CHAPTER 4

- DISTRICT REGULATIONS

§ 4-100.- District Use Classifications.

General Regulations in Chapter 3, District Regulations in Chapter 4, and Supplemental Regulations in Chapter 5 are applicable to all of the following classes of uses:

(a)

Permitted uses. Permitted uses listed in the district use tables in this Division are permitted outright.

(b)

Conditional uses. Conditional uses in the district use tables are permitted by the Zoning Administrator without further review upon compliance with conditions specified in the tables.

(c)

Special exceptions. Special exceptions are permitted after review and approval by the Board of Zoning Appeals upon compliance with general conditions in the regulations.

§ 4-101. - R-10 Single Family Residential District Uses.

 (4) private kennel for not more than three (3) dogs or three (3) cats, four (4) months of age or older, with minimum 6 foot fence for exterior kennel;
 (5) private swimming pool, including deck, bath house or cabana; boat dock;
 (6) disaster shelter;
 (7) private garden; greenhouse or slathouse up to eight (8) feet high;
 (8) private tennis, outdoor recreation and picnic facilities

 

R-10 CONDITIONAL USES
(approved by Zoning Administrator
if all conditions are met)

 (2) no office, commercial operation, or storage of vehicles or equipment is permitted;
 (3) a landscaped strip at least five (5) feet wide is planted & maintained along exterior lot lines.
49 Electric, gas, water, sanitary services One (1) space.
c. Cemetery, provided all following conditions are met:
 (1) minimum five (5) acre lot;
 (2) no crematorium or dwelling except caretaker;
 (3) front yard setback greater of seventy (70) feet from center of street or ten (10) feet from street right-of-way line;
 (4) non-illuminated sign not over thirty (30) square feet in area or ten (10) feet in height.
6553 Cemetery None.
d. Temporary contractor office & equipment shed, provided all following conditions are met:
 (1) used in connection with construction on premises;
 (2) must not cause traffic congestion or nuisance;
 (3) for term up to one (1) year; may be renewed once.
1521 General contractors, single family houses One (1) for each 300 square feet of office. area.
e. Customary home occupation in single family dwelling, provided all following conditions are met:
 (1) conducted inside dwelling by resident family members;
 (2) utilizes not more than 25% of total dwelling floor area;
 (3) no change in exterior appearance of dwelling;
 (4) no outside display of products;
 (5) no sale of products except those made on premises or consumables incidental to a service;
 (6) creates no health or safety hazard, noise, offensive emission, traffic hazard, unsightly condition or nuisance;
 (7) activity is not visibly evident outside dwelling, except for a wall-mounted sign not over four (4) square feet in area.

R-10 SPECIAL EXCEPTIONS

c. Clustered single family development, provided the Board of Zoning Appeals determines:
 (1) detached single family units on minimum of 2 acres;
 (2) not exceed density per entire tract; may exceed density per acre;
 (3) lot requirements per house may be waived;
 (4) Subdivision Regulations are met;
 (5) adequate provisions for access and traffic safety;
 (6) the use is compatible with the district.
88 Private households Two (2) for each dwelling unit.
d. Conversion of existing dwelling to multi-family, provided the Board of Zoning Appeals determines:
 (1) large dwelling (over 3,000 square feet in total area) existed prior to 1970, has little economic value or usefulness as single family dwelling or other conforming use;
 (2) minimum 20,000 square foot lot;
 (3) no enlargement or exterior change to building permitted;
 (4) not more than 4 dwelling units are permitted;
 (5) the use is compatible with the district.
N/A Two (2) for each dwelling unit in rear yard.
e. Conversion of existing dwelling to bed and breakfast inn, provided the Board of Zoning Appeals determines:
 (1) all conditions for home occupation are met as required in subsection e. of R-10 Conditional Uses;
 (2) no common or shared driveways are permitted;
 (3) adequate off-street parking is provided in approved areas;
 (4) maximum of five (5) guest rooms;
 (5) guest rooms restricted to guest stay not exceeding 30 days;
 (6) the use is compatible with the district.
7011 Bed and breakfast inn Location set by Board; minimum: one (1) for each guest room plus two (2) for resident innkeeper.

 

§ 4-102. - R-10 Single Family Residential District Regulations.

The following regulations apply to all uses in R-10 districts:

Minimum lot area: Ten thousand (10,000) square feet.
Minimum land area per dwelling unit: Ten thousand (10,000) square feet.
Maximum dwelling units per net acre: Four (4) dwelling units.
Minimum lot width at front building line: Eighty (80) feet.
Minimum lot depth: One hundred (100) feet.
Minimum front yard depth: Twenty-five (25) feet, or average of existing setbacks from same street in same block in district, but not less than fifteen (15) feet.
Minimum setback from second street frontage: Side street on corner lot: twenty-five (25) feet;
Rear street on double frontage lot: twenty-five (25) feet.
Minimum side yard: Principal structure: fifteen (15) feet from interior side lot line;
Accessory structure: five (5) feet from interior side lot line; three (3) feet from rear lot line;
Open carport: seven (7) feet from side lot line.
Minimum rear yard: Principal structure: twenty (20) feet from interior rear lot line.
Accessory structure: three (3) feet from interior rear lot line.
Maximum structure height: Thirty-five (35) feet to the roof line (not applicable to church spires, belfries, cupolas, domes, chimneys, flag poles, antennae).
Visibility requirements: Corner lot: no obstruction between heights of 3 and 10 feet above finished street level within 25 feet of intersection of street right-of-way lines.
Private drive: no obstruction over height of 30 inches within 10 feet of street.
Off-street parking area requirements: See supplemental regulations, Chapter 5.
Signs: See supplemental regulations, Chapter 5.
Supplemental regulations: See Chapter 5.
Landscaping: Landscaping is encouraged in residential districts. At a minimum, all residential uses should have shrubbery and ground covering grass within the front yard or street side of the residence. This shrubbery and grass should be maintained according to city ordinance standards.

 

§ 4-103. - R-8 Single Family Residential District Uses.

§ 4-104. - R-8 Single Family Residential District Regulations.

The following regulations apply to all uses in R-8 districts:

Minimum residential lot area: Eight thousand (8,000) square feet.
Minimum lot area pre dwelling unit: Eight thousand (8,000) square feet.
Maximum units per net acre: Five (5) dwelling units.
Minimum lot width at building line: Sixty (60) feet.
Minimum front yard depth: Twenty-five (25) feet, or average of existing setbacks from same street in same block in district, but not less than 15 feet.
Minimum setback from second street frontage: Side street on corner lot - 15 feet.
Rear street on double frontage lot - 25 feet.
Minimum side yard: Principal structure - 10 feet from interior side lot line, except zero lot line units.
Accessory structure - 5 feet from interior side lot line.
Minimum rear yard: Principal structure - 15 feet from interior rear lot line.
Accessory structure - 3 feet from interior rear lot line.
Maximum structure height: Forty (40) feet to the roof line (not applicable to church spires, belfries, cupolas, domes, chimneys, flag poles, antennae).
Visibility requirements: Corner lot: no obstruction between heights of 3 and 10 feet above finished street level within 25 feet of intersection of street right-of-way lines.
Private drive: no obstruction over 30 inches high within 10 feet of street.

a. All special exceptions permitted in R-8 districts.

