ARTICLE III

Compliance With Various Regulations

§ 365-11 Incorporation of use and bulk regulations.

The restrictions and controls intended to regulate construction and use of buildings in each zoning district are set forth in Article IV, District Use Regulations, and the attached Schedule of Area, Bulk and Yard Requirements, which is hereby declared to be a part of this chapter.[1]

§ 365-12 Buildings to comply with regulations.

No building shall hereafter be erected, altered, converted, enlarged or reduced, wholly or in part, except in conformity with this chapter.

§ 365-13 Subdivisions to result in compliance.

Where a lot is formed from part of a lot already occupied by a building, such subdivisions shall be effected in such a manner as not to impair any of the requirements of this chapter with respect to the existing building and all yards and other open space in connection therewith and so that all resulting lots have adequate dimensions consistent with the requirements of the zone wherein they are located and so that all lots have frontage on a street.

§ 365-14 Compliance with water supply and waste disposal regulations.

In particular, water supply and waste disposal regulations of the Borough of Wallington Board of Health and the State Department of Environmental Protection shall be adhered to.

§ 365-15 Prohibited uses.

Any use not specifically designated as a principal permitted use, an accessory use, or a conditional use is specifically prohibited from any zone district in the Borough. Notwithstanding anything to the contrary in the Borough Code and pursuant to Section 31b of the New Jersey Cannabis Regulatory, Enforcement Assistance, and Marketplace Modernization Act (P.L. 2021, c. 16),[1] all cannabis establishments, cannabis distributors or cannabis delivery services are hereby prohibited in all zone districts in the Borough and further prohibited from operating anywhere in Wallington, except for the delivery of cannabis items and related supplies by a licensed cannabis delivery service based and initiated from a cannabis delivery service outside of Wallington.
