- ADMINISTRATION
The Planning and Building Department, under the direction and supervision of the Land Code Administrator, shall be responsible for administering and enforcing this ordinance. The Land Code Administrator may be provided with the assistance of other persons as the Board of Aldermen may direct. Any officer of the Wiggins Police Department is also authorized to enforce this ordinance.
The Planning and Building Department, as directed by the Land Code Administrator (LCA), shall have the following powers and duties:
1.
The interpretation of this ordinance shall be the responsibility of the Land Code Administrator.
2.
To review all applications for development within the City of Wiggins and ensure that they are in compliance with this ordinance.
3.
To issue all permits and approval letters for land development upon completion of the required review procedure and approval by the authorized body.
4.
To revoke or suspend any permit issued under this ordinance that is not in compliance.
5.
To perform all inspections required by this ordinance and to perform any additional inspections the LCA deems necessary to ensure compliance with this ordinance.
6.
To enforce any conditions attached to permits or approvals by the Planning Commission or Board of Aldermen.
7.
To prepare the agenda and keep a record of the minutes of all Planning Commission meetings. The LCA shall ensure that the City Clerk receives signed copies of the minutes to be bound and made available for public review.
8.
To prepare and present recommendations on all actions presented to the Planning Commission or Board of Aldermen under this ordinance.
9.
The LCA shall serve as the Floodplain Administrator and shall administer and enforce the Flood Damage Prevention Ordinance as outlined in that ordinance.
10.
The LCA may order the discontinuance of any use of land, buildings or structures that was not legally established in accordance with this ordinance.
11.
The LCA may order the removal by the property owner of any buildings, structures, additions, alterations, or structural changes which were not legally erected in accordance with this ordinance.
12.
The LCA may order the discontinuance of any work being done which is not in compliance with this ordinance.

The Planning Commission (PC) shall consist of five (5) members to be appointed by the Board of Aldermen. The Board of Aldermen may also appoint an alternate Planning Commission member to serve in the absence of any regularly appointed member. Members shall serve three-year terms which shall be staggered such that no more than two positions are re-appointed per year. The LCA shall maintain a record of appointments and terms and shall notify the Planning Commission and Aldermen of the needed appointments each year. The Board of Aldermen may remove any member of the Planning Commission with or without cause at any time.

The Planning Commission shall review applications and conduct hearings as specified in this ordinance. After review, they shall approve or prepare recommendations for applications presented to the commission as called out in this ordinance. The commission shall prepare any additional recommendations to the Board of Aldermen it deems necessary to provide for the application and enforcement of this ordinance.
3.
The Planning Commission shall adopt rules necessary for the conduct of its affairs and in keeping with the provisions of this ordinance. The Planning Commission shall elect as a minimum a chairperson and vice-chairperson.

Meetings shall be held at least monthly on a date scheduled by the Planning Commission.

Decisions made by the Land Code Administrator may be appealed to the Planning Commission by any person affected by the decision, any member of the Planning Commission, any member of the Board of Aldermen or the Mayor.

Decisions made by the Planning Commission may be appealed to the Board of Aldermen by any person affected by the decision, the Land Code Administrator, any member of the Board of Aldermen or the Mayor.
3.
Written appeals shall be filed with the Land Code Administrator or City Clerk no later than ten (10) days after the date the decision is made. A written appeal shall stay all proceedings on the appealed action until the appeal is heard and acted upon. The Land Code Administrator shall set the appeal hearing date and confirm it with the Governing Authority. The Land Code Administrator shall give notice to all parties involved and shall post a public notice at City Hall at least five (5) days prior to the hearing. The Planning Commission or Board of Aldermen shall act on the appeal within 60 days.
4.
Appeals from decisions made by the Board of Aldermen shall be by petition for appeal to the appropriate Court. Any such petition to the Court shall be filed with the Court Clerk no later than 30 days after the date the decision is entered into the Official Minutes of the City of Wiggins.