 

§ 4-106. - R-6 One and Two Family Residential District Regulations.

The following regulations apply to all uses in R-6 districts:

Minimum lot area: Six thousand (6,000) square feet.
Minimum land area per unit: Single family - 6,000 square feet;
Duplex - 9,000 square feet.
Maximum dwelling units per net acre: Seven (7) dwelling units.
Minimum lot width at building line: Fifty (50) feet.
Minimum front yard depth: Fifteen (15) feet from street right-of-way line.
Minimum setback from second street frontage: Side street on corner lot: fifteen (15) feet.
Rear street on double frontage lot: fifteen (15) feet.
Minimum side yard: Principal structure: five (5) feet from interior side lot line; provided, total of both side yards must be at least 30% of lot width.
Accessory structure: five (5) feet from interior side lot line.
Minimum rear yard: Principal structure: fifteen (15) feet from interior rear lot line.
Accessory structure: three (3) feet from interior rear lot line.
Maximum structure height: Forty (40) feet to roof line (not applicable to church spires, belfries, cupolas, domes, chimneys, flag poles, antennae).
Visibility requirements: Corner lot: no obstruction between heights of three (3) and ten (10) feet above finished street level within twenty-five (25) feet of intersection of street right-of-way lines.
Private drive: no obstruction over height of thirty (30) inches within ten (10) feet of street.
Off-street parking area requirements: See supplemental regulations, Chapter 5.
Signs: See supplemental regulations, Chapter 5.
Supplemental regulations: See Chapter 5.
Landscaping: (1) One (1) large maturing tree per duplex housing unit shall be planted within the required front setback. The trees shall be a minimum of three (3) inches in caliper at planting.
(2) Two (2) shrubs per duplex housing unit shall be planted within the required front setback.
(3) Landscaping is encouraged in residential districts. At a minimum, all residential uses should have shrubbery and ground covering grass within the front yard or street side of the residence. This shrubbery and grass should be maintained according to city ordinance standards.

 

§ 4-106.1. - R-2 Residential District Uses.

§ 4-106.2. - R-2 Residential District Regulations.

The following regulations apply to all uses in R-2 districts:

Minimum lot area: Six thousand (6,000) square feet for first unit, plus minimum area for additional units required in the following table of minimum land area and maximum units per net acre
Minimum land area per single family dwelling unit: Six thousand (6,000) square feet

  (2) Exterior siding: Wood, hardboard, vinyl, brick, or aluminum and shall be comparable in composition, appearance, and durability to the exterior siding commonly used in standard residential construction.
  (3) Roofing Material: Type of shingle or roofing material that is commonly used in standard residential construction.
  (4) Minimum Roof Pitch: 4' × 12' roof pitch, or the standard of each manufacturer's equivalent to a 4' × 12' roof pitch.
  (5) Skirting: Continuous permanent brick foundation or curtain wall, continuous except for ventilation and access, shall be installed upon a poured concrete footing after placement on the lot, and before occupancy.
  (6) The tongue, axles, transporting lights, and removable towing apparatus must be removed after placement on the lot and before occupancy.
  (7) Stairs, porches, entrance platforms, ramps and other means of entrance and exit to and from the home shall be installed or constructed in a manner commonly used in standard residential construction and attached firmly to the primary structure and anchored securely to the ground. Porches at least 3 feet by 3 feet shall be constructed at both the front and back entrances with appropriate handrail.
  (8) Suitable tie-down or anchoring devices shall be installed.
  (9) Follow appropriate City building codes and standards.
  (10) Have separate water and wastewater taps and may not share water and wastewater taps with any other dwelling or structure.
Non-conforming Manufactured Homes: Such homes vacated or abandoned for a period of six (6) months or more or non-conforming manufactured homes damaged by fifty (50%) percent or more shall be ordered to be removed from the property. Removal shall be completed within six (6) months of the date of the removal order.

This requirement may be waived by the zoning administrator where the use and situation requires parking to be placed to the front of the building, provided that this shall not adversely affect the residential nature of the neighborhood.

 A. Requirements for Parking Area Borders Parallel to Adjacent Property Lines
 1. Buffer strip shall be at least ten feet (10') in width.
 2. A garden wall, opaque fence, or hedge (min. six (6') feet in height) shall be installed along any adjacent property line.
 3. One (1) tree shall be planted for each fifty linear feet (50') of the landscaping area and one (1) small maturing tree or shrub of at least three feet (3') in height shall be planted every ten linear feet (10') within the landscape.
 All portions of the landscaping area not planted with shrubs and trees shall be planted in grass and/or with some other vegetative ground cover; and
 Parked vehicles may overhang a landscaped area no more than one foot (1'), provided curbing or other wheel stops are installed to insure no greater overhang or penetration of the landscaped islands. Landscaping, walls, fences, and earthberms shall be located as to prevent their damage and/or destruction by overhanging vehicles.
 Requirements For Boundaries Adjacent To Any Residential Zoning District and Existing Residential Uses in this District
 1. Required Buffer Area:
  a) Minimum Width: 20 feet.
 2. Required Buffering Materials:
  a) Buffering materials shall provide an opaque buffer to create a strong impression of a spatial separation and to preclude visual contact.
  b) 7 trees for every 100 linear feet.
  c) 50 shrubs per 100 linear feet.
  d) All portions of the landscaping area not planted with shrubs and trees or covered by a wall or fence barrier shall be planted in grass and/or with some other vegetative ground cover.
 3. Alternative 1: Buffering Requirements reduced by 25% (5 feet):
  a) Minimum width may be reduced by 25% or five (5) feet with use of a landscaped earth berm.
  b) Berms shall be constructed within the property boundary meeting the following requirements:
   (1) Minimum Height: 2 ft.
   (2) Minimum Crown Width: 2 ft.
   (3) Minimum Slope: 2:1
 4. Alternative 2: Buffering Requirements reduced by 50% (10 feet):
  a) Minimum width may be reduced by 50% or ten (10) feet and required number of shrubs reduced to 30 shrubs per 100 linear feet with use of landscaped wall or fence.
  b) Wall shall be solid and meet the standards for walls and fences set forth in Section 3.2.
  c) Maximum wall height: 6 ft.
  d) Shrubs shall reach ⅓ of the height of the wall within 3 years.
 5. Alternative 3: Buffering Requirements reduced by 60% (12 feet):
  a) Minimum width may be reduced by 50% or twelve (12) feet and required number of shrubs reduced to 30 shrubs per 100 linear feet with use of landscaped wall or fence, and a planted earth berm.
  b) Berms shall be constructed within the property boundaries meeting the following requirements:
   (1) Minimum Height: 2 ft.
   (2) Minimum Crown Width: 2 ft.
   (3) Minimum Slope: 2:1
  c) Wall shall be solid and meet the standards for walls and fences set forth in this ordinance.
  d) Maximum wall height: 6 ft.
  e) Shrubs shall reach ⅓ of the height of the wall within 3 years.
 B. Street Trees
 1. Where appropriate, street trees shall be planted along all public streets with permission of the appropriate jurisdiction. Street trees shall be large maturing canopy species specified by the City of Abbeville and approved by the planning commission.
 2. Maximum of one (1) street tree every thirty (30') feet on center.
Tree size: min. of three (3") inches in caliper.
Signs: A. Materials employed for construction of sign shall be durable and weather resistant, and all signs shall be maintained in good repair.
B. Sign Area: Shall be measured by height (A) by length (B) of the smallest rectangle that can be drawn to measure all sign elements. Unless otherwise noted, only one side or face of the same sign shall be used in computing sign area.
C. Allowed Signs: The applicant may select one (1) of the following five (5) choices for a sign type per street frontage:
 1. Wall Sign
  a) Maximum Size: 25 square feet or 15% of the front wall area, whichever is greater.
 2. Window Sign
  a) Maximum Size: 30% of the window area.
 3. Projecting Sign
  a) Maximum Size: 6 square feet for one side.
  b) Clearance: 8' above ground level.
 4. Awning Sign
  a) Maximum Size: Individual letters shall not exceed 10" in height.
  b) Signs, symbols, or designs may be painted or sewn on to any awning.
 5. Ground Sign

