ARTICLE XXII
M-S Medical Service District
§ 84-101 Purpose and intent.
It is the purpose and intent of this article to further the public health, safety and welfare by making provision for a Medical Service District to adequately provide for centralized medical facilities to serve the people in the West Chester region, of which the Township is a part, to encourage location of support of medical services uses within the district in conjunction with existing medical facilities and to provide for the expansion of existing medical facilities within the district to service the present and future needs of the region.
§ 84-102 Use regulations.
A building may be erected, altered or used and a lot or premises may be used for any of the following purposes and for no other:
A.
A general hospital for humans with the following designated accessory uses when located and operated within the hospital facility or when operated and located on a lot immediately adjoining and contiguous to the lot on which the hospital facility is located:

(1)
A medical education school.
(2)
Residences for hospital staff.
(3)
A cafeteria.
(4)
An outpatient clinic.
(5)
An emergency service.
(6)
A maintenance shop.
(7)
Power generation.
(8)
A hospital- or clinic-related laundry.
(9)
Nursery school, kindergarten or child day-care center and adult day-care center, provided that:

(a)
A minimum of 75% of the number of individuals enrolled in any such facility shall, at all times, be comprised of the children, grandchildren, parents or grandparents or other members of the immediate household of the hospital employees or of its medical, surgical or nursing staffs.
(b)
The enrollment at any such center shall not at any time exceed 120 people.
(c)
The center shall annually, on or before December 1 of each calendar year, verify and certify to the Township, by completion of a questionnaire form provided by the Township, that the center is in compliance with the percentage limitation imposed by Subsection A(9)(a) of this section.
(d)
In addition to the minimum area and bulk regulations and design standards established in this article, any such facility shall comply with the minimum site standards, design standards and regulations established and promulgated by the Pennsylvania Department of Public Welfare, the Pennsylvania Board of Private Schools or other state regulatory agency having jurisdiction.
B.
Medical office building or clinic, including outpatient medical services.

C.
Pharmacy.
D.
Ambulance and emergency rescue services.
F.
Accessory uses to the aforementioned permitted uses, but excluding drug and/or alcohol treatment centers.
§ 84-103 Area and bulk regulations.
The following area and bulk regulations shall apply:
A.
Lot size: two acres minimum.
B.
Lot width at building line: 200 feet minimum.
C.
Lot width at street right-of-way line: 50 feet minimum.
D.
Building ground area coverage: 30% maximum of lot area.
E.
Building setback line: 40 feet minimum for any building or parking area.
F.
Side yard: 50 feet minimum for each, except that a building on any corner lot must be set back 20 feet from the lot line on the side street.
G.
Green area which must be landscaped: 20% minimum.
H.
Rear yard: 100 feet minimum.
J.
Paved surface area not to exceed 60% of the total lot area.
K.
Public water and public sewer facilities required.
§ 84-104 Design standards.
The following design standards shall apply:
§ 84-105 General standards.
The following limitations shall be applied to any use permitted in this district:
A.
No use shall be conducted in any open area.
B.
No goods shall be displayed in any open area.
C.
No odors shall be emitted which are perceptible at the lot line adjoining another zoning district.
D.
No glare shall be allowed which is perceptible at the lot line adjoining another zoning district.
E.
No loading shall be permitted in the area between the building and any street line.
F.
No noise emanating from a use in this district shall exceed the level of ordinary conversation at the rear lot line. Short, intermittent noise peaks may be permitted if they do not exceed normal traffic noise peaks.
§ 84-106 Special design standards.
The following special design standards shall apply:
A.
The height of the general hospital building may exceed the maximum building height regulation of § 84-103I when authorized as a special exception by the Zoning Hearing Board subject to Article XVII of this chapter, provided that the applicant demonstrates by a clear preponderance of the evidence that the proposed structure can be serviced by existing fire-fighting equipment, and provided, further, that the height of such building shall be limited in any event to no more than eight stories or 80 feet, whichever is the lesser.
§ 84-107 Special use regulations.
The following uses shall be permitted as a special exception when authorized by the Zoning Hearing Board subject to Article XVII of this chapter. The area and bulk regulations, design standards and general standards established by this article shall apply.
A.
A helicopter pad, provided that it is a rooftop type, and provided, further, that the applicant establishes by a clear preponderance of the evidence that its use is intended for emergency services use only and not for general transportation.
