For the purpose of this chapter, the unincorporated area of Valencia County New Mexico is hereby divided into the following zoning districts:
(A) Natural Resources Districts.
(1) Agricultural Preservation District (AP).
(2) Mineral Resource District (MR).
(3) Parks, Recreation, Open Spaces District (PRO).
(4) Outland District (OD).
(B) Residential Districts.
(1) Rural Residential Districts (RR-1, RR-2).
(2) Suburban Residential District (SR).
(C) Commercial Districts.
(1) Neighborhood Commercial District (C-1).
(2) Community Commercial District (C-2).
(D) Industrial Districts.
(1) Resource Industrial District (I-1).
(2) Light/ General Industrial District (I-2).
(3) Heavy Industrial District (I-3).
(E) Overlay Districts.
(1) Floodplain Overlay District (FP).
(2) Wireless Communications Facilities Overlay District (WCF).
(3) Planned Development District (PD).

§ 154.021 OFFICIAL ZONING MAP.
(A) Generally. The boundaries of the zoning districts and overlay districts established by § 154.020 of this chapter are indicated on the official zoning map which, together with all explanatory matter thereon, is hereby adopted by reference and declared to be a part of this chapter. The official zoning map shall be identified by the signature of the Chairperson of the Commission, attested by the County Clerk, and shall bear the seal of the county under the following language: "This is to certify that this is the official zoning map referred to in § 154.021 of the Valencia County Interim Comprehensive Zoning Chapter, No. 2004-05."
(B) Location of map. Regardless of the existence of purported copies of the official zoning map which may from time to time be made or published, there shall be only 1 official zoning map which shall be located in the office of the County Clerk of Valencia County, being the most recent official zoning map filed of record in the office.
(C) Reference to zoning map. For the precise location of all zoning district and overlay district boundaries within the unincorporated areas of Valencia County, reference shall be made to the official zoning map, which shall be the final authority as to the current zoning status of any land and water areas, or buildings or structures in the county.
(D) Changes in conformity with ordinance.
(1) No changes of any nature shall be made on the official zoning map or matter shown thereon except in conformity with the procedures set forth in this chapter.
(2) Any unauthorized change of whatever kind by any person shall be considered a violation of this chapter and punishable as provided under § 154.999 of this chapter.
(3) Unless any prior official zoning map has been lost, or has been totally destroyed, any or all prior map(s) or any significant parts thereof remaining shall be preserved, as shall all available records pertaining to its adoption or amendments.

§ 154.022 APPLICATION OF ZONING DISTRICT REGULATIONS.
The regulations established by this chapter within each zoning district shall be minimum regulations and shall apply uniformly to each class or kind of structure or land, except as hereinafter provided:
(A) No building or other structure shall hereafter be erected or altered:
(1) To be greater in height or bulk;
(2) To accommodate or house a greater number of families;
(3) To occupy a greater percentage of parcel area; or
(4) To have narrower or smaller front yards, rear yards, side yards, or other open spaces, than specified by this chapter.
(B) No part of a yard, or other open space, or off-street parking or loading space required by this chapter in connection with any building shall be included as part of a yard, open space, or off-street parking or loading space similarly required for any other building.
(C) No yard or parcel existing at the time of passage of this chapter shall be reduced in dimension or area below the minimum requirements set forth herein. Yards or parcels created after the date of adoption of this chapter shall meet at least the minimum requirements established by this chapter.
(D) The zoning district regulations which apply to lands which may hereafter be annexed to any city shall continue in effect until the lands are otherwise classified or rezoned by the jurisdiction having authority to make the changes.
(E) All lands within the unincorporated jurisdiction of the county shall be zoned. The immunity from zoning lands held in ownership or in trust by the United States or by the State of New Mexico to the extent this immunity exists from local control shall be recognized until the immunity ceases. For purposes of this chapter, immunity ceases at the time the land is no longer held in fee simple or trust by the United States or the State of New Mexico.