§ 4-112. - OC Office Commercial District Regulations.

The following regulations apply to all uses in OC districts.

Minimum lot area: Commercial uses: none;
Residential uses: single family - six thousand (6,000) square feet;
duplex - nine thousand (9,000) square feet.
Minimum lot width at building line: Commercial uses: none;
Residential uses: fifty (50) feet.
Maximum dwelling units: Seven (7) dwelling units per acre.
Minimum front yard depth: Twenty-five (25) feet from street right-of-way line
Minimum setback from second street.
Frontage: Side street on corner lot: twelve & one-half (12½) feet;
Rear street on double frontage lot: twenty-five (25) feet.
Minimum side yard: Principal structure: eight (8) feet from interior side lot line;
Accessory structure: five (5) feet from interior side lot line.
Minimum rear yard: Principal structure: eight (8) feet from interior rear lot line.
Accessory structure: three (3) feet from interior rear lot line.
Maximum structure height: Forty (40) feet when permitted by fire regulations (not applicable to church spires, belfries, cupolas, domes, chimneys, flag poles, antennae).
Visibility requirements: Corner lot: no obstruction between heights of three (3) and ten (10) feet above finished street level within twenty-five (25) feet of intersection of street right-of-way lines.
Private drive: no obstruction over height of thirty (30) inches within ten (10) feet of street.
Off-street parking area requirements: See parking, supplemental regulations, Chapter 5.
Parking for non-residential uses shall be located to the side and rear of the building. This requirement may be waived by the zoning administrator where the use and situation requires parking to be placed to the front of the building, provided that this shall not adversely affect the character of the area.
Landscaping: See landscaping, supplemental regulations, Chapter 5.
[A.] Requirements for Parking Area Borders Parallel to Adjacent Property Lines
 [1.] Buffer strip shall be at least ten feet (10') in width.
 [2.] A garden wall, opaque fence, or hedge (min. six (6') feet in height) shall be installed along any adjacent property line.
 [3.] One (1) tree shall be planted for each fifty linear feet (50') of the landscaping area and one (1) small maturing tree or shrub of at least three feet (3') in height shall be planted every ten linear feet (10') within the landscape.
 All portions of the landscaping area not planted with shrubs and trees shall be planted in grass and/or with some other vegetative ground cover; and
 Parked vehicles may overhang a landscaped area no more than one foot (1'), provided curbing or other wheel stops are installed to insure no greater overhang or penetration of the landscaped islands. Landscaping, walls, fences, and earthberms shall be located as to prevent their damage and/or destruction by overhanging vehicles.
[B.] Requirements For Boundaries Adjacent To Any Residential Zoning District and Existing Residential Uses in this District
 1. Required Buffer Area:
  a) Minimum Width: 20 feet.
 2. Required Buffering Materials:
  a) Buffering materials shall provide an opaque buffer to create a strong impression of a spatial separation and to preclude visual contact.
  b) 7 trees for every 100 linear feet.
  c) 50 shrubs per 100 linear feet.
  d) All portions of the landscaping area not planted with shrubs and trees or covered by a wall or fence barrier shall be planted in grass and/or with some other vegetative ground cover.
 3. Alternative 1: Buffering Requirements reduced by 25% (5 feet):
  a) Minimum width may be reduced by 25% or five (5) feet with use of a landscaped earth berm.
  b) Berms shall be constructed within the property boundary meeting the following requirements:
   (1) Minimum Height: 2 ft.
   (2) Minimum Crown Width: 2 ft.
   (3) Minimum Slope: 2:1

§ 4-116. - GC General Commercial District Regulations.

The following regulations apply to all uses in GC districts:

