crank sprocket housing to the seat post. The registration card shall be completed in its entirety and issued to the licensee. The number shall be the same as that issued to the bicycle and entered on the registration card.

§ 9.52.060 Records.

   The License Agency shall maintain adequate records of issuance and transfer. The records shall include fees received and the dates involved.

§ 9.52.070 License fee.

   The license fee shall be fixed by resolution of the City Council. The fee shall be collected at the time of issuance of the license. All bicycle licenses will be transferable upon the payment of a fee. All license and transfer fees shall be paid into the general fund of the City of Tulare.

§ 9.52.080 Transfer of license.

   The license shall be transferred to a new owner. A transfer fee shall be assessed. The transfer fee shall be established by resolution of the City Council.

§ 9.52.090 Report of transfer.

   It shall be the duty of every person who sells or transfers ownership of any bicycle to report the sale or transfer to the Licensing Agency within ten days of the sale or transfer. The original registration card shall be presented to the Licensing Agency for verification of ownership. The new owner information shall be entered on the registration card and the card returned to the new owner upon payment of the transfer fee. All records pertaining to the bicycle involved shall be updated to show new owner information.

§ 9.52.100 Altering frame numbers.

   It shall be unlawful for any person to wilfully or maliciously remove, destroy, mutilate or otherwise attempt to change or alter any frame number of any bicycle licensed under the provisions of this chapter.

§ 9.52.110 Tampering with license.

   It shall be unlawful for any person to remove, destroy, mutilate or alter in any way any bicycle license, registration card, or frame number which has been assigned to any bicycle by the city’s Licensing Agency.

§ 9.52.120 Impounding of bicycles.

   The Police Department, or any members thereof, may impound and retain possession of any bicycle operated in violation of any of the provisions of this chapter. The impound may take effect as long as or until such violations have been corrected or fees satisfied. In the event of an impounded or found bicycle not being claimed by its lawful owner within the period of one year, the ownership shall revert to the city. The bicycle shall then be sold at the next scheduled public auction. A new owner shall then be responsible for transfer fees. A new registration card shall be issued in lieu of no available card. All funds received from public auction shall be paid into the general fund of the city.

§ 9.52.130 Report of dealer, secondhand purchase.

   All persons engaged in the business of buying secondhand vehicles are hereby required to make a daily report to the Police Department, giving the name and address of the person from whom the bicycle was purchased and any frame and license numbers available.

§ 9.52.140 Report of dealer, sales.

   All persons engaged in the business of selling new or used bicycles are hereby required to make a daily report to the Police Department, giving the name and address of the purchaser and all frame or serial numbers of the bicycle. All dealers shall be required to maintain a record of sales for a period of not less than five years.

§ 9.56.010 Acquisition of parking facilities authorized.

   Under the provisions of § 52(c) of the City Charter, the Board of Public Utilities Commissioners is hereby granted the power to acquire, construct, operate, maintain, extend, manage and control works and property for the purpose of supplying the city and its inhabitants with revenue producing off-street automobile parking facilities, including off-street parking lots, parking garages, and all other type of off street parking facilities now, or hereafter developed; and to acquire and take by purchase, lease, condemnation or otherwise, and to hold in the name of the city any property situated within or without the city or within or without the state that may be necessary or convenient for such purposes; to borrow money for any or all such purposes of such terms and conditions prescribed by the Board, the indebtedness to be payable only out of the revenue funds pertaining to the off-street parking facilities operated by the Board.

§ 9.60.010 Passenger and freight loading and unloading zone.

   No person shall leave standing or parked upon any street, avenue or lane within the city for a time longer than it takes to load or unload passengers or freight or for any time longer than 15 minutes between the hours of 8:00 a.m. and 6:00 p.m. of each and every day of the week, excepting Sundays and holidays, in any parking area which shall be designated by yellow paint or other yellow material upon the entire curb surface.

§ 9.60.020 Authority to establish zones.

   In the exercise of his or her power to regulate and control traffic upon, and the movement of standing of vehicles upon, the streets or the city, the Chief of Police, subject to the approval of the Manager, is hereby authorized to establish loading and unloading zones in which vehicles will not be permitted to stand longer than 15 minutes or the time necessary to load or unload passengers or freight.

§ 9.60.030 Passenger loading and unloading zone.

   No person shall leave standing or parked upon any street, avenue or lane within the city for a time longer than it takes to load or unload passengers or for any time longer than 15 minutes between the hours of 8:00 a.m. and 6:00 p.m. of each and every day of the week, excepting Sundays and legal holidays, in any parking area which shall be designated by white paint or other white material upon the entire curb surface.

§ 9.64.010 Plan adopted.

   The City of Tulare hereby adopts Rule 9410 of the San Joaquin Valley Unified Air Pollution Control District, as administered by, and as amended from time to time by, the District, as the Transportation Demand Management Plan within the city.

§ 9.68.010 Administrative Fine Schedule.

   The City Council of the City of Tulare in an effort to more efficiently administer all fines, as referenced within each chapter of the Tulare Municipal Code and associated with its administrative citation process hereby sets forth an Administrative Fine Schedule to be established and adopted by resolution.
