Campgrounds

§ 262-66 Application for permit.
A.
No applicant shall use or allow the use of a parcel of land or portion thereof for the establishment, operation, or maintenance of a campground unless a campground special use permit is obtained as set forth in this article.
B.
Application procedure:
(1)
An application to establish, operate and maintain a campground shall be in writing, signed by the applicant and accompanied by the required special use permit application fee. The application submission shall be submitted on forms provided by the Town and consistent with the provisions of § 262-35 of this chapter, together with a copy of the application to the NYSDOH for a campground permit if required by Title 10 NYCRR, Chapter 1, Part 7, Subpart 7-3.
(2)
Each application submission for a campground special use permit shall contain the following information:
(a)
The name and contact information of the applicant;
(b)
The identification (Tax Map and street address) and the size (in acres) of the parcel that is proposed to be used as a campground;
(c)
The number of campsites to be provided in the campground;
(d)
The name and contact information of the owner of the parcel on which the campground is to be located;
(e)
A management plan describing how the campground will be operated;
(f)
A location map which shows all tax parcels and the location of all public and private streets and roads within 1,000 feet of the proposed campground.
(3)
Special permits shall be reviewed pursuant to the applicable provisions of New York State Town Law § 274-b and Article V, Special Review Standards and Procedures, of this Chapter 262 of the Town Code.
§ 262-67 Campground design standards.
A.
Minimum development area. The land parcel on which the campground is proposed shall have a minimum gross area of at least three contiguous acres in single ownership or under unified control.
B.
The minimum area per site shall be 1,250 square feet. These campsites shall be large enough to allow at least a five-foot clearance between the boundaries of the campsite and the exterior surfaces of the camping unit placed on it, so as to provide for a ten-foot separation distance between camping units on adjacent campsites.
C.
Easily accessible and usable recreational spaces shall be provided in all campgrounds. Such recreational space shall have a total area equal to at least 5% of the gross land area of the campground and shall be fully maintained by the campground operator.
D.
At least one designated off-street parking space shall be provided for each campsite.
E.
Interior campground streets/roads/paths shall be properly designed and constructed for the safe transport of pedestrians or vehicles as allowed by the campground operator.
F.
Water supply and sewage disposal systems shall be designed and constructed in compliance with all Oneida County and New York State Health Department and Environmental Conservation Department requirements.
G.
Every campsite shall be accessible by fire and emergency equipment, and such access shall be maintained in good condition and free of obstacles.
§ 262-68 Campground operations.
A.
The campground operator shall operate the campground in compliance with the standards set forth in this article and shall provide adequate supervision to maintain the campground, its common grounds, roads, facilities and equipment in good repair and in a sanitary condition pursuant to the NYS Sanitary Code.
B.
A campground campsite shall only be used for camping purposes. Camping units and/or recreational camping vehicles shall not be used for residential purposes, whether permanently or temporarily, in any campground. A recreational vehicle in the campground shall be maintained in a transportable condition at all times and meet all requirements which may be imposed by an appropriate state agency.
C.
All receptacles, including cans and dumpsters, shall be kept in a sanitary condition at all times. It shall be the responsibility of the operator to ensure that garbage and refuse shall be collected and properly disposed of outside of the campground as frequently as may be necessary.
D.
The campground operator shall be responsible for maintaining accurate records concerning the occupancy of all campground-owned camping units. Such records shall be available for inspection by the Town Code Enforcement Officer upon 10 days' written notice to the campground operator.
E.
No noxious or offensive activities or nuisances shall be permitted on a campsite or anywhere within the campground.
F.
No campground operator shall permit or allow the dumping or placement of any sanitary waste anywhere upon a campsite or elsewhere within the campground, except in places designated therefor.
§ 262-69 Required permits.
Campgrounds are regulated by the New York State Sanitary Code, Subpart 7-3. All campgrounds with more than five camping sites are under the jurisdiction of the NYS Health Department and require an annual operating permit. A copy of the Town of Verona campground special use permit and the NYSDOH campground permit shall be posted in a conspicuous place on the campground.