Minimum lot area: None.
Minimum lot width at building line: Fifty (50) feet.
Minimum front yard depth: Thirty-five (35) feet from street right-of-way line.
Minimum setback from second street frontage: Side street on corner lot: twelve & one-half (12½) feet; Rear street on double frontage lot: twenty-five (25) feet.
Minimum side yard: Principal structure: twenty (20) feet from interior side lot line; Accessory structure: five (5) feet from interior side lot line.
Minimum rear yard: Principal structure: twenty-five (25) feet from interior rear lot line. Accessory structure: five (5) feet from interior rear lot line.
Maximum structure height: Forty (40) feet when permitted by fire regulations (not applicable to church spires, belfries, cupolas, domes, chimneys, flag poles, antennae).
Visibility requirements: Corner lot: no obstruction between heights of three (3) and ten (10) feet above finished street level within twenty-five (25) feet of intersection of street right-of-way lines. Private drive: no obstruction over height of thirty (30) inches within ten (10) feet of street
Off-street parking area and loading area requirements: See parking, supplemental regulations, Chapter 5.
 A. Except for single family residential, parking shall be located to the rear of the building.
 B. Parking areas on adjacent lots should be connected.
Landscaping: See landscaping, supplemental regulations, Chapter 5.
Planting screen, fence or wall at least six (6) feet high is required along all interior lot lines abutting a residential district and a buffer yard at least five feet wide.
[A.] Requirements for Parking Area Borders Parallel to Adjacent Property Lines
 [1.] Buffer strip shall be at least ten feet (10') in width.
 [2.] A garden wall, opaque fence, or hedge (min. four (4') feet in height) shall be installed along any adjacent property line.
 [3.] One (1) small maturing tree is required every ten (10) linear feet.
[B.] Street Trees
 [1.] Where appropriate, street trees shall be planted along all public streets with permission of the appropriate jurisdiction. Street trees shall be large maturing canopy species specified by the City of Abbeville and approved by the planning commission.
 [2.] Maximum of one (1) street tree every thirty (30') feet on center.
Tree size: min. of three (3") inches in caliper.
[C.] Requirements For Boundaries Adjacent To Any Residential Zoning District and Existing Residential Uses in this District
 1. Required Buffer Area:
  a) Minimum Width: 20 feet.
 2. Required Buffering Materials:
  a) Buffering materials shall provide an opaque buffer to create a strong impression of a spatial separation and to preclude visual contact.
  b) 7 trees for every 100 linear feet.
  c) 50 shrubs per 100 linear feet.
  d) All portions of the landscaping area not planted with shrubs and trees or covered by a wall or fence barrier shall be planted in grass and/or with some other vegetative ground cover.
 3. Alternative 1: Buffering Requirements reduced by 25% (5 feet):
  a) Minimum width may be reduced by 25% or five (5) feet with use of a landscaped earth berm.
  b) Berms shall be constructed within the property boundary meeting the following requirements:
   (1) Minimum Height: 2 ft.
   (2) Minimum Crown Width: 2 ft.
   (3) Minimum Slope: 2:1
 4. Alternative 2: Buffering Requirements reduced by 50% (10 feet):
  a) Minimum width may be reduced by 50% or ten (10) feet and required number of shrubs reduced to 30 shrubs per 100 linear feet with use of landscaped wall or fence.
  b) Wall shall be solid and meet the standards for walls and fences set forth in this ordinance.
  c) Maximum wall height: 6 ft.
  d) Shrubs shall reach ⅓ of the height of the wall within 3 years.
 5. Alternative 3: Buffering Requirements reduced by 60% (12 feet):
  a) Minimum width may be reduced by 50% or twelve (12) feet and required number of shrubs reduced to 30 shrubs per 100 linear feet with use of landscaped wall or fence, and a planted earth berm.
  b) Berms shall be constructed within the property boundaries meeting the following requirements:
   (1) Minimum Height: 2 ft.
   (2) Minimum Crown Width: 2 ft.
   (3) Minimum Slope: 2:1
  c) Wall shall be solid and meet the standards for walls and fences set forth in this ordinance.
  d) Maximum wall height: 6 ft.
  e) Shrubs shall reach ⅓ of the height of the wall within 3 years.
Shopping centers: Two (2) or more stores or businesses located on the same parcel of land constitute a shopping center. Site plan approval required.
Signs: A. Materials employed for construction of sign shall be durable and weather resistant, and all signs shall be maintained in good repair.
B. Sign Area: Shall be measured by height (A) by length (B) of the smallest rectangle that can be drawn to measure all sign elements. Unless otherwise noted, only one side or face of the same sign shall be used in computing sign area.
C. Allowed Signs: The applicant may select one (1) of the following five (5) choices for a sign type per street frontage:
 1. Wall Sign
  a) Maximum Size: 25 square feet or 15% of the front wall area, whichever is greater.
 2. Window Sign
  a) Maximum Size: 30% of the window area.
 3. Projecting Sign
  a) Maximum Size: 6 square feet for one side.
  b) Clearance: 8' above ground level.
 4. Awning Sign
  a) Maximum Size: Individual letters shall not exceed 10" in height.
  b) Signs, symbols, or designs may be painted or sewn on to any awning.
 5. Ground Sign
  a) Maximum Size: 25 square feet per sign face.
  b) Maximum Height: 5 feet from finished grade.
D. Secondary Signs: The following signs shall be permitted in conjunction with the Allowed Sign.
 1. Window or projecting sign no larger than 12" × 18" bearing business identification in addition to a wall or awning sign.
 2. One sign per business occupying the upper floors of a building no larger than 12" × 18".
E. Prohibited Signs: Refer to the definitions in this ordinance for description of these types of signs.
 1. Digital or moving image signs of any type other than barber poles.

B. Street Trees
 1. Street tree requirements apply only to lot frontage on SC Highways 72, 20 and 28.
 2. One (1) large maturing tree every 30'. (Pick one or two species for consistency.)
 3. Required trees shall be planted a minimum distance of five feet (5') and a maximum distance of ten feet (10') from the right-of-way or property boundary within the required front setback.
 4. Tree size at planting: 3 inches in caliper minimum
C. Requirements for Parking Areas
 1. Peripheral
  a) Required Landscaping Area: at least 10' in depth shall be located between the abutting property lines and the parking, loading, or other vehicular use area, except where permitted driveway openings are to be provided.
  b) Required Landscaping Materials: Choose One:
   (1) One (1) large maturing tree shall be planted for each fifty linear feet (50') of the landscaping area and one (1) small maturing tree or shrub of at least three feet (3') in height shall be planted every ten linear feet (10') within the landscape; or
   (2) A combination of trees, hedge, other durable landscape material or approved wall, fence or earthberm may be utilized to form the continuous landscape element of at least three feet (3') in height.
  c) Other Requirements:
   (1) All portions of the landscaping area not planted with shrubs and trees or covered by a wall or fence barrier shall be planted in grass and/or with some other vegetative ground cover; and
   (2) Parked vehicles may overhang a landscaped area no more than two and one-half feet (2½'), provided curbing or other wheel stops are installed to insure no greater overhang or penetration of the landscaped islands. Landscaping, walls, fences, and earthberms shall be located as to prevent their damage and/or destruction by overhanging vehicles.
 2. Interior
  a) Required Landscaping Area: Five percent (5%) of the interior of any parking, loading, or other vehicular use area shall be landscaped. The location of such landscaping is at the option of the owner or developer; provided, however, the following standards shall apply;
(1) Landscape Island: shall be at least nine feet (9') in width and eighteen feet (18') in length. Each island shall contain one large maturing tree plus shrubs and/or vegetative ground cover to cover the entire area.
(a) No more than ten (10) parking spaces shall be permitted in a continuous row without being interrupted by a landscaped island.
(b) Each parking row shall terminate in a landscape island.
(2) Median Strip: shall be at least ten feet (10') in width.
(a) Every fourth row of parking shall be separated by a median strip for landscaping and pedestrian purposes.
(b) Every median strip shall contain plantings of one large maturing tree at intervals of 30 to 40 feet, plus shrubs and/or vegetative ground cover to cover the entire area.
  b) Other Requirements:
   (1) All portions of the landscaping area not planted with trees shall be planted in grass and/or with some other vegetative ground cover; and
   (2) Parked vehicles may overhang a landscaped area no more than two and one-half feet (2½'), provided curbing or other wheel stops and installed to insure no greater overhang or penetration of the landscaped islands. Landscaping, walls, fences, and earthberms shall be located as to prevent their damage and/or destruction by overhanging vehicles.

