ARTICLE VI

- EXCEPTIONS AND MODIFICATIONS

Sec. 58-196. - Lot of record.

A lot which exists as an established lot of record at the time of the adoption of the ordinance from which this chapter is derived and which does not comply with the area, yard or other requirements of this chapter, may continue as a nonconforming lot. The board of appeals may grant a variance from the requirements of this chapter to permit the use of the lot as a building site in which case the board of appeals shall establish the setback restrictions, building restriction lines, yard and other requirements of this chapter in such a manner so as to comply, as closely as possible, with the requirements of this chapter.

Sec. 58-197. - Height limitation exemptions.

Chimneys, church steeples, cooling towers, elevators, bulkheads, fire towers, monuments, stacks, stage towers or scenery lofts, tanks, water towers, spires, radio and television antennae and towers, grain elevators or other such architectural and mechanical appurtenances are exempt from height regulations.

Sec. 58-198. - Exceptions and modifications to yard requirements.

(a)

Allowable projections of structure into yards and other exceptions to yard requirements. Architectural features of buildings, such as window sills, cornices, roof overhangs and unenclosed porches may project into the area within the building setback lines not more than six feet. Open fire escapes, fireproof outside stairways, chimneys and flues may project into the area within the building setback lines not more than six feet. Ground level patios and uncovered decks may extend into the rear yard up to one-half the distance of the rear yard requirement and no closer than six feet to either side lot line for single-family detached dwellings.

(b)

Side yards not required for second-story residential uses in nonresidential structures. Side yards shall not be required for residential dwellings erected above commercial structures.

(c)

Allowable projections of business structures into yards. Awnings, canopies, marquees as attached to and part of a building may project into the front yard in the commercial districts only.

(d)

Allowable projections of accessory buildings into yards. One-story accessory buildings may project into yards, provided that:

(1)

The building does not occupy more than 30 percent of the rear yard.

(2)

When more than ten feet from the building and 60 feet from the front yard, it may project into the side or rear yards, provided that it projects no closer than six feet to the side or rear lot lines.

(3)

Garage accessory buildings entered from alleys or streets, in the case of double frontage lots, are not closer than ten feet to the street or alley line.
