Yorba Linda City Zoning Code

The City Council of the City of Yorba Linda adopted the General Plan on November 1, 2016. The Plan consists of a map and text to define intensities and densities of use as well as standards applicable to certain uses.

Adoption and amendment of the General Plan is a legislative act.

With the exception of those amendments necessary to meet housing goals, no mandatory element of the General Plan may be amended more than four times in any one calendar year. Amendments to the General Plan may be textual or changes to the map. Textual and mapping changes may be of three types:

Persons, agencies, special districts or governmental entities seeking to amend the General Plan must file an application with the Community Development Department. The application shall be submitted on forms and in substantial compliance with administrative procedures provided by the Community Development Department. A fee as prescribed by City Council resolution, shall accompany the application. The City may amend the General Plan on its own initiative without payment of a fee.

The City Council shall approve all major and minor General Plan amendments by resolution. All major and minor General Plan amendments shall be referred to the Planning Commission prior to action by the City Council. The Planning Commission shall take action by resolution making a recommendation to the City Council.

Major and minor amendments shall be considered and may be approved, denied, or modified by the City Council after a noticed public hearing. All major and minor amendments shall also require a noticed public hearing before the Planning Commission prior to being considered by the City Council. The Planning Commission shall make a written recommendation to the City Council that the matter be approved, denied or modified. The recommendation of the Planning Commission shall be by a majority of the entire membership of the Planning Commission. Notice of the public hearing shall be given pursuant to California Government Code Sections 65090 and 65091. Technical amendments, such as typographical errors or other non-substantive corrections or additions, shall be approved, denied, or modified by the Community Development Director without benefit of a public hearing but shall be subject to appeal procedures as set forth in Chapter 18.36 of this title.