Signs: A. Intent. The purpose of these sign regulations are: to encourage the effective use of signs as a means of communication; to maintain and enhance the aesthetic environment; and to increase the City's ability to attract sources of economic development and growth; to improve pedestrian and traffic safety; to minimize the possible adverse effect of signs on nearby public and private property; and to enable the fair and consistent enforcement of these sign regulations.
B. Refer to another section for general sign requirements.
C. No sign, or part thereof, may be altered, constructed, changed, converted, enlarged, or moved unless in conformity with the following requirements.
D. Sign Area: Shall be measures by height (A) by length (B) of the smallest rectangle that can be drawn to measure all sign elements. Unless otherwise noted, only one side or face of the same sign shall be used in computing sign area.
E. Allowed Signs: The applicant may select two (2) of the following six (6) choices for a sign type per street frontage:
 1. Wall Sign
  a) Maximum Size: 1 square foot per lineal foot of the building wall on which the sign is to be placed.
 2. Window Sign
  a) Maximum Size: 20% of the window area
 3. Projecting Sign
  a) Maximum Size: 16 square feet for one side
  b) Maximum Height: No projecting sign shall extend above the roof line.
  c) Clearance: 8' above ground level
 4. Awning Sign
  a) Maximum Size: 15% of exterior surface of the awning.
  b) Signs, symbols, or designs may be painted or sewn onto the awning.
 5. Ground Sign
  a) Maximum Size: 35 square feet.
  b) Maximum Height: 10 feet.
  c) Setback: No freestanding sign shall be closer than five (5) feet to an exterior property line.
  d) No more than one (1) ground sign shall be allowed per parcel.
 6. Directory Sign
  a) The parcel shall contain no more than one (1) directory sign.
  b) The maximum sign area shall not exceed three (3) inches by fifteen (15) inches for each identified activity, business, firm, or tenant.
  c) The directory sign may take the form of any sign permitted in the zoning district provided that such sign shall comply with its applicable specification. If the directory sign is a freestanding sign, no other freestanding shall be located on the parcel.
F. Prohibited Signs:
 1. Digital image or moving picture signs of any type.
 2. Signs projecting above the roof line.
 3. Any sign not listed as being allowed is prohibited.
G. Criteria for Bonus Sign Area. To encourage design excellence, the maximum sign areas for the Highway Commercial district may be increased by the percentages as provided herein. A separate bonus is granted for compliance with each of the criteria and the area is cumulative, but the percentage increase is based on the original sign area limitation.
 1. Wall sign which consists of individual letters or words mounted directly on the building surface: 15% increase permitted
 2. Coordinated signs in shopping centers or any three consecutive separate establishments, all the lettering and background is uniform in style and color: 10% increase permitted
 3. Gas stations that incorporate the price information into the main identification sign face: 10% increase permitted
 4. Sign is not internally illuminated (other than non-flashing neon): 15% increase permitted
 5. Ground sign is installed in a landscaped planter having an area four (4) times the area of the resultant sign for one sign face: 20% increase permitted

Sexually Oriented Businesses (See also Article VI)
 a) Findings of Fact:
  (1) Although there are no known sexually oriented businesses currently operating in Abbeville, it is possible, and probable, that at some point one or more would desire to locate in Abbeville and it is in the interests of the health, safety, and welfare of the patrons of such businesses, as well as the citizens of Abbeville, to provide certain minimum standards and regulations for sexually oriented businesses, as well as the operators and employees of such businesses.
  (2) Sexually oriented businesses generate secondary effects which are detrimental to the public health, safety, and welfare. Additionally, sexually oriented businesses are frequently used for unlawful sexual activities, including public sexual indecency, prostitution, and sexual encounters of a casual nature. Such businesses are of particular concern to the community when they are located in close proximity to each other, or close to schools, churches or parks and playgrounds.
  (3) The concern over sexually transmitted diseases is a legitimate health concern of Abbeville which demands reasonable regulation of these businesses in order to protect the health and well-being of our citizens.
  (4) The location of sexually oriented businesses close to residential areas diminishes property values and leads to conditions that give rise to crime in residential neighborhoods. Many studies performed in other communities indicate conclusively that property crimes and sexual crimes increase significantly in neighborhoods in which such a business is located.
  (5) It is not the intent of this section to suppress any speech activities protected by the First Amendment or to place any impermissible burden on any constitutionally protected expression or expressive conduct by the enactment or enforcement of the Ordinance. Rather, it is the intent of Abbeville City Council to enact a content neutral regulation which addresses the secondary effects of sexually oriented businesses.
  (6) All state laws regulating this type of business apply.
  (7) No such business shall locate within 1,000 linear feet, measured from the edge of the property line, of any residence, church, day care center, or other Sexually Oriented Business.
 b) Signage:
  (1) Freestanding signs are prohibited except for one freestanding sign showing the word "Entrance" to the parking lot, and one freestanding sign showing the word "Exit" from the parking lot. Each sign can be no larger than 12" × 18" and shall have no other word or decoration than the specific words described here.
  (2) Business shall not display a sign or advertising visible from public streets or sidewalks, or outside the premises that is photographic, pictorial, or illustrative.
 c) Required Buffers Between Residential Areas or Residentially Zoned Areas and Business:
  (1) Required Buffer Area:
   (a) Minimum Width: 20 feet.
  (2) Required Buffering Materials:
   (a) Buffering materials shall provide an opaque buffer to create a strong impression of a spatial separation and to preclude visual contact.
    (i) 7 trees for every 100 linear feet.
    (ii) 50 shrubs per 100 linear feet.
    (iii) All portions of the landscaping area not planted with shrubs and trees or covered by a wall or fence barrier shall be planted in grass and/or with some other vegetative ground cover.
  (3) Berms shall be constructed within the property boundaries meeting the following requirements:
   (a) Minimum Height: 2 ft.
   (b) Minimum Crown Width: 2 ft.
   (c) Minimum Slope: 2:1
  (4) Solid walls shall be constructed and meet the standards for walls and fences set forth in Section 3.2
   (a) Maximum wall height: 6 ft.
   (b) Shrubs shall reach ⅓ of the height of the wall within 3 years.
  (5) No free access shall be permitted between adjacent residential area and the parcel.
Tattoo Parlor or Body Piercing Parlor: All requirements and regulations applying to Sexually Oriented Business also apply to the location of state-licensed tattoo parlors and body piercing parlors.

§ 4-120. - LI Limited Industrial District Regulations.

The following regulations apply to all uses in LI districts:

