ARTICLE I
Title, Purpose and Districts
§ 205-1 Short title.
This chapter shall be known and may be cited as the "Building Zone Ordinance" of the Incorporated Village of Upper Brookville.
§ 205-2 Purpose.
A.
This chapter is for the purpose of regulating and restricting the height, number of stories, architectural design and size of buildings and other structures, the percentage of lot that may be occupied, the size of yards and other open spaces, the density of population and the location and use of buildings, structures and land for residence and other purposes, dividing the Village of Upper Brookville into districts for said purposes and providing fines and penalties for violations of the provisions of this chapter, in order to promote the health, safety, morals and the general welfare.
B.
These regulations have been made in accordance with a comprehensive plan for the improvement of the Village and its future growth, protection and development and with reasonable consideration, among other things, as to the character of each district and its peculiar suitability for particular uses and with a view to conserving the value of buildings and encouraging the most appropriate use of land throughout the Village.
C.
These regulations are designed to:
(1)
Lessen congestion in the streets.
(2)
Secure safety from fire, flood, panic and other dangers.
(3)
Promote health and the general welfare.
(4)
Provide adequate light and air.
(5)
Prevent the overcrowding of land.
(6)
Avoid undue concentration of population.
(7)
Facilitate the adequate provision of transportation, water, sewerage and open space.
(8)
Protect the continuity of wooded areas and the balance between such wooded areas, open fields and other cultivated parcels and the man-made environment.
(9)
Conserve soils and natural topography.
(10)
Minimize erosion and sedimentation.
(11)
Preserve and enhance natural upstream surface water retention areas, encourage the maximum groundwater recharge and protect both groundwater and surface water quality for the Village and the surrounding region.
(12)
Recognize that the country roadside and hedgerows are scenic features which are particularly important in establishing and maintaining the country-like character of the Village.
(13)
Maintain a compatible relationship between the various land uses, including architectural and aesthetic considerations, and a physical and fiscal balance between the intensity of such uses and the available community facilities and services.
(14)
Limit and, where possible, eventually eliminate all significant nonconforming uses.
(15)
Adhere to the principles of the Comprehensive Plan (formerly "Master Plan") of the Village.
§ 205-3 Districts and regulations established.
For the aforesaid purposes the following districts are hereby established and the following regulations governing the height, number of stories, architectural design and sizes of buildings and other structures, their construction, reconstruction, alteration or repair, the percentage of a lot that may be occupied, the sizes of yards, courts and other open spaces, the density of population and the location and use of buildings, structures and land for residence and other purposes are hereby approved and shall hereafter apply in the Village of Upper Brookville.
§ 205-4 Zoning Map.
B.
The boundaries of these districts are hereby established as shown on the map entitled "Zoning Map," Village of Upper Brookville, Nassau County, New York, dated December 11, 1960, which map accompanies and is hereby declared to be a part of this chapter.[1]

§ 205-5 Applicability.
A.
From and after the effective date of this chapter, every building or portion of a building erected or altered and every use within a building or accessory building or upon the land in any district shall be in conformity with these regulations.
B.
From and after the effective date of this chapter, any existing building or structure or any existing use of a building or structure or of land not in conformity with the regulations herein prescribed shall be regarded as nonconforming but may continue, subject to the regulations herein provided in respect to such buildings, structures or uses.
