AN ORDINANCE AUTHORIZING BOUNDARY MODIFICATIONS TO THE AREA
KNOWN AS THE DEKALB COUNTY ENTERPRISE ZONE
AMENDMENT 5
SOUTHEAST DEKALB INDUSTRIAL EXPANSION
 
 
WHEREAS, the Town of Cortland, the City of DeKalb, the City of Genoa, the City of Sandwich, the City of Sycamore, the Village of Waterman, and the County of DeKalb, the "Designating Units of Government", entered into an agreement and adopted ordinances and resolutions establishing an Enterprise Zone including incorporated portions of the City of DeKalb, the Town of Cortland, the City of Genoa, the City of Sandwich, the City of Sycamore and the Village of Waterman and unincorporated portions of the County of DeKalb and;
WHEREAS, the Initial Designating Ordinances and the DeKalb County Enterprise Zone were certified by the Illinois Department of Commerce and Economic Opportunity (DCEO) to begin operations on January 1, 2016, in accordance with the Illinois Enterprise Zone Act (20 ILCS 655/1 et. seq.), hereafter referred to as the "Act"; and,
 
WHEREAS, there is a need to expand the boundary of the DeKalb County Enterprise Zone to include the area as described in Exhibits “A” and "B", and,
WHEREAS, the proposed area to be added is contiguous, as defined in the Act, to the existing DeKalb County Enterprise Zone boundaries, and,
WHEREAS, there is adequate available acreage in the DeKalb County Enterprise Zone to accommodate the expanded boundary; and,
 
WHEREAS, a public hearing regarding such amendments has been held as provided by law on July 22, 2025; and,
 
WHEREAS, this Ordinance and the related Amendment to the DeKalb County Enterprise Zone Intergovernmental Agreement (IGA) found in Exhibit C shall be in effect from and after their passage, approval and recording according to law.
 
NOW, THEREFORE BE IT ORDAINED BY THE VILLAGE PRESIDENT AND THE VILLAGE BOARD OF THE VILLAGE OF WATERMAN, ILLINOIS:
 
SECTION 1. The Village of Waterman hereby approves and concurs with expanding the boundary of the DeKalb County Enterprise Zone to include those areas as described in Exhibits A and B, also referred to as Amendment 5 to the Zone.
 
SECTION 2. That the Village President of the Village of Waterman is authorized to execute the Amendment to the Enterprise Zone Intergovernmental Agreement between the Town of Cortland, the City of Genoa, the City of DeKalb, the City of Sandwich, the City of Sycamore, the Village of Waterman, and the County of DeKalb attached as Exhibit C.
 
SECTION 3. That this Ordinance shall become effective immediately upon the adoption thereof, subject to approval by the Illinois Department of Commerce and Economic Opportunity.
 
SECTION 4. That the Village Clerk is hereby directed and authorized to publish this Ordinance in pamphlet form as required by law and forward one original and two certified copies of this Ordinance to the DeKalb County Enterprise Zone Administrator for inclusion in the Illinois Department of Commerce and Economic Opportunity’s Application to Add Territory- Option 2 for its approval and to file a certified copy of this Ordinance is available for public inspection upon request in the office of the municipal clerk.

ORDINANCE 2025-08
AN ORDINANCE APPROVIING VARIANCE TO ZONING ORDINANCE
 
 
 
BE IT ORDAINED, by the Trustees of the Village of Waterman, DeKalb County, Illinois, at a regular meeting held on the 14 th day of October 2025, that:
 
WHEREAS, the Village of Waterman County of DeKalb, State of Illinois (the “Village”), is a duly organized and existing village created under the provision of the laws of the State of Illinois, and is no operating under the provisions of the Illinois Municipal Code, and all laws amendatory thereof and supplementary thereto, with full powers to enact ordinances and adopt resolutions for the benefit of the residents of the Village; and
 
WHEREAS, the owner of record of the improved real property commonly known as 310 S. Hickory, Waterman, Illinois (the “Property”) requested a variance from the Waterman Zoning Ordinance to build a non-confirming structure;
 
WHEREAS, the Planning Commission met on June 23, 2025, to consider the application for a variance;
 
WHEREAS, the Planning Commission made a recommendation to the Board of Trustees at the regularly scheduled meeting of July 8, 2025, to approve the requested variance;
 
WHEREAS, the Board of Trustees voted in favor of the requested variance;
 
WHEREAS, the Illinois Municipal Code provides that in municipalities of less than 500,000, if the authority to determine and approve variations is vested with the corporate authorities, it must be exercised by adoption of an ordinance, 65 ILCS 5/11-13-5;
 
NOW, THEREFORE, be it ordained by the President and Board of Trustees of the Village of Waterman:
Section 1:   The foregoing recitals are incorporated herein as the findings of the Board of Trustees for the Village of Waterman.
 
Section 2:   It is hereby declared that the request to construct a non-conforming structure on the Property is granted.
 
Section 3:   This Ordinance shall become effective upon its passage and approval as provided by law.