Minimum lot area: One-half (½) acre.
Minimum lot width at building line: One hundred (100) feet.
Minimum front yard depth: Thirty (30) feet from street right-of-way line, or one fourth (¼) of lot width, but not less than fifteen (15) feet.
Minimum setback from second street frontage: Side street on corner lot: Thirty (30) feet;
Rear street on double frontage lot: Thirty (30) feet.
Minimum side yard: Thirty (30) feet from interior side lot line in, or one tenth ( 1/10 ) of lot width, but not less than ten (10) feet.
Minimum rear yard: Thirty (30) feet from interior rear lot line, or one tenth ( 1/10 ) of lot depth, but not less than ten (10) feet.
Maximum structure height: Sixty (60) feet when permitted by fire regulations (not applicable to church spires, belfries, cupolas, domes, utility and communication towers, chimneys, flag poles, antennae).
Visibility requirements: Corner lot: no obstruction between heights of three (3) and ten (10) feet above finished street level within fourteen (14) feet of intersection of street right-of-way lines.
Private drive: no obstruction over height of thirty (30) inches within ten (10) feet of street.
Off-street parking area and loading area requirements: See parking, supplemental regulations, Chapter 5.
Truck terminal: paved acceleration and deceleration lanes at lest ten (10) feet wide and one hundred (100) feet long are required at entrance and exit of terminal site which must have access to and from a major street.
Landscaping: See landscaping, supplemental regulations, Chapter 5.
[A.]1. Additions, expansions, or changes which increase a business by 40% of the gross floor area shall be in compliance with the landscaping requirements.
 2. If more than one landscaping/buffering requirement overlaps, the more stringent regulation shall be applied.
 3. See landscaping requirements in Chapter 5.
B. Street Trees
 1. Street tree requirements apply only to lot frontage on SC Highways 72, 28, and 20.
 2. One (1) large maturing tree every 30'. (Pick one o two species for consistency.)
 3. Required trees shall be planted a minimum distance of five feet (5') and a maximum distance of ten feet (10') from the right-of-way or property boundary within the required front setback.
 4. Tree size at planting: 3 inches in caliper minimum
C. Requirements for Parking Areas
 1. Peripheral
  a) Required Landscaping Area: at least 5' in depth shall be located between the abutting property lines and the parking, loading, or other vehicular use area, except where permitted driveway openings are to be provided.
  b) Required Landscaping Materials: Choose One:
   (1) One (1) large maturing tree shall be planted for each fifty linear feet (50') of the landscaping area and one (1) small maturing tree or shrub of at least three feet (3') in height shall be planted every ten linear feet (10') within the landscape; or
   (2) A combination of trees, hedge, other durable landscape material or approved wall, fence or earthberm may be utilized to form the continuous landscape element of at least three feet (3') in height.
  c) Other Requirements:
   (1) All portions of the landscaping area not planted with shrubs and trees or covered by a wall or fence barrier shall be planted in grass and/or with some other vegetative ground cover; and
   (2) Parked vehicles may overhang a landscaped area no more than two and one-half feet (2½'), provided curbing or other wheel stops are installed to insure no greater overhang or penetration of the landscaped islands. Landscaping, walls, fences, and earthberms shall be located as to prevent their damage and/or destruction by overhanging vehicles.
 2. Interior
  a) Required Landscaping Area: Five percent (5%) of the interior of any parking, loading, or other vehicular use area shall be landscaped. The location of such landscaping is at the option of the owner or developer; provided, however, the following standards shall apply;
(1) Landscape Island: shall be at least nine feet (9') in width and eighteen feet (18') in length. Each island shall contain one large maturing tree plus shrubs and/or vegetative ground cover to cover the entire area.
(a) No more than ten (10) parking spaces shall be permitted in a continuous row without being interrupted by a landscaped island.
(b) Each parking row shall terminate in a landscape island.
(2) Median Strip: shall be at least ten feet (10') in width.
(a) Every fourth row of parking shall be separated by a median strip for landscaping and pedestrian purposes.
(b) Every median strip shall contain plantings of one large maturing tree at intervals of 30 to 40 feet, plus shrubs and/or vegetative ground cover to cover the entire area.
  b) Other Requirements:
   (1) All portions of the landscaping area not planted with trees shall be planted in grass and/or with some other vegetative ground cover; and
   (2) Parked vehicles may overhang a landscaped area no more than two and one-half feet (2½'), provided curbing or other wheel stops and installed to insure no greater overhang or penetration of the landscaped islands. Landscaping, walls, fences, and earthberms shall be located as to prevent their damage and/or destruction by overhanging vehicles.
D. Requirements for Front Setback
 1. Required Landscaping Area:
  a) Minimum Depth: 10 feet.
 2. Required Landscaping Materials:
  a) All portions of the landscaping area not planted with shrubs and trees or covered by a wall or fence barrier shall be planted in grass and/or with some other vegetative ground cover.
  b) 1 small maturing tree for every 100 square feet (Street trees or large maturing trees may be counted towards this requirement).
  c) Street trees, where required, shall be included as part of the required planting.
  d) 6 shrubs every 500 square feet.
  e) Approved ground cover.
E. Requirements For Boundaries Adjacent To Any Neighborhood Residential Zoning District and Existing Residential Uses in the District
 1. Required Buffer Area:
  a) Minimum Width: 20 feet.
 2. Required Buffering Materials:
  a) Buffering materials shall provide an opaque buffer to create a strong impression of a spatial separation and to preclude visual contact.
  b) 7 trees for every 100 linear feet.
  c) 50 shrubs per 100 linear feet.
  d) All portions of the landscaping area not planted with shrubs and trees or covered by a wall or fence barrier shall be planted in grass and/or with some other vegetative ground cover.
 3. Alternative 1: Buffering Requirements reduced by 25% (5 feet):
  a) Minimum width may be reduced by 25% or five (5) feet with use of a landscaped earth berm.
  b) Berms shall be constructed within the property boundary meeting the following requirements:
   (1) Minimum Height: 2 ft.
   (2) Minimum Crown Width: 2 ft.
   (3) Minimum Slope: 2:1
 4. Alternative 2: Buffering Requirements reduced by 50% (10 feet):
  a) Minimum width may be reduced by 50% or ten (10) feet and required number of shrubs reduced to 30 shrubs per 100 linear feet with use of landscaped wall or fence.
  b) Wall shall be solid and meet the standards for walls and fences set forth in this ordinance.
  c) Maximum wall height: 6 ft.
  d) Shrubs shall reach ⅓ of the height of the wall within 3 years.
 5. Alternative 3: Buffering Requirements reduced by 60% (12 feet):
  a) Minimum width may be reduced by 50% or twelve (12) feet and required number of shrubs reduced to 30 shrubs per 100 linear feet with use of landscaped wall or fence, and a planted earth berm.
  b) Berms shall be constructed within the property boundaries meeting the following requirements:
   (1) Minimum Height: 2 ft.
   (2) Minimum Crown Width: 2 ft.
   (3) Minimum Slope: 2:1
  c) Wall shall be solid and meet the standards for walls and fences set forth in Section 3.2.
  d) Maximum wall height: 6 ft.
  e) Shrubs shall reach ⅓ of the height of the wall within 3 years.
Signs: A. Intent. The purpose of these sign regulations are: to encourage the effective use of signs as a means of communication; to maintain and enhance the aesthetic environment; and to increase the City's ability to attract sources of economic development and growth; to improve pedestrian and traffic safety; to minimize the possible adverse effect of signs on nearby public and private property; and to enable the fair and consistent enforcement of these sign regulations.
B. Refer another section for general sign requirements.
C. No sign, or part thereof, may be altered, constructed, changed, converted, enlarged, or moved unless in conformity with the following requirements.
D. Sign Area: Shall be measures by height (A) by length (B) of the smallest rectangle that can be drawn to measure all sign elements. Unless otherwise noted, only one side or face of the same sign shall be used in computing sign area.
E. Allowed Signs: The applicant may select two (2) of the following six (6) choices for a sign type per street frontage:
 1. Wall Sign
  a) Maximum Size: 1 square foot per lineal foot of the building wall on which the sign is to be placed.
 2. Window Sign
  a) Maximum Size: 20% of the window area
 3. Projecting Sign
  a) Maximum Size: 16 square feet for one side
  b) Maximum Height: No projecting sign shall extend above the roof line.
  c) Clearance: 8' above ground level
 4. Awning Sign
  a) Maximum Size: 15% of exterior surface of the awning.
  b) Signs, symbols, or designs may be painted or sewn onto the awning.
 5. Freestanding Sign
  a) Maximum Size: 35 square feet.
  b) Maximum Height: 12 feet.
  c) Setback: No freestanding sign shall be closer than five (5) feet to an exterior property line.
  d) No more than one (1) freestanding sign shall be allowed per parcel.
 6. Directory Sign
  a) The parcel shall contain no more than one (1) directory sign.
  b) The maximum sign area shall not exceed three (3) inches by fifteen (15) inches for each identified activity, business, firm, or tenant.
  c) The directory sign may take the form of any sign permitted in the zoning district provided that such sign shall comply with its applicable specification. If the directory sign is a freestanding sign, no other freestanding shall be located on the parcel.
F. Prohibited Signs:
 1. Digital image or moving picture signs of any type.
 2. Signs projecting above the roof line.
 3. Any sign not listed as being allowed is prohibited.
G. Criteria for Bonus Sign Area. To encourage design excellence, the maximum sign areas for the Highway Commercial district may be increased by the percentages as provided herein. A separate bonus is granted for compliance with each of the criteria and the area is cumulative, but the percentage increase is based on the original sign area limitation.
 1. Wall sign which consists of individual letters or words mounted directly on the building surface: 15% increase permitted
 2. Coordinated signs in shopping centers or any three consecutive separate establishments, all the lettering and background is uniform in style and color: 10% increase permitted
 3. Gas stations that incorporate the price information into the main identification sign face: 10% increase permitted
 4. Sign is not internally illuminated (other than non-flashing neon): 15% increase permitted
 5. Ground sign is installed in a landscaped planted having an area four (4) times the area of the resultant sign for one sign face: 20% increase permitted
Storage: No open storage of junk or salvage materials is permitted with any use in the district.

