SECTION 304

- Zoning of annexed areas.

Wherever any area is annexed to the City of Utica, one of the following conditions will apply:

Land that is zoned previous to annexation shall be classified as being in whichever district of this ordinance most clearly conforms with the zoning that existed prior to annexation, such classification to be recommended by the planning commission to the city council and the council shall approve same by resolution.

Land not zoned prior to annexation shall be automatically classified as an R-1A through R-1B district until a zoning map for said area has been adopted by the city council. The planning commission shall recommend the appropriate zoning districts for such area within three months after the matter is referred to it by the city council.

Whenever any city is incorporated, or whenever territory is annexed to any city incorporated pursuant to the provisions of the Home Rule Cities Act, the then existing zoning regulations for the territory within the newly incorporated city or for the annexed territory shall remain in full force and effect for a period of two years after incorporation or annexation, unless the legislative body of the city shall lawfully adopt other zoning regulations or ordinances.
