AGRITOURISM
The following uses, on parcels eligible for agritourism uses, are examples of uses permitted by-right as agritourism subject, when applicable, to requirements for large agritourism events as set out in this article.
(1)
Agritourism events.
(2)
Educational activities related to the on-site agricultural operation, including workshops, demonstrations, and classes.
(3)
Exhibits and museums related to farm or agricultural production.
(4)
Facility tours.
(5)
Farm market.
(6)
Farm stays.
(7)
Farm to table tastings and dinners.
(8)
Farm tours organized by two or more farms or by a third party to which the public is invited to visit multiple farms on a particular day, typically organized weeks or months ahead of time.
(9)
Hayrides.
(10)
Horseback riding.
(11)
Outdoor mazes of agricultural origin such as straw bales or corn.
(12)
On-premises sale, tasting, or consumption of products during regular business hours within the normal course of business of a licensed winery, cidery, craft brewery, and craft distillery.
(13)
Picnics, self-provided or purchased on-site.
(14)
School field trips.
(15)
Self-pick flower, fruit, and vegetable operations.
(16)
Other agritourism activities that do not have a substantial impact on the health, safety, and general welfare of the public, as determined by the Zoning Administrator or his designee, subject to permitting requirements for large agritourism events.

(a)
Agritourism locations shall have no more than 18 large agritourism events per year. Each day shall be a counted as a single large agritourism event regardless of whether multiple activities occur on the same day or consecutive days include similar activities.
(b)
An agritourism location shall obtain an event permit for large agritourism events. A single event permit may provide for multiple events of a similar nature that are scheduled for the same calendar year.
(c)
Farm property auctions, livestock markets, and similar agriculture business activities not conducted for tourism purposes are exempt from event permit requirements stated in this section.

(a)
All agritourism activities and ancillary activities shall be conducted in accordance with all federal, state, local laws, regulations and taxation. This includes, but is not limited to, compliance with Code of Virginia, § 3.2-6402(A), requiring the posting and maintaining of certain warning signs.

All necessary federal, state and local licenses and permits for agritourism activities and ancillary activities shall be obtained prior to beginning operation of, and shall be maintained in good standing during operation of the activities.

The following list is a non-exclusive list of uses that shall not be agritourism as permitted in this article regardless of whether such use occurs on a parcel eligible for agritourism uses because such uses are not customarily associated with agricultural operations and have high risk of substantial impact on the health, safety, and general welfare of the public.
(1)
Amusement rides.
(2)
Off-road vehicle trail riding.
(3)
Rodeo.
(4)
Ziplines.
(5)
Outdoor amplified sound, unless permitted by event permit or exempt from permit requirements.

The following minimum requirements shall apply to all parcels used for agritourism pursuant to this article.
(1)
Access shall be provided by an exclusive right of ingress/egress from a state-maintained road or by a shared right of ingress/egress contingent upon written limited term agreement with notarized signatures of all users of such private access. Term of such private agreement shall be no longer than one 12-month period. Successive 12-month agreements are allowed.
(2)
Sufficient area for parking shall be provided on-site. No parking shall be permitted on the public or private roadway access to the property.
(3)
Adequate restroom facilities, waste water management, and solid waste management shall be provided.
(4)
Subject to exception for non-conforming exterior lighting installed prior to the effective date of this article, all exterior lighting installed after the effective date of this article shall be down-cast and shielded to minimize glare and reduce light trespass and skyglow by being fully shielded.
(5)
All use shall be governed by the County Noise Ordinance.
(6)
State laws and regulations governing operations of licensed farm wineries, limited breweries, and limited distilleries shall control in the event of conflict with this article.
