ARTICLE X

- NONCONFORMING USES AND STRUCTURES

Sec. 30-677.- Use of structures which are nonconforming.

The existing lawful use of a structure or premises which is compliant with shoreland setbacks, but is not in conformance with other provisions of the Burnett County Ordinances may be continued subject to the following conditions:

(1)

No structural addition to any nonconforming structure over the life of the structure shall exceed 25 percent of its building envelope and may not increase the nonconformity, unless a variance permitting expansion beyond 25 percent of its building envelope is successfully obtained. Any repair, maintenance, renovation, rebuilding or remodeling of a nonconforming structure or any part of a nonconforming structure is allowed within the same structure envelope as long as a permit is obtained (if required) prior to the activity taking place.

(2)

Discontinued nonconforming use. If a nonconforming use is discontinued for a period of 12 months, any future use of the building, structure or property shall conform to this chapter.

(3)

Uses or adjuncts thereof which are nuisances shall not be permitted to continue as nonconforming uses.
