LOADING REQUIREMENTS

§ 155.110 OFF-STREET PARKING REQUIRED.

   (A)   Adequate parking. There shall be provided at the time of the erection of any building, or at the time any principal building is enlarged or increased in capacity by adding dwelling units, guest rooms, seats or floor area, permanent off-street parking space in the amount specified by this subchapter. The parking space may be provided in a parking garage or properly graded open space that complies with the standards for parking established in this chapter. No off-street parking is required within B-1 Zones.
   (B)   Application. Each application for a zoning permit or a building permit shall include sufficient information for the Administrator to determine if adequate space is available to meet the requirements of this chapter for the stated intended use.
   (C)   Combination of required parking space. The required parking space for any number of separate uses may be combined in one lot, but the required space assigned to one use may not be assigned to another use, except, that one-half of the parking space required for churches, theaters or assembly halls, whose peak attendance will be at night or on Sundays, may be assigned to a use which will be closed at night or on Saturdays and Sundays.
   (D)   Parking standards. Parking lands shall be physically improved, landscaped, properly surfaced, marked or otherwise designated, and shall conform to city standards. Each parking space shall be unobstructed and shall be arranged so that any vehicle may be moved into and out of each space without moving any other vehicle.
   (E)   Lighting. Lighting shall be provided on the parking lands and shall be of a type and placement so as not to pose a visual disturbance to adjacent property owners. Lighting plans shall be submitted for review and approval to the Administrator which show the size, type and placement of all units.
   (F)   Paved sidewalks. Paved sidewalks (adjacent to parking lots) as per city specifications, shall be provided at the owner’s expense.
   (G)   Parking. Parking required for uses in the central business district may be provided within 400 feet of the main entrance to the principal use and located in any commercial zone if the required off-street parking cannot be reasonably provided on the same lot on which the principal use is located.
   (H)   Certificates of occupancy. No certificates of occupancy shall be issued for any units until the required number of parking spaces, with ingress and egress are fully constructed. In the event any of the required parking spaces for units for which certificates of occupancy are requested are provided on non-contiguous parking lands, the lands shall be fully constructed and dedicated in accordance with all of the standards of this chapter before the certificates of occupancy shall be issued.

§ 155.111 PARKING REQUIREMENTS PER LAND USE.

   The following off-street parking spaces shall be required and shall conform to the standards contained in § 155.110.

§ 155.112 HANDICAPPED PARKING REQUIREMENTS.

   (A)   (1)   In addition to the use requirements for off-street parking detailed in this section, a minimum of one parking space for the handicapped shall be provided at governmental buildings, public or quasi-public buildings, professional offices, clinics, short- and long-term care facilities and commercial facilities.
      (2)   An additional handicapped space shall be provided in parking areas for each additional 25 spaces above the initial 25 spaces.
   (B)   Each space must be a minimum of 12 feet, six inches wide, be visibly marked as required by the North Carolina State Building Code Volume lc, 1989 and meet other regular requirements.
   (C)   Handicapped parking must be provided in accordance with North Carolina State Accessibility Code (ADA).

§ 155.113 OFF-STREET LOADING REQUIREMENTS FOR SHOPPING CENTER, WHOLESALE AND INDUSTRIAL USES.

   (A)   The number of off-street loading berths required by this section shall be considered as the absolute minimum and the developer shall evaluate his or her own needs to determine if they are greater than the minimum specified by this section.
   (B)   For purposes of this section, an off-street loading berth shall have minimum plan dimensions of 12 feet by eight feet and 14 feet overhead clearance with adequate means for ingress and egress.
