RESIDENTIAL DISTRICTS

§ 154.014 PRINCIPAL AND ACCESSORY USES IN THE RESIDENTIAL DISTRICTS.

   (A)   Summary tables of principal and accessory uses. All principal uses allowed in the residential districts are summarized in Table 4-1 and listed in the sections for the individual zoning districts. All accessory uses are summarized Table 4-2 and listed in the sections for the individual zoning districts.
   (B)   Permitted uses. Principal uses specified with a “P” are permitted by-right in the district or districts where designated, provided that the use complies with all other applicable provisions of this chapter. Essential public services and signs are permitted uses in any zoning district.
   (C)   Conditional uses. Permitted uses specified with a “C” are allowed as a conditional use in the district or districts where designated, upon approval by the City Council, provided that the use complies with all other applicable provisions of this chapter.
   (D)   Accessory uses and structures. Accessory uses, buildings and structures located within a residential district shall comply with the provisions of §§ 154.148 through 154.169.
   (E)   Prohibited uses. Any use not listed as either “P” (permitted) or “C” (conditional) in a particular district or any use not determined by the Planning Director to be substantially similar to a use listed as permitted or conditional in a particular district shall be prohibited in that district. Such determination shall be made in the manner provided for in § 154.007, which addresses conflicts between substantially similar uses.
   (F)   Specific development requirements. Principal permitted and conditional uses indicated under the specific development standards column shall be subject to the standards identified in §§ 154.109 through 154.143, Specific Development Requirements.
   (G)   General development requirements. Development of land for multi-family residential, schools, places of worship, parks or other non-residential purposes shall conform to the requirements for traffic circulation, landscape design, fencing, lighting, and other considerations as specified in §§ 154.148 through 154.169, General Development Requirements. Signs are regulated by Chapter 152 of the code.
   (H)   Dimensional Requirements in the Residential Districts. Dimensional requirements for the residential districts are presented under §§ 154.015 through 154.018, the R-1 District through the R-4 District.

§ 154.015 R-1, SUBURBAN RESIDENTIAL DISTRICT.

   (A)   Purpose. The purpose of this district is to allow low-density single-family detached dwellings in the developing portions of the city where city sewer and water is available. All dwelling units in an R-1 district shall be required to connect to city sewers.
   (B)   Permitted principal uses.
      (1)   Refer to Table 4-1.
      (2)   Some permitted uses have requirements that are presented in §§ 154.109 through 154.143, Specific Development Requirements. Refer also to §§ 154.148 through 154.169, General Development Requirements.
      (3)   In the R-1 zoning district, there shall be no more than one 1-, 2- or 3-family dwelling per land parcel, not counting accessory dwelling units.
   (C)   Conditional principal uses.
      (1)   Refer to Table 4-1.
      (2)   Refer to §§ 154.109 through 154.143 for requirements that must be met for approval of some conditional uses. Refer also to §§ 154.148 through 154.169, General Development Requirements.
   (D)   Accessory uses.

**   No permanent structure (one attached to frost-free footings) shall be located in an easement unless the easement is amended or otherwise allows such structures. A non-permanent structure may be located in an easement but may have to be moved if the easement-holder demands.
 
   (F)   Maximum building coverage. No more than 40% of the parcel shall be occupied by buildings having vertical mass including dwellings, garages, storage buildings, gazebos and greenhouses but not including driveways, parking areas, decks, patios, unscreened courts, wind or solar energy equipment, play equipment or dog houses.
   (G)   Residential driveways shall be a maximum of 28 feet in width at the property line with three foot wide flares (four foot minimum and eight foot maximum length) and maximum slope of 12%. See § 154.155(A)(4) Driveways and Private Internal Access Roads - Number, Separation and Width; and refer also to § 154.162 Parking in Residential Areas, Supplementary.
   (H)   Specific development requirements. Some conditional uses and some permitted uses have specific requirements that are presented in §§ 154.109 through 154.143, Specific Development Requirements. Refer to Table 4-1 for the uses that have specific requirements.
   (I)   General development requirements. Development requirements that apply to all uses are presented in §§ 154.148 through 154.169, General Development Requirements.

§ 154.016 R-2, URBAN RESIDENTIAL DISTRICT.

   (A)   Purpose. The purpose of this district is to allow the continuation of existing residential development and infilling of existing lots in the older residential areas of the city where central sewer and water systems are available.
   (B)   Permitted principal uses.
      (1)   Refer to Table 4-1.
      (2)   Some Permitted uses have requirements that are presented in §§ 154.109 through 154.143, Specific Development Requirements. Refer also to §§ 154.148 through 154.169, General Development Requirements.
      (3)   In the R-2 zoning district, there shall be no more than one 1-, 2- or 3-family dwelling per land parcel, not counting accessory dwelling units.
   (C)   Conditional principal uses.
      (1)   Refer to Table 4-1.

§ 154.017 R-3, MULTI-FAMILY DISTRICT, LOW AND MEDIUM DENSITY.

   (A)   Purpose. The major purpose of this district is to allow low-density multi-family dwelling (two to 15 units), including apartments and townhouses in approximate areas of the city.
   (B)   Permitted principal uses.
      (1)   Refer to Table 4-1.
      (2)   Some permitted uses have requirements that are presented in §§ 154.109 through 154.143, Specific Development Requirements. Refer also to §§ 154.148 through 154.169, General Development Requirements.
      (3)   In the R-3 zoning district, there shall be no more than one 2- or 3-family dwelling per land parcel, not counting accessory dwelling units.
   (C)   Conditional principal uses.
      (1)   Refer to Table 4-1.
      (2)   Refer to §§ 154.109 through 154.143 for specific requirements that must be met for approval of some Conditional Uses. Refer also to §§ 154.148 through 154.169, General Development Requirements.

§ 154.019 R-M, MANUFACTURED HOME COMMUNITY DISTRICT.

   (A)   Purpose. The purpose of this district is to allow manufactured or mobile home communities in appropriate areas of the city.
   (B)   Location. Manufactured home communities are permitted by M.S. § 462.357(1)(b), as it may be amended from time to time, as a conditional use in zoning districts that allow two-family dwellings, or by the city as a permitted use in the R-M zoning district.
   (C)   Permitted principal use.
      (1)   Refer to Table 4-1. Manufactured home communities are the only permitted principal use in the R-M zoning district.

1   Setbacks shall be measured from the lot lines of the manufactured home site, assuming that the lots are not platted. If platted, the setback measurements would be from the platted property lines.
2   Front setback shall be measured from the back of the curb, assuming that the street is not in a platted public right-of-way.
3   The side of the house with the principal door shall face onto the larger setback. The principal door shall not face the street on a corner lot.
4   The driveway between the curb and the parking pad shall be paved with asphalt or concrete.
5   Parking pads shall have a front setback equal to the front setback of the house.