AN ORDINANCE APPROVING THE 2026 PROPERTY TAX LEVY
 
WHEREAS, the Village of Waterman as a corporate authority in the State of Illinois has the authority to levy for taxes; and
 
WHEREAS, the Village President and Board of Trustees of the Village of Waterman have reviewed the proposed property tax levy in conformance with all statutes and regulations;
 
NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Waterman, DeKalb County, Illinois as follows:
 
SECTION 1. That this is an ordinance levying taxes for all corporate purposes for the VILLAGE OF WATERMAN, DEKALB COUNTY, ILLINOIS, for the tax year 2026.
 
SECTION 2. That the amounts hereinafter set forth, or so much thereof as may be authorized by law, and the same are hereby levied for such purposes as: General Corporate, Road & Bridge, Police, Audit, Tort, Social Security, Chlorination, and Recapture Revenue.
 
SECTION 3. That the amount appropriated for each object and purpose shall be as follows:

SECTION 5. That all ordinances and parts of ordinances in conflict with or inconsistent with the provisions of this ordinance are hereby repealed to the extent of any such conflict or inconsistency.
 
SECTION 6. That if any part or portion of this ordinance shall be declared invalid by a court of competent jurisdiction, such partial invalidity shall not affect the remainder of this ordinance.
 
SECTION 7. That this Ordinance shall be in full force and effect from and after its passage and approval.

AN ORDINANCE APPROVING THE AMENDMENT TO
THE ANNEXATION AGREEMENT
BE IT ORDAINED, by the Trustees of the Village of Waterman, DeKalb County, Illinois, at a regular meeting thereof held on the 9th day of December 2025, that:
WHEREAS, the Village of Waterman, County of DeKalb, State of Illinois (the “Village”), is a duly organized and existing village created under the provision of the laws of the State of Illinois, and is now operating under the provisions of the Illinois Municipal Code, and all laws amendatory thereof and supplementary thereto, with full powers to enact ordinances and adopt resolutions for the benefit of the residents of the Village; and
WHEREAS, the VILLAGE authorized execution of the Original Annexation Agreement on June 8, 2004 to incorporate a parcel of unimproved real estate referred to as the “TERRITORY”, the legal description of which is attached hereto as Exhibit A with the intention of developing the TERRITORY as single-family dwelling units, multi-family dwelling units and commercial lots and that said Annexation Agreement was recorded as document number 2004019233 on September 17, 2004 with the DeKalb County Recorder of Deeds; and
WHEREAS, an Amendment to the Annexation Agreement approved on November 9, 2004, by the VILLAGE and that said Amended Annexation Agreement was recorded as document 2004023389 on November 16, 2004, with the DeKalb County Recorder of Deeds; and
WHEREAS, the original DEVELOPERS, Mohammad E. Akrabawi and Shirley L. Akrabawi transferred the TERRITORY to Deerfield Crossings, LLC by warranty deed recorded on December 6, 2004, with the DeKalb County Recorder of Deeds; and
 
   WHEREAS, Deerfield Crossings LLC sold the TERRITORY to ALMANAR TRADING, LLC by warranty deed recorded on June 4, 2010 with the DeKalb County Recorder of Deeds. The owner of record, and all future owners shall be referred to herein as the “DEVELOPER”; and
 
WHEREAS, the TERRITORY remains largely undeveloped and unimproved and the VILLAGE believes it to be in its best interest to encourage development of the TERRITORY;
 
WHEREAS, certain terms of the Original and Amended Annexation Agreements are expiring and the VILLAGE desires to extend and modify the Original Annexation Agreement in order to allow for future development of the TERRITORY; and
WHEREAS, the Original Annexation Agreement allows for amendment of the Agreement upon mutual consent of the parties; and
 
WHEREAS, under the Illinois Municipal Code, the Annexation Agreement may be amended by the corporate authorities, pursuant to notice published once in a newspaper of general circulation in the annexing municipality at least 15 but not more than 30 days prior to the Village Board hearing on the proposed amendment; and
WHEREAS, the Village of Waterman published the appropriate notice pursuant to the Illinois Municipal Code and a public hearing was held on December 9, 2025.
 
NOW, TEHREFORE, be it ordained by the President and Board of Trustees of the Village of Waterman:
 
Section 1: The Annexation Agreement Amendment dated October 20, 2025, is approved by the Board of Trustees for the Village of Waterman.
Section 2: That this ordinance shall become effective immediately upon its passage and proper recording.

AN ORDINANCE APPROVING AMENDMENT TO ANNEXATION AGREEMENT
 
which Ordinance was adopted by the Board of Trustees at a regular meeting held on the 9th day of DECEMBER 2025.
 
   I do further certify that a quorum of said Board of Trustees was present at said meeting; that the deliberations and vote of the Board on the adoption of said ordinance were conducted openly; that said meeting was called and held at a specific time and place convenient to the public; that the agenda for said meeting was posted at the location where said meeting was held and at the principal office of the Board at least 48 hours in advance of holding said meeting; that notice of said meeting was duly given to all of the news media requesting such notice; that said meeting was called and held in strict compliance with the provisions of the Open Meeting Act of the State of Illinois, as amended, and with the provisions of the applicable statutes of the State of Illinois, as amended.