   (1) All portions of the landscaping area not planted with shrubs and trees or covered by a wall or fence barrier shall be planted in grass and/or with some other vegetative ground cover; and
   (2) Parked vehicles may overhang a landscaped area no more than two and one-half feet (2½'), provided curbing or other wheel stops are installed to insure no greater overhang or penetration of the landscaped islands. Landscaping, walls, fences, and earthberms shall be located as to prevent their damage and/or destruction by overhanging vehicles.
 2. Interior
  a) Required Landscaping Area: Five percent (5%) of the interior of any parking, loading, or other vehicular use area shall be landscaped. The location of such landscaping is at the option of the owner or developer; provided, however, the following standards shall apply;
(1) Landscape Island: shall be at least nine feet (9') in width and eighteen feet (18') in length. Each island shall contain one large maturing tree plus shrubs and/or vegetative ground cover to cover the entire area.
(a) No more than ten (10) parking spaces shall be permitted in a continuous row without being interrupted by a landscaped island.
(b) Each parking row shall terminate in a landscape island.
(2) Median Strip: shall be at least ten feet (10') in width.
(a) Every fourth row of parking shall be separated by a median strip for landscaping and pedestrian purposes.
(b) Every median strip shall contain plantings of one large maturing tree at intervals of 30 to 40 feet, plus shrubs and/or vegetative ground cover to cover the entire area.
  b) Other Requirements:
   (1) All portions of the landscaping area not planted with trees shall be planted in grass and/or with some other vegetative ground cover; and
   (2) Parked vehicles may overhang a landscaped area no more than two and one-half feet (2½'), provided curbing or other wheel stops and installed to insure no greater overhang or penetration of the landscaped islands. Landscaping, walls, fences, and earthberms shall be located as to prevent their damage and/or destruction by overhanging vehicles.
 D. Requirements for Front Setback
 1. Required Landscaping Area:
  a) Minimum Depth: 10 feet.
 2. Required Landscaping Materials:
  a) All portions of the landscaping area not planted with shrubs and trees or covered by a wall or fence barrier shall be planted in grass and/or with some other vegetative ground cover.
  b) 1 small maturing tree for every 100 square feet (Street trees or large maturing trees may be counted towards this requirement).
  c) Street trees, where required, shall be included as part of the required planting.
  d) 6 shrubs every 500 square feet.
  e) Approved ground cover.
E. Requirements For Boundaries Adjacent To Any Residential Zoning District and Existing Residential Uses in the District
 1. Required Buffer Area:
  a) Minimum Width: 20 feet.
 2. Required Buffering Materials:
  a) Buffering materials shall provide an opaque buffer to create a strong impression of a spatial separation and to preclude visual contact.
  b) 7 trees for every 100 linear feet.
  c) 50 shrubs per 100 linear feet.
  d) All portions of the landscaping area not planted with shrubs and trees or covered by a wall or fence barrier shall be planted in grass and/or with some other vegetative ground cover.
 3. Alternative 1: Buffering Requirements reduced by 25% (5 feet):
  a) Minimum width may be reduced by 25% or five (5) feet with use of a landscaped earth berm.
  b) Berms shall be constructed within the property boundary meeting the following requirements:
   (1) Minimum Height: 2 ft.
   (2) Minimum Crown Width: 2 ft.
   (3) Minimum Slope: 2:1
 4. Alternative 2: Buffering Requirements reduced by 50% (10 feet):
  a) Minimum width may be reduced by 50% or ten (10) feet and required number of shrubs reduced to 30 shrubs per 100 linear feet with use of landscaped wall or fence.
  b) Wall shall be solid and meet the standards for walls and fences set forth in Section 3.2.
  c) Maximum wall height: 6 ft.
  d) Shrubs shall reach ⅓ of the height of the wall within 3 years.
 5. Alternative 3: Buffering Requirements reduced by 60% (12 feet):
  a) Minimum width may be reduced by 50% or twelve (12) feet and required number of shrubs reduced to 30 shrubs per 100 linear feet with use of landscaped wall or fence, and a planted earth berm.
  b) Berms shall be constructed within the property boundaries meeting the following requirements:
   (1) Minimum Height: 2 ft.
   (2) Minimum Crown Width: 2 ft.
   (3) Minimum Slope: 2:1
  c) Wall shall be solid and meet the standards for walls and fences set forth in Section 3.2.
   d) Maximum wall height: 6 ft.
   e) Shrubs shall reach ⅓ of the height of the wall within 3 years.
Signs: A. Intent. The purpose of these sign regulations are: to encourage the effective use of signs as a means of communication; to maintain and enhance the aesthetic environment; and to increase the City's ability to attract sources of economic development and growth; to improve pedestrian and traffic safety; to minimize the possible adverse effect of signs on nearby public and private property; and to enable the fair and consistent enforcement of these sign regulations.
B. Refer to another section for general sign requirements.
C. No sign, or part thereof, may be altered, constructed, changed, converted, enlarged, or moved unless in conformity with the following requirements.
D. Sign Area: Shall be measures by height (A) by length (B) of the smallest rectangle that can be drawn to measure all sign elements. Unless otherwise noted, only one side or face of the same sign shall be used in computing sign area.
E. Allowed Signs: The applicant may select two (2) of the following six (6) choices for a sign type per street frontage:
 1. Wall Sign
  a) Maximum Size: 1 square foot per lineal foot of the building wall on which the sign is to be placed.
 2. Window Sign
  a) Maximum Size: 20% of the window area
 3. Projecting Sign
  a) Maximum Size: 16 square feet for one side
  b) Maximum Height: No projecting sign shall extend above the roof line.
  c) Clearance: 8' above ground level
 4. Awning Sign
  a) Maximum Size: 15% of exterior surface of the awning.
  b) Signs, symbols, or designs may be painted or sewn onto the awning.
 5. Freestanding Sign
  a) Maximum Size: 35 square feet.
  b) Maximum Height: 12 feet.
  c) Setback: No freestanding sign shall be closer than five (5) feet to an exterior property line.
  d) No more than one (1) freestanding sign shall be allowed per parcel.
 6. Directory Sign
  a) The parcel shall contain no more than one (1) directory sign.
  b) The maximum sign area shall not exceed three (3) inches by fifteen (15) inches for each identified activity, business, firm, or tenant.
  c) The directory sign may take the form of any sign permitted in the zoning district provided that such sign shall comply with its applicable specification. If the directory sign is a freestanding sign, no other freestanding shall be located on the parcel.
F. Prohibited Signs:
 1. Digital or moving picture signs of any type.
 2. Signs projecting above the roof line.
 3. Any sign not listed as being allowed is prohibited.
G. Criteria for Bonus Sign Area. To encourage design excellence, the maximum sign areas for the Highway Commercial district may be increased by the percentages as provided herein. A separate bonus is granted for compliance with each of the criteria and the area is cumulative, but the percentage increase is based on the original sign area limitation.
 1. Wall sign which consists of individual letters or words mounted directly on the building surface: 15% increase permitted
 2. Coordinated signs in shopping centers or any three consecutive separate establishments, all the lettering and background is uniform in style and color: 10% increase permitted
 3. Gas stations that incorporate the price information into the main identification sign face: 10% increase permitted
 4. Sign is not internally illuminated (other than non-flashing neon): 15% increase permitted
 5. Ground sign is installed in a landscaped planted having an area four (4) times the area of the resultant sign for one sign face: 20% increase permitted
Subdivision regulations: Applicable regulations must be met.

