ARTICLE XI
Piers, Boathouses and Marinas on Greenwood Lake
§ 500-114 Purpose.
In view of the need to insure safe and unobstructed movement of water traffic as well as the most appropriate utilization of water resources and open space on Greenwood Lake, the following provisions shall apply to boathouses and marinas.
§ 500-115 General requirements; permit requirements.
A.
Permit required. No boathouse or marina shall be constructed, enlarged or extended unless and until the owner and/or lessee secures from the Construction Official a construction permit as provided under § 470-4 of this Land Development Ordinance. Normal maintenance and repair and seasonal replacement of preexisting structures shall not require a building permit.
B.
Marina site plan. Prior to the issuance of a construction permit for a marina, the Planning Board shall review and approve a site plan in conformance with the Land Development Ordinance, which shall include a water traffic circulation plan.
C.
Marine services. Permit applications for a marina shall be referred to the Division of Marine Services by the applicant for any comments and suggestions as part of the site plan review.
D.
Construction limitations.
(1)
No boathouse or marina shall extend into Greenwood Lake beyond the pierhead line or more than 15% of the width of Greenwood Lake measured on a line perpendicular to the closest opposite shore, whichever is less.
(2)
For the purpose of determining the exterior limits of boathouses and mainwalks, any structure, including any type of anchors or pilings placed or driven independently of the main structure, used for the mooring of boats or the securing of the main structure, shall be considered to be part of the boathouse or mainwalk.
(3)
The top of any pier shall not be less than 14 inches from the high water mark of 10.25 on the gauge at the Awosting Dam.
E.
Supervision and maintenance. The owner and/or lessee of a boathouse or marina shall provide for the proper supervision of such facility and to maintain such facility in good condition, free of litter or refuse, so as not to be offensive to surrounding lot owners or the general public. If such facility is in danger of becoming a hazard to residents, visitors, swimmers or boats, or adversely affecting navigation by reason of structural members extending or floating into Greenwood Lake, then the Construction Official shall notify and require the owner and/or lessee to undertake repairs.
§ 500-116 Development controls for boathouses.
No boathouse shall be constructed, enlarged or extended and no building permit shall be issued therefor except in compliance with the following requirements:
A.
Boathouses shall be permitted in all zoning districts on lots that have water frontage.
B.
No boathouse shall be located closer to the side lot line than this chapter permits for an accessory building in that zone.
C.
Any combination of piers and boathouses shall not occupy more than 20% of the water lot area within the pierhead line. In no case shall a boathouse alone exceed 15% of the water lot area within the pierhead line.
D.
There shall not be more than one boathouse for each water lot.
E.
Boathouses shall be located over the water and shall abut the shoreline of the waterway.
F.
Ingress and egress for boats shall be perpendicular to the shoreline.
G.
There shall be no living or sleeping accommodations, cooking or toilet facilities provided in any boathouse.
§ 500-117 Development controls for marinas.
No marina shall be constructed, enlarged or extended and no building permit shall be issued therefor except in compliance with the following requirements:
A.
Marinas shall be permitted only in those zoning districts wherein such use is a permitted use, provided that no marina shall be located within 200 feet of a public or private beach or swimming area.
B.
No dock, pier or mainwalk constituting part of a marina shall be located within 16 feet of a side lot line, nor shall a pier, dock or mainwalk within a marina be located closer than 30 feet from a private pier, dock or mainwalk.
C.
No marina shall occupy more than 30% of the water lot area within the pierhead line.
D.
No mainwalks shall be less than four feet in width and no catwalk shall be less than two feet in width.
E.
No more than one mainwalk or pier or dock shall be permitted on a channel to open water less than 24 feet.
F.
In cases where piers, docks or mainwalks are covered, the maximum height shall not exceed 12 feet above the high water mark.
§ 500-118 Technical requirements applying to waterfront developments.
No dredging, filling or structures which may lower, raise or affect the capacity of Greenwood Lake or the flow of water shall be permitted except by permission of the New Jersey Department of Environmental Protection and/or the U.S. Army Corps of Engineers.
