After the effective date of this chapter, pre-existing lots or structures, or uses of lots or structures, which are prohibited under the regulations for the zone in which they are located, shall be considered as nonconforming. Nonconforming lots, structures or uses may be continued, provided they conform to the provisions of this section.

§ 156.071 CONTINUANCE OF NONCONFORMING BUILDINGS.
The lawful use of a building existing at the time of the passage of this chapter shall not be affected by this chapter, and such use may be extended throughout the building, provided no structural alterations except those required by law, ordinance or ordered by the Zoning Administrator to secure the safety of the building are made therein. If such nonconforming building is removed or the nonconforming use of such building is discontinued for a continuous period of more than 1 year, every future use of such premises shall be in conformity with the provisions of this chapter.

The lawful use of land existing as of January 1, 2021 although such use does not conform to the provisions of this chapter, shall not be affected by this chapter provided, however, that no such nonconforming use shall be extended to occupy a greater area of land than occupied by such use in existence on January 1, 2021. If such nonconforming use is discontinued for a continuous period of not less than 24 months, every future use of said land shall be in conformity with the provision of this chapter. Uses deemed unlawful by this chapter, or any other public law shall not be covered by this provision.

Nothing in this chapter shall be construed to prevent the restoration of a business or building destroyed by fire, explosion, or other casualty, if such construction is begun 1 year of the date of such damage. Owner occupied residences, which are nonconforming uses may be rebuilt regardless of the extent of the destruction.
