18.40 Highway

Business District HB

18.40.010 Purpose.

The purpose of the highway business (HB) district is to provide areas for the location of businesses established to serve a mobile public and which are dependent upon access by vehicular traffic. [Ord. 525 § 3, 1981; Ord. 419 Ch. 4 § 6, 1976. 1996 Code § 7-50.]

18.40.020 Permitted uses.

(a) Uses Not Requiring a Special Use Permit.

(1) Service stations;

(2) Auto washing establishments;

(3) Motels and hotels;

(4) Restaurants (including drive-in);

(5) Convenience stores;

(6) Grocery and drug stores;

(7) Professional services (including medical and dental clinics and financial institutions);

(8) Repealed by Ord. 848;

(9) Hospitals;

(10) Repealed by Ord. 853;

(11) Commercial sports and recreation facilities;

(12) Drive-in movie theaters;

(13) Electric vehicle charging stations;

(14) Government facilities;

(15) Retail package alcohol sales;

(16) Bars;

(17) Retail stores and shops;

(18) Truck stops including service and overnight parking;

(19) Sales of passenger automobiles and light-duty pickup trucks;

(20) All uses allowed in a general business district;

(21) Animal clinics;

(22)     Arenas;

(23) Auto repair shops, and auto body repair shops, with auto storage no longer than 60 days unless proof is provided by the shop that they are awaiting parts but nothing destined for junk or salvage;

(24)     Bus terminal;

(25)     Retail with outdoor storage;

(26) Wholesale with outdoor storage;

(27) Farm implement sales/service;

(28) Frozen food lockers;

(29) Commercial greenhouses;

(30) Heavy equipment sales/service;

(31) Commercial kennels;

(32) Landscaping nurseries;

(33) Lumberyard;

(34) Mobile home sales/service;

(35) Research labs or facilities;

(36) Shopping centers;

(37) Assisted living/long-term care;

(38) Clubs/lodges;

(39) Childcare center;

(40) Plumbing/welding/electrical supply shops;

(41) Warehouses.

(b) Uses Requiring a Special Use Permit.

(1) All other uses not mentioned in allowed uses or an allowed use declared by the building inspector and planner to be not in conformance with the purpose of this district due to peculiar circumstances require a special use permit as provided by WMC 18.95.010.

(2) Dwellings, which the special use permit shall be retained by the structure until such time the dwelling portion is reverted to a business, or the dwelling becomes uninhabitable for two years.

(c) Uses prohibited in highway business districts are:

(1) Junkyards;

(2) Storage of any wrecked or inoperable vehicles for a period in excess of six hours except in connection with a full-time auto body repair shop or auto repair shop. The storage of any vehicle on the premises of any auto body repair shop or auto repair shop shall be allowed only for bona fide business purposes in connection with the operation and conduct of any such business;

(3) Any use permitted in a heavy industrial district and other similar uses permitted in such district;

(4) Although otherwise permitted, any use which interferes with the free flow of traffic. [Ord. 853 §§ 6 – 13, 2025; Ord. 848 §§ 3, 6, 2024; Ord. 820 § 4, 2018.]

18.40.030 Development standards.

(a) Minimum lot area shall be 10,000 square feet.

(b) Maximum height shall be subject to fire protection capabilities.

(c) Setback requirements shall be as follows:

(1) Front yard: 40 feet (12.2 meters).

(2) Side yard: 25 feet (7.6 meters) from residential property lines when abutting a residential zone, 15 feet when abutting any nonresidential district, and five feet where abutting an alley.

(3) Rear yard: 25 feet (7.6 meters) from residential property lines when abutting a residential zone, 15 feet when abutting any nonresidential district, and five feet where abutting an alley.

(4) Gasoline pumps: 15 feet (4.6 meters) front and side yard setback.

(5) Sales stands: 40 feet (12.2 meters) front yard setback.

(6) Adjacent to interstate right-of-way: 10 feet (3.0 meters).

18.40.040 Site plans.

A site plan shall be submitted to the building inspector in order to obtain a building permit. A site plan may be required for review by the planning commission at its discretion. [Ord. 419 Ch. 4 § 6, 1976. 1996 Code § 7-53.]