§ 4-123. - PD Planned Development District Uses.

Planned Development districts may permit a mixture of different types of housing with compatible commercial uses, shopping centers, office parks and other mixed use developments. Flexibility in design, character and quality of development and preservation of natural and scenic features are made possible through the approval of a plan which describes the specific uses, densities, setbacks, and other requirements for a planned development. The approved plan constitutes the district regulations for a particular planned development.

§ 4-124. - PD Planned Development District Regulations.

The following regulations shall apply to all uses in PD districts, other provisions in this ordinance to the contrary notwithstanding:

Minimum site area: 3 acres.
Minimum lot area for structure: Set in approved plan.
Minimum lot width, yards, setbacks: Set in approved plan.
Maximum structure height: Sixty (60) feet when permitted by fire regulations (not applicable to church spires, belfries, cupolas, domes, chimneys, flag poles, antennae).
Off-street parking and loading requirements: Set in approved plan.
Landscaping: Set in approved plan, but not less than landscaping required by supplemental regulations, Chapter 5.
Signs: Set in approved plan, but not greater than signs allowed by supplemental regulations, Chapter 5.
Subdivision regulations: Applicable regulations must be met.
Supplemental regulations: See Chapter 5.

 

§ 4-125. - PD Planned Development District Application and Review Procedures.

The following procedures shall apply to establishment of a PD district, other provisions in this ordinance to the contrary notwithstanding:

a. Zoning amendment required: PD districts are established by amendment to the zoning ordinance in the manner prescribed for rezoning.
b. District regulations: The applicable regulations in § 4-124, Chapter 5, and those in the approved plan and descriptive statement shall constitute the PD district regulations for the site.
c. Preapplication conference optional: An applicant for PD zoning is encouraged, but not required, to contact the Planning Commission prior to submission of the application for information and review of the regulations and procedures applicable to the proposed plan and descriptive statement.
d. Amendment application required: Initiation of a PD amendment shall be by submission of an application form provided by the Zoning Administrator with required attachments.
e. Development plans required: A site development plan is a required attachment to application for PD amendment. The site development plan shall indicate the proposed uses of all land areas and such other information as the Zoning Administrator deems reasonably necessary for review.
f. Descriptive statement required: A descriptive statement is a required attachment to the application for PD amendment. The descriptive statement shall indicate the characteristics and standards to be used for development of the site, and shall include at least the following items:
 1. legal description of site boundaries, and total area of the site;
 2. area and location of each type of use;
 3. number and density of dwelling units by type;
 4. description of open space locations, uses and proposed dedication for public use;
 5. ownership and maintenance of streets, and proposed dedication to public;
 6. methods for dealing with parking and the impact of projected traffic on the uses on the site and adjacent districts and streets;
 7. steps proposed to comply with sediment control and storm drainage regulations;
 8. steps proposed to comply with landscaping regulations;
 9. details of association or organization involved in ownership and maintenance, including procedures and methods of operation;
 10. outline for development phasing with anticipated time frames;
 11. design standards, procedures and methods demonstrating that development will result in an integrated use district, functional and compatible with the area;
 12. proposed restrictive covenants to be recorded to assure future compliance with the standards in the plan; and
 13. such other information as may be appropriate for Planning Commission review.
g. Planning Commission review: Upon determination that the application meets above requirements, the Zoning Administrator shall forward the application to the Planning Commission for review and recommendation to City Council as required for zoning amendments.
h. City Council action: Upon receipt of the Planning Commission recommendation, City Council shall conduct a public hearing as required for zoning amendments, and may approve, approve with modifications accepted by applicant, or disapprove the proposed amendment.
i. Zoning and building permits: Zoning and building permits shall not be issued until the zoning is approved by City Council, and approved plats, the approved descriptive statement and all required restrictive covenants are filed for record with the Municipal Clerk and the Clerk of Court for Abbeville County, and all required bonds are posted with the Municipal Clerk.
j. District map: The site development plan approved by City Council shall be the zoning district map for the PD and shall be the basis for issuance of zoning and building permits.
k. Changes to plan: 1. Minor changes. Changes proposed in writing by the applicant which do not alter district boundaries and which involve revision of minor characteristics of the PD such as relocation of driveways, revision of floor plans, facades, landscaping, relocation of required parking, drainage structures, and features which do not materially affect the approved plan concept or violate any applicable regulations may be approved by the Zoning Administrator. Approval or rejection of the change is subject to review and final determination by the Planning Commission if the applicant or any party whose property is adversely affected files a written objection with the Planning Commission within ten (10) days after action by the Zoning Administrator. An applicant may submit a rejected change as an amendment to the plan under the normal zoning amendment procedures.
2. Major changes. Changes proposed in writing by the applicant which alter district boundaries or which materially affect the characteristics of the PD shall be submitted under normal zoning amendment procedures applicable to establishment of the PD.
3. Permits. No zoning or building permits involving a minor or major change of the PD descriptive statement or map shall be issued until the written change is filed with the Municipal Clerk and recorded in the office of the Clerk of Court for Abbeville County.
l. Failure to begin; failure to progress; failure to complete: If the responsible party fails to begin, fails to progress, or fails to complete development as agreed in the descriptive statement, City Council may charge the developer with violation of the zoning ordinance, may rezone the property, or may take any combination of these actions. In any event, if the planned development is not initiated within two years of its establishment, the Planning Commission shall initiate the rezoning of the property to an appropriate district classification in conformity with the comprehensive plan.
