10.04 Zones Established

In order to carry out the purposes of this ordinance, the unincorporated territory of Utah County, Utah, is hereby divided into zones as follows:

10.08 Declaration

It is hereby declared that in establishing zones, the boundaries thereof, and regulations and restrictions applying within each of the zones, due and careful consideration was given, among other things, to the suitability of the land for particular uses with a view to conserving property values and encouraging appropriate land uses for unincorporated Utah County.

10.12 Official Zone Map

The location and boundaries of each of the zones are shown on the Official Utah County Zone Map. Said map is hereby declared to be an official record and part of this ordinance and the map and all notations, references, and other information shown thereon shall be as much a part of this ordinance as if the matters and other information as set forth by said map were fully described herein. When adopted by the County Commission, said map shall be filed in the Office of the County Clerk/Auditor and may be recorded with the County Recorder. Whenever amendments or changes are made in zone boundaries, such amendments or changes shall be made on the said map.

Any area or portion of this county which is not clearly zoned on said map because of an action which would leave an un-zoned enclave of property in the unincorporated area of Utah County, is hereby declared to be in the CE-1 Critical Environment Zone, unless, prior to specific property becoming subject to the zoning jurisdiction of Utah County, a Public Hearing has been held and approval given for a different zoning district or districts by the Utah County Commission after a recommendation by the Utah County Planning Commission in which event the specific property shall be in such zoning district or districts as designated by the Utah County Commission.

10.16 Boundaries Of Zones

Where uncertainty exists with respect to the boundaries of various zones, the Zoning Administrator shall make a determination of the zone boundary location based on the findings of information on file or recorded in the Offices of Utah County.

10.20 Area And Width Requirements

UCLUO 12 contains the area and width requirements for zoning Lots within the applicable zones established herein; however, Lots within large scale Developments shall be subject to the Lot area and Lot Width requirements established by UCLUO 14, and not by any other conflicting Lot area or Lot Width requirements of this Ordinance.

10.24 Lots Lying In Multiple Zones

Notwithstanding the requirements of the Conflicting Regulations section of UCLUO 1, if a Lot lies in multiple zones, such Lot shall be eligible to obtain permits for those uses permitted or conditionally permitted in the zone in which the majority of the Lot lies, provided:

  1. No more than fifteen (15)-percent and ten (10) acres of the total area of the Lot is included in the minority zone(s).
  2. The portion of the Lot lying in the majority zone must meet the applicable area and width requirements of the majority zone.
  3. Those uses that are permitted, or conditionally permitted, in the I-1, HS-1, or NC-1 Zones, which are not permitted, or conditionally permitted, in a zone associated with a residential, agricultural, or watershed land use designation, as set forth in the Utah County General Plan, or successor document, are prohibited in the minority zone portion of a Lot, if such minority zone portion of a Lot lies in a zone associated with a residential, agricultural, or watershed land use designation.
  4. Any use permitted, or conditionally permitted, exclusively in the I-1 Zone shall not be conducted in the minority zone portion of a Lot.
  5. Structures related to those permitted uses, or conditionally permitted uses, in the majority zone—which uses are not permitted, or conditionally permitted, in the minority zone(s)—shall only be constructed on that portion of the Lot lying in the majority zone.
  6. If a use is permitted or conditionally permitted in both the majority and minority zone(s), a Structure(s) related to such use may be constructed in either in the majority or a minority zone portion of the Lot, provided the portion of the Lot (the entirety of either the majority zone portion or a minority zone portion) on which the Structure(s) lies meets the area requirements of the zone in which the Structure(s) lies.
  7. Waste-water systems are prohibited in the minority zone portion(s) of a Lot lying in multiple zones, if such minority zone portion(s) lies in the CE-1 Zone, unless such CE-1 Zone portion(s) of the Lot meets the applicable area and width requirements for the pertinent use associated with the waste-water system.
  8. Those uses that are not permitted, or conditionally permitted, in the majority zone, but are permitted, or conditionally permitted, in a minority zone, shall not be conducted on a Lot lying in multiple zones.
  9. Notwithstanding the other provisions of this section, a Lot lying in multiple zones—where the total minority zone portions of the Lot exceed fifteen (15)-percent or ten (10) acres—shall be subject to the requirements of the most restrictive zone.
