Provisions
This title shall be known as the zoning code for the town of Yarrow Point. (Ord. 769 § 2 (Att. A), 2025; Ord. 549 § 1, 2005)
In their interpretation and application, the provisions of this title shall be held to be the minimum requirements which are adopted for the promotion of the public health, safety, and welfare. This code is to be interpreted as a whole, in view of the purpose set out in this chapter. If the general purpose of this development code conflicts with the specific purpose of any chapter of this development code, the specific purpose shall control. (Ord. 769 § 2 (Att. The purpose of this title is to regulate the use of land; to limit land use density to be compatible with the street, local park, and infrastructure capabilities; to regulate the size and placement of buildings, structures, and vegetation so as to assure some preservation of views, light, air, and open space; and preserve the character of the neighborhood. The location, size, shape, area and boundaries of the zones to which the provisions of the text of this title are applicable shall be as indicated on the map which is entitled “Official Zoning Map of the Town of Yarrow Point,” and such map, as adopted by the town council, shall be a part of this title, copy on file with the town clerk/treasurer. The position of planner is hereby created to administer the provisions of this and any YPMC provisions related to zoning and land use. The planner shall be appointed by the mayor and serve at the mayor’s discretion. (Ord. 769 § 2 (Att. A), 2025; Ord. 549 § 1, 2005)
If any section, paragraph, subsection, clause or phrase of this code is for any reason held to be unconstitutional or invalid, such decision shall not affect the validity of the remaining portion of this code. The town council hereby declares that they would have passed this code and each section, paragraph, subsection, clause or phrase thereof irrespective of the fact that any one or more sections, paragraphs, clauses, or phrases were unconstitutional or invalid.
